為貫徹(che)落實黨的(de)十八(ba)屆四中(zhong)全會《關(guan)(guan)于(yu)全面推(tui)進(jin)依法(fa)治國若干重大問題的(de)決(jue)定(ding)》關(guan)(guan)于(yu)“加強(qiang)行業性(xing)(xing)、專(zhuan)業性(xing)(xing)人(ren)民(min)(min)調解(jie)組(zu)織(zhi)建設”的(de)要(yao)求,適應新形勢下化解(jie)行業、專(zhuan)業領域矛盾糾紛的(de)需要(yao),維護社會和諧穩定(ding),近日,司法(fa)部(bu)、中(zhong)央綜治辦(ban)、最(zui)高人(ren)民(min)(min)法(fa)院、民(min)(min)政部(bu)制定(ding)印發了《關(guan)(guan)于(yu)推(tui)進(jin)行業性(xing)(xing)、專(zhuan)業性(xing)(xing)人(ren)民(min)(min)調解(jie)工作的(de)指導意見》。1月18日,《法(fa)制日報》記者就指導意見的(de)有關(guan)(guan)問題采(cai)訪了司法(fa)部(bu)負責人(ren)。
創新發展新時期人民調解
問:當前,四部門聯合出臺指導意見有何重要意義?
答:推(tui)進(jin)行(xing)業(ye)(ye)性(xing)、專業(ye)(ye)性(xing)人民(min)調(diao)(diao)解(jie)工作,是(shi)適應經濟社(she)會(hui)發展、化解(jie)新(xin)(xin)型矛盾(dun)糾紛(fen)的迫(po)切需要,是(shi)維(wei)護(hu)群眾合法(fa)權益、促進(jin)社(she)會(hui)公平正(zheng)義的必然要求,是(shi)創(chuang)新(xin)(xin)社(she)會(hui)治(zhi)理、完善矛盾(dun)糾紛(fen)多元化解(jie)機制的重(zhong)要內容。近年來,各級司法(fa)行(xing)政機關圍繞中心、服務大局,積極推(tui)進(jin)行(xing)業(ye)(ye)性(xing)、專業(ye)(ye)性(xing)人民(min)調(diao)(diao)解(jie)工作,化解(jie)了大量矛盾(dun)糾紛(fen),取得了明(ming)顯成效(xiao)。實踐證明(ming),開展行(xing)業(ye)(ye)性(xing)、專業(ye)(ye)性(xing)人民(min)調(diao)(diao)解(jie)工作,充分發揮人民(min)調(diao)(diao)解(jie)職能(neng)作用(yong),是(shi)新(xin)(xin)時期人民(min)調(diao)(diao)解(jie)工作的創(chuang)新(xin)(xin)、發展,是(shi)人民(min)調(diao)(diao)解(jie)制度的豐富、完善。
黨的(de)十(shi)八(ba)屆四中全會(hui)(hui)從全面推進(jin)依(yi)法治國的(de)高度,對加強行(xing)(xing)業(ye)(ye)性、專業(ye)(ye)性人民調解工(gong)(gong)作(zuo)作(zuo)出部署,這(zhe)既是(shi)對近年來(lai)開展行(xing)(xing)業(ye)(ye)性、專業(ye)(ye)性人民調解工(gong)(gong)作(zuo)的(de)肯定(ding),也(ye)對新(xin)(xin)時期(qi)人民調解工(gong)(gong)作(zuo)提出了新(xin)(xin)的(de)更高的(de)要求(qiu)。指導(dao)意見的(de)印發(fa),對進(jin)一步加強和(he)規范行(xing)(xing)業(ye)(ye)性、專業(ye)(ye)性人民調解工(gong)(gong)作(zuo),依(yi)法及時化(hua)解相(xiang)關(guan)行(xing)(xing)業(ye)(ye)、專業(ye)(ye)領域矛盾(dun)糾紛,維護(hu)相(xiang)關(guan)行(xing)(xing)業(ye)(ye)領域正(zheng)常工(gong)(gong)作(zuo)秩序,維護(hu)社會(hui)(hui)和(he)諧(xie)穩定(ding),保(bao)障公平正(zheng)義(yi),促進(jin)經濟(ji)社會(hui)(hui)發(fa)展具有重要意義(yi)。
問:推進行業性、專業性人民調解工作的總體要求是什么?
答:指(zhi)(zhi)(zhi)導(dao)意見要(yao)求,加(jia)強行(xing)(xing)業(ye)(ye)性(xing)、專(zhuan)(zhuan)業(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)必須認(ren)真貫徹(che)落實(shi)黨的十八(ba)大(da)和(he)十八(ba)屆三(san)中、四中、五中全(quan)會(hui)(hui)精神(shen),以鄧小平(ping)理論、“三(san)個代表”重(zhong)(zhong)要(yao)思(si)想和(he)科(ke)學發(fa)展觀為指(zhi)(zhi)(zhi)導(dao),深入貫徹(che)落實(shi)習近平(ping)總書記系(xi)列重(zhong)(zhong)要(yao)講話精神(shen),按(an)照協(xie)調(diao)(diao)(diao)(diao)推進(jin)(jin)“四個全(quan)面(mian)(mian)”戰略(lve)布(bu)局的要(yao)求,全(quan)面(mian)(mian)貫徹(che)落實(shi)人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)法(fa),進(jin)(jin)一步加(jia)強行(xing)(xing)業(ye)(ye)性(xing)、專(zhuan)(zhuan)業(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)組織隊伍建設(she),健全(quan)部(bu)門間協(xie)調(diao)(diao)(diao)(diao)配合(he)機制,完善工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)制度(du),提(ti)升保障能力,有(you)效預防化(hua)解(jie)(jie)(jie)矛(mao)盾糾紛(fen),切實(shi)維護(hu)(hu)社會(hui)(hui)和(he)諧穩定。同(tong)時要(yao)求,推進(jin)(jin)行(xing)(xing)業(ye)(ye)性(xing)、專(zhuan)(zhuan)業(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)必須遵循以下原則:堅持(chi)黨委領導(dao),政府(fu)主導(dao),司法(fa)行(xing)(xing)政機關(guan)指(zhi)(zhi)(zhi)導(dao),相關(guan)部(bu)門密(mi)切配合(he),共(gong)同(tong)推進(jin)(jin)行(xing)(xing)業(ye)(ye)性(xing)、專(zhuan)(zhuan)業(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo);堅持(chi)以人(ren)(ren)(ren)(ren)為本,始終把維護(hu)(hu)雙(shuang)方當事人(ren)(ren)(ren)(ren)合(he)法(fa)權(quan)益作(zuo)(zuo)(zuo)(zuo)(zuo)為人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)的出發(fa)點(dian)(dian)和(he)落腳點(dian)(dian),根據當事人(ren)(ren)(ren)(ren)需(xu)求,提(ti)供便捷服務,維護(hu)(hu)雙(shuang)方合(he)法(fa)權(quan)益;堅持(chi)實(shi)事求是,因(yin)地制宜,不搞一刀切,從化(hua)解(jie)(jie)(jie)矛(mao)盾糾紛(fen)的實(shi)際需(xu)要(yao)出發(fa),積極推動設(she)立行(xing)(xing)業(ye)(ye)性(xing)、專(zhuan)(zhuan)業(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)組織;堅持(chi)尊重(zhong)(zhong)科(ke)學,根據矛(mao)盾糾紛(fen)的行(xing)(xing)業(ye)(ye)、專(zhuan)(zhuan)業(ye)(ye)特點(dian)(dian)和(he)規律,運用專(zhuan)(zhuan)業(ye)(ye)知識,借助(zhu)專(zhuan)(zhuan)業(ye)(ye)力量,提(ti)高調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)的權(quan)威性(xing)和(he)公信(xin)力;堅持(chi)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)創新(xin),充(chong)分發(fa)揮人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)優勢,大(da)力推進(jin)(jin)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)理念、制度(du)機制和(he)方式方法(fa)創新(xin),努(nu)力實(shi)現人(ren)(ren)(ren)(ren)民調(diao)(diao)(diao)(diao)解(jie)(jie)(jie)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)新(xin)發(fa)展、新(xin)跨越。
人民調解員專業化職業化
問:指導意見對行業性、專業性人民調解組織建設提出了哪些具體要求?
答:組(zu)(zu)(zu)織(zhi)(zhi)(zhi)(zhi)建(jian)(jian)設(she)(she)(she)(she)是(shi)做好行(xing)(xing)業(ye)(ye)(ye)(ye)性(xing)、專業(ye)(ye)(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)工(gong)作(zuo)(zuo)的基礎(chu)。根據人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)法的規(gui)定(ding),行(xing)(xing)業(ye)(ye)(ye)(ye)性(xing)、專業(ye)(ye)(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)委(wei)(wei)員(yuan)會(hui)(hui)(hui)是(shi)在司(si)法行(xing)(xing)政(zheng)機關(guan)(guan)指導下,依法設(she)(she)(she)(she)立(li)的調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)特定(ding)行(xing)(xing)業(ye)(ye)(ye)(ye)、專業(ye)(ye)(ye)(ye)領(ling)域矛(mao)盾糾紛的群(qun)眾性(xing)組(zu)(zu)(zu)織(zhi)(zhi)(zhi)(zhi)。指導意見要求,加強行(xing)(xing)業(ye)(ye)(ye)(ye)性(xing)、專業(ye)(ye)(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)組(zu)(zu)(zu)織(zhi)(zhi)(zhi)(zhi)建(jian)(jian)設(she)(she)(she)(she),一是(shi)司(si)法行(xing)(xing)政(zheng)機關(guan)(guan)要加強與有關(guan)(guan)行(xing)(xing)業(ye)(ye)(ye)(ye)主(zhu)管部門協調(diao)(diao)(diao)(diao)(diao)(diao)配合,根據相關(guan)(guan)行(xing)(xing)業(ye)(ye)(ye)(ye)、專業(ye)(ye)(ye)(ye)領(ling)域矛(mao)盾糾紛情況(kuang)和特點,指導人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)協會(hui)(hui)(hui)、相關(guan)(guan)行(xing)(xing)業(ye)(ye)(ye)(ye)協會(hui)(hui)(hui)等社(she)會(hui)(hui)(hui)團體(ti)和其他組(zu)(zu)(zu)織(zhi)(zhi)(zhi)(zhi),設(she)(she)(she)(she)立(li)行(xing)(xing)業(ye)(ye)(ye)(ye)性(xing)、專業(ye)(ye)(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)委(wei)(wei)員(yuan)會(hui)(hui)(hui)或(huo)依托現有的人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)委(wei)(wei)員(yuan)會(hui)(hui)(hui)設(she)(she)(she)(she)立(li)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)工(gong)作(zuo)(zuo)室(shi)(shi)。對于(yu)本地(di)相關(guan)(guan)行(xing)(xing)業(ye)(ye)(ye)(ye)、專業(ye)(ye)(ye)(ye)領(ling)域需(xu)要設(she)(she)(she)(she)立(li)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)組(zu)(zu)(zu)織(zhi)(zhi)(zhi)(zhi)的,要主(zhu)動向(xiang)黨委(wei)(wei)、政(zheng)府匯報(bao),總結借鑒(jian)醫療衛生、道路交通、勞動關(guan)(guan)系、家(jia)事關(guan)(guan)系等領(ling)域人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)工(gong)作(zuo)(zuo)的經(jing)驗,積極推動相關(guan)(guan)行(xing)(xing)業(ye)(ye)(ye)(ye)、專業(ye)(ye)(ye)(ye)領(ling)域人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)組(zu)(zu)(zu)織(zhi)(zhi)(zhi)(zhi)建(jian)(jian)設(she)(she)(she)(she)。二是(shi)對已設(she)(she)(she)(she)立(li)的行(xing)(xing)業(ye)(ye)(ye)(ye)性(xing)、專業(ye)(ye)(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)組(zu)(zu)(zu)織(zhi)(zhi)(zhi)(zhi)要進一步鞏固提高,依法規(gui)范(fan)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)委(wei)(wei)員(yuan)會(hui)(hui)(hui)的設(she)(she)(she)(she)立(li)、人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)員(yuan)選聘等,健全各項工(gong)作(zuo)(zuo)制度,強化(hua)學習(xi)培訓,提高工(gong)作(zuo)(zuo)能力,有效化(hua)解(jie)(jie)(jie)(jie)矛(mao)盾糾紛。三是(shi)行(xing)(xing)業(ye)(ye)(ye)(ye)性(xing)、專業(ye)(ye)(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)委(wei)(wei)員(yuan)會(hui)(hui)(hui)要以方便群(qun)眾調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)為目的選擇辦公(gong)地(di)點,辦公(gong)場(chang)所(suo)應包括(kuo)接待室(shi)(shi)、調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)室(shi)(shi)、檔案室(shi)(shi)等。行(xing)(xing)業(ye)(ye)(ye)(ye)性(xing)、專業(ye)(ye)(ye)(ye)性(xing)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)調(diao)(diao)(diao)(diao)(diao)(diao)解(jie)(jie)(jie)(jie)委(wei)(wei)員(yuan)會(hui)(hui)(hui)應當自(zi)設(she)(she)(she)(she)立(li)或(huo)變更之日起三十(shi)日內,將調(diao)(diao)(diao)(diao)(diao)(diao)委(wei)(wei)會(hui)(hui)(hui)名(ming)稱、人(ren)(ren)(ren)(ren)(ren)(ren)員(yuan)組(zu)(zu)(zu)成、工(gong)作(zuo)(zuo)地(di)址(zhi)、聯系方式(shi)等情況(kuang)報(bao)所(suo)在地(di)縣(xian)(xian)級(ji)司(si)法行(xing)(xing)政(zheng)機關(guan)(guan),縣(xian)(xian)級(ji)司(si)法行(xing)(xing)政(zheng)機關(guan)(guan)應及時通報(bao)所(suo)在地(di)綜治(zhi)組(zu)(zu)(zu)織(zhi)(zhi)(zhi)(zhi)和基層人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)(min)(min)(min)法院。
問:為進一步加強行業性、專業性人民調解員隊伍建設,指導意見提出了哪些要求?
