——公安部負責人就深化公安執法規范化建設答記者問
近日,中(zhong)共中(zhong)央(yang)辦公(gong)廳(ting)、國務院辦公(gong)廳(ting)印發《關(guan)于深化公(gong)安執法規范化建設的意見(jian)》(以(yi)下簡稱《意見(jian)》)。日前,公(gong)安部負責人就深化公(gong)安執法規范化建設的有關(guan)情況回(hui)答了(le)記者提問。
問:如何認識深化公安執法規范化建設的意義及作用?
答(da):深(shen)化公(gong)(gong)安執(zhi)法(fa)(fa)規范(fan)化建(jian)設(she)(she),在(zai)(zai)整(zheng)個公(gong)(gong)安工作(zuo)中居于全(quan)局性、基礎性地位(wei),對全(quan)面(mian)(mian)推(tui)進(jin)依法(fa)(fa)治國具(ju)有(you)十分重要的(de)作(zuo)用(yong)。公(gong)(gong)安機關(guan)作(zuo)為國家(jia)重要的(de)行(xing)政(zheng)執(zhi)法(fa)(fa)和刑事(shi)(shi)司法(fa)(fa)力(li)量,是(shi)全(quan)面(mian)(mian)推(tui)進(jin)依法(fa)(fa)治國的(de)踐行(xing)者、推(tui)動者、保(bao)障者,公(gong)(gong)安工作(zuo)法(fa)(fa)治化水平(ping)直接關(guan)系職責任務的(de)依法(fa)(fa)履行(xing)和國家(jia)法(fa)(fa)律的(de)有(you)效實施,事(shi)(shi)關(guan)社會大局穩定和人(ren)(ren)民群眾切身(shen)利益,事(shi)(shi)關(guan)憲(xian)法(fa)(fa)法(fa)(fa)律權威和社會公(gong)(gong)平(ping)正(zheng)義,事(shi)(shi)關(guan)政(zheng)府法(fa)(fa)治形象和執(zhi)法(fa)(fa)公(gong)(gong)信力(li)。深(shen)化執(zhi)法(fa)(fa)規范(fan)化建(jian)設(she)(she)、全(quan)面(mian)(mian)建(jian)設(she)(she)法(fa)(fa)治公(gong)(gong)安的(de)目的(de),就(jiu)是(shi)要更好地發揮公(gong)(gong)安機關(guan)在(zai)(zai)全(quan)面(mian)(mian)推(tui)進(jin)依法(fa)(fa)治國中的(de)生力(li)軍作(zuo)用(yong),切實履行(xing)好黨和人(ren)(ren)民賦予(yu)的(de)職責使命。
新(xin)形勢新(xin)任務(wu)新(xin)要(yao)求(qiu)迫(po)切需(xu)要(yao)著(zhu)力(li)建(jian)設與之相(xiang)(xiang)適應(ying)的法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)公(gong)(gong)安(an)(an),不(bu)(bu)斷增強公(gong)(gong)安(an)(an)機(ji)關依法(fa)(fa)(fa)(fa)(fa)(fa)(fa)履(lv)職能(neng)(neng)力(li)。近年來,全國(guo)公(gong)(gong)安(an)(an)機(ji)關堅持不(bu)(bu)懈、持之以(yi)恒地狠抓(zhua)執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)規(gui)范化建(jian)設,無論是(shi)在(zai)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)觀念(nian)(nian)、群眾(zhong)(zhong)觀念(nian)(nian)和執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)理(li)念(nian)(nian)、執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)能(neng)(neng)力(li)上,還(huan)(huan)是(shi)在(zai)權力(li)運行、管(guan)理(li)監督(du)和執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)質量、執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)公(gong)(gong)信力(li)上都有(you)了明顯(xian)提(ti)(ti)高,廣大公(gong)(gong)安(an)(an)民(min)警(jing)牢記使命、忠實(shi)履(lv)職,涌現出(chu)了以(yi)吳春忠、崔光日、汪(wang)勇、買買提(ti)(ti)江·托乎尼(ni)亞孜等(deng)為(wei)代(dai)表的一批執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)為(wei)民(min)先進典型,為(wei)維(wei)護國(guo)家(jia)安(an)(an)全和社(she)會穩定、服(fu)務(wu)經濟社(she)會發展和人民(min)群眾(zhong)(zhong)作出(chu)了重大貢(gong)獻。但我(wo)們也(ye)清醒看到,與協調推(tui)進“四個全面”戰(zhan)略布局的新(xin)形勢新(xin)任務(wu)相(xiang)(xiang)比,與黨(dang)和人民(min)的新(xin)要(yao)求(qiu)新(xin)期待相(xiang)(xiang)比,當前公(gong)(gong)安(an)(an)執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)工(gong)作還(huan)(huan)存在(zai)很多不(bu)(bu)適應(ying)、不(bu)(bu)符合的地方,一些(xie)民(min)警(jing)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)觀念(nian)(nian)不(bu)(bu)強、執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)素養不(bu)(bu)高,運用(yong)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)思(si)維(wei)、法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)方式處(chu)理(li)新(xin)情況新(xin)問(wen)題能(neng)(neng)力(li)仍需(xu)進一步(bu)提(ti)(ti)升(sheng),執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)標準、操作規(gui)程、管(guan)理(li)監督(du)等(deng)制度機(ji)制還(huan)(huan)不(bu)(bu)夠完善、嚴(yan)密,執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)不(bu)(bu)嚴(yan)格、不(bu)(bu)規(gui)范、不(bu)(bu)公(gong)(gong)正、不(bu)(bu)文明等(deng)問(wen)題還(huan)(huan)時有(you)發生,群眾(zhong)(zhong)反(fan)映強烈。為(wei)此,必須把深化公(gong)(gong)安(an)(an)執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)規(gui)范化建(jian)設擺上更(geng)加突出(chu)的位置,拿出(chu)一系列硬(ying)招(zhao)、實(shi)招(zhao),在(zai)抓(zhua)根治(zhi)本、解(jie)決(jue)問(wen)題、破解(jie)難題上下功夫求(qiu)實(shi)效,在(zai)更(geng)高層次、更(geng)高水平(ping)上建(jian)設法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)公(gong)(gong)安(an)(an),不(bu)(bu)斷提(ti)(ti)升(sheng)公(gong)(gong)安(an)(an)機(ji)關的依法(fa)(fa)(fa)(fa)(fa)(fa)(fa)履(lv)職能(neng)(neng)力(li)和執(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)公(gong)(gong)信力(li)。
問:新形勢下如何進一步深化公安執法規范化建設?
答:黨(dang)中(zhong)央高度重視公(gong)(gong)安(an)執(zhi)法(fa)(fa)(fa)規范(fan)化(hua)(hua)(hua)建設工作(zuo)(zuo)。黨(dang)的(de)十(shi)八大以來(lai)(lai),習(xi)近(jin)平總(zong)書記就政法(fa)(fa)(fa)機關(guan)嚴格執(zhi)法(fa)(fa)(fa)、公(gong)(gong)正司(si)法(fa)(fa)(fa)作(zuo)(zuo)出(chu)了(le)一(yi)系列重要(yao)指示,明(ming)確要(yao)求(qiu)公(gong)(gong)安(an)機關(guan)堅持(chi)嚴格規范(fan)公(gong)(gong)正文明(ming)執(zhi)法(fa)(fa)(fa),在全(quan)面(mian)推進依法(fa)(fa)(fa)治國(guo)中(zhong)發(fa)揮生力軍作(zuo)(zuo)用(yong)。在中(zhong)央全(quan)面(mian)深(shen)化(hua)(hua)(hua)改革領導(dao)(dao)小(xiao)組(zu)的(de)領導(dao)(dao)下(xia),在中(zhong)央司(si)法(fa)(fa)(fa)體制改革領導(dao)(dao)小(xiao)組(zu)的(de)指導(dao)(dao)下(xia),公(gong)(gong)安(an)部認真總(zong)結近(jin)年來(lai)(lai)執(zhi)法(fa)(fa)(fa)規范(fan)化(hua)(hua)(hua)建設的(de)經驗(yan)做(zuo)法(fa)(fa)(fa),全(quan)面(mian)檢視執(zhi)法(fa)(fa)(fa)工作(zuo)(zuo)中(zhong)的(de)問題和(he)不足(zu),在深(shen)入調研論(lun)證和(he)廣(guang)泛(fan)征求(qiu)有關(guan)部門(men)意見(jian)的(de)基礎上,研究(jiu)形成了(le)深(shen)化(hua)(hua)(hua)公(gong)(gong)安(an)執(zhi)法(fa)(fa)(fa)規范(fan)化(hua)(hua)(hua)建設的(de)意見(jian)。今(jin)年5月20日(ri),習(xi)近(jin)平總(zong)書記主持(chi)召開中(zhong)央全(quan)面(mian)深(shen)化(hua)(hua)(hua)改革領導(dao)(dao)小(xiao)組(zu)會議(yi)審議(yi)通(tong)過(guo)《意見(jian)》并發(fa)表重要(yao)講話,明(ming)確了(le)深(shen)化(hua)(hua)(hua)公(gong)(gong)安(an)執(zhi)法(fa)(fa)(fa)規范(fan)化(hua)(hua)(hua)建設的(de)指導(dao)(dao)思(si)想、總(zong)體目(mu)標、基本原(yuan)則和(he)工作(zuo)(zuo)要(yao)求(qiu),為進一(yi)步做(zuo)好新形勢下(xia)的(de)公(gong)(gong)安(an)執(zhi)法(fa)(fa)(fa)工作(zuo)(zuo)提供了(le)基本遵(zun)循。
《意(yi)見》對(dui)深化(hua)公(gong)安(an)(an)(an)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)規(gui)范化(hua)建(jian)設作出了全面系(xi)統的(de)(de)(de)(de)部署,標志著(zhu)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)公(gong)安(an)(an)(an)建(jian)設進(jin)入了一(yi)個新的(de)(de)(de)(de)階段。一(yi)是踐行(xing)為(wei)(wei)民(min)理念。強(qiang)(qiang)調(diao)遵循以人(ren)民(min)為(wei)(wei)中心(xin)的(de)(de)(de)(de)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)理念,要求(qiu)每(mei)一(yi)名(ming)民(min)警都要內植于(yu)心(xin)、外踐于(yu)行(xing),在(zai)每(mei)一(yi)項執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)活(huo)動、每(mei)一(yi)起(qi)案件辦理中,始(shi)終站在(zai)人(ren)民(min)的(de)(de)(de)(de)立場(chang),體(ti)(ti)(ti)(ti)現(xian)人(ren)民(min)的(de)(de)(de)(de)意(yi)志,落實(shi)(shi)為(wei)(wei)民(min)的(de)(de)(de)(de)要求(qiu),維護人(ren)民(min)的(de)(de)(de)(de)利益。二是著(zhu)力(li)構(gou)建(jian)體(ti)(ti)(ti)(ti)系(xi)。著(zhu)眼完善公(gong)安(an)(an)(an)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)權(quan)力(li)運(yun)行(xing)機制,構(gou)建(jian)完備的(de)(de)(de)(de)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)制度(du)體(ti)(ti)(ti)(ti)系(xi)、規(gui)范的(de)(de)(de)(de)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)辦案體(ti)(ti)(ti)(ti)系(xi)、系(xi)統的(de)(de)(de)(de)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)管理體(ti)(ti)(ti)(ti)系(xi)、實(shi)(shi)戰(zhan)的(de)(de)(de)(de)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)培訓(xun)體(ti)(ti)(ti)(ti)系(xi)、有力(li)的(de)(de)(de)(de)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)保(bao)障體(ti)(ti)(ti)(ti)系(xi),實(shi)(shi)現(xian)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)隊伍專(zhuan)業化(hua)、執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)行(xing)為(wei)(wei)標準(zhun)化(hua)、執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)管理系(xi)統化(hua)、執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)流程信息化(hua)。三是規(gui)范執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)行(xing)為(wei)(wei)。圍(wei)繞公(gong)安(an)(an)(an)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)中的(de)(de)(de)(de)重點方(fang)(fang)面和(he)(he)關(guan)(guan)鍵環節,就規(gui)范執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)依據、執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)程序(xu)、執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)行(xing)為(wei)(wei)和(he)(he)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)決策、執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)監督、責任追究機制等(deng),提出一(yi)系(xi)列加強(qiang)(qiang)和(he)(he)改進(jin)的(de)(de)(de)(de)具體(ti)(ti)(ti)(ti)措施,保(bao)證執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)工(gong)作始(shi)終在(zai)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)軌道內運(yun)行(xing)。四(si)是強(qiang)(qiang)化(hua)能力(li)建(jian)設。強(qiang)(qiang)調(diao)抓住領導(dao)干部“關(guan)(guan)鍵少數”和(he)(he)基層(ceng)一(yi)線執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)主體(ti)(ti)(ti)(ti),建(jian)立健全常態化(hua)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)教育培訓(xun)機制,實(shi)(shi)行(xing)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律(lv)要求(qiu)與實(shi)(shi)戰(zhan)應用相結合執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)培訓(xun)模(mo)式,不(bu)斷提升(sheng)運(yun)用法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)思(si)維和(he)(he)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)方(fang)(fang)式維護穩定、治(zhi)(zhi)理社會(hui)(hui)的(de)(de)(de)(de)能力(li)。五(wu)是營造法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)環境(jing)。在(zai)嚴格要求(qiu)內部的(de)(de)(de)(de)同時,針(zhen)對(dui)影(ying)響和(he)(he)制約公(gong)安(an)(an)(an)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)工(gong)作的(de)(de)(de)(de)一(yi)些外部因素,就加強(qiang)(qiang)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)保(bao)障、創造良好(hao)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)環境(jing)等(deng)提出明確要求(qiu),支持保(bao)障公(gong)安(an)(an)(an)機關(guan)(guan)依法(fa)(fa)(fa)(fa)(fa)(fa)(fa)行(xing)使(shi)職權(quan),為(wei)(wei)公(gong)安(an)(an)(an)執(zhi)(zhi)(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)工(gong)作營造良好(hao)社會(hui)(hui)氛圍(wei)。
據此(ci),《意見》提(ti)出了(le)八個方面的(de)重點(dian)任務,包括推進公安重點(dian)立(li)法、健全依(yi)法決策機制(zhi)、完善執(zhi)法制(zhi)度機制(zhi)、改進行政管(guan)理工作(zuo)、完善執(zhi)法監督管(guan)理體系、深化(hua)執(zhi)法信息化(hua)建設、提(ti)升執(zhi)法主(zhu)體依(yi)法履職能力、加強(qiang)綜合保障等50多(duo)項(xiang)具體措(cuo)施。
問:在具體的執法活動和案件辦理中怎樣體現以人民為中心的執法理念?
答:公安機(ji)關踐行以人(ren)(ren)民為(wei)中(zhong)(zhong)心的執(zhi)法(fa)(fa)理(li)念,就是要堅持把維護最廣大(da)人(ren)(ren)民利(li)益作為(wei)出發點(dian)和落腳點(dian),把人(ren)(ren)民群眾滿意作為(wei)根(gen)本(ben)標準,把人(ren)(ren)民群眾對嚴(yan)格規范公正文明執(zhi)法(fa)(fa)的期待(dai)和要求落實(shi)到每(mei)一項執(zhi)法(fa)(fa)活動、每(mei)一起案件辦理(li)中(zhong)(zhong),努力讓(rang)人(ren)(ren)民群眾感受到社會公平正義(yi)。
