日前,國務院辦公廳印發(fa)《關(guan)于加(jia)強(qiang)行(xing)政規范性文(wen)件(jian)制定和監督管(guan)理工作的通知(zhi)》(以下簡稱《通知(zhi)》)。司法部有關(guan)負責(ze)人就有關(guan)問題接(jie)受記者采(cai)訪。
記者:當前制定出臺《通知》有什么重要意義?
有關負責人:《通知(zhi)(zhi)》是(shi)(shi)(shi)(shi)目前第一個從國(guo)(guo)家(jia)層(ceng)面(mian)對行(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范性文(wen)件的(de)(de)概念、制定程序、監督(du)(du)管理(li)(li)作出(chu)全(quan)面(mian)、系統(tong)規(gui)(gui)定的(de)(de)文(wen)件,也是(shi)(shi)(shi)(shi)從源頭上規(gui)(gui)范行(xing)(xing)政(zheng)(zheng)(zheng)管理(li)(li)和(he)執法(fa)(fa)(fa)依據的(de)(de)重要(yao)(yao)措(cuo)施。加強行(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范性文(wen)件制定和(he)監督(du)(du)管理(li)(li)、遏止“奇葩”文(wen)件出(chu)臺,是(shi)(shi)(shi)(shi)全(quan)面(mian)貫(guan)徹(che)習近(jin)平新時代中國(guo)(guo)特色社(she)會主義(yi)思想和(he)黨(dang)的(de)(de)十九大(da)關于(yu)“深(shen)化依法(fa)(fa)(fa)治(zhi)國(guo)(guo)實(shi)(shi)踐”要(yao)(yao)求的(de)(de)重要(yao)(yao)舉(ju)措(cuo),是(shi)(shi)(shi)(shi)落實(shi)(shi)黨(dang)中央、國(guo)(guo)務院關于(yu)推進(jin)依法(fa)(fa)(fa)行(xing)(xing)政(zheng)(zheng)(zheng)、建設法(fa)(fa)(fa)治(zhi)政(zheng)(zheng)(zheng)府部署要(yao)(yao)求的(de)(de)重要(yao)(yao)抓(zhua)手。全(quan)面(mian)貫(guan)徹(che)落實(shi)(shi)《通知(zhi)(zhi)》各(ge)項要(yao)(yao)求,對切實(shi)(shi)保護(hu)人民群眾合法(fa)(fa)(fa)權(quan)益、增強政(zheng)(zheng)(zheng)府公信力和(he)執行(xing)(xing)力、建設人民滿(man)意的(de)(de)服務型(xing)政(zheng)(zheng)(zheng)府具有十分重要(yao)(yao)的(de)(de)作用,對堅持依法(fa)(fa)(fa)治(zhi)國(guo)(guo)、依法(fa)(fa)(fa)執政(zheng)(zheng)(zheng)、依法(fa)(fa)(fa)行(xing)(xing)政(zheng)(zheng)(zheng)共同(tong)推進(jin),堅持法(fa)(fa)(fa)治(zhi)國(guo)(guo)家(jia)、法(fa)(fa)(fa)治(zhi)政(zheng)(zheng)(zheng)府、法(fa)(fa)(fa)治(zhi)社(she)會一體(ti)建設,實(shi)(shi)現(xian)國(guo)(guo)家(jia)治(zhi)理(li)(li)體(ti)系和(he)治(zhi)理(li)(li)能力現(xian)代化具有十分重要(yao)(yao)的(de)(de)意義(yi)。
記者:制定出臺《通知》有什么背景?
有關負責人:制(zhi)發(fa)(fa)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范(fan)性文(wen)(wen)件(jian)(jian)(jian)是行(xing)(xing)(xing)政(zheng)(zheng)(zheng)機關依法履行(xing)(xing)(xing)管(guan)(guan)理職能的重(zhong)(zhong)要方(fang)式(shi)和(he)(he)手段,直(zhi)接關系(xi)人(ren)民(min)(min)群眾切身利(li)益,事關政(zheng)(zheng)(zheng)府(fu)(fu)形象。黨中央(yang)、國務院高度重(zhong)(zhong)視行(xing)(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范(fan)性文(wen)(wen)件(jian)(jian)(jian)制(zhi)定(ding)(ding)(ding)(ding)(ding)和(he)(he)監(jian)(jian)督管(guan)(guan)理工(gong)作,黨的十八(ba)屆三中全會(hui)、四中全會(hui)決定(ding)(ding)(ding)(ding)(ding),中共中央(yang)、國務院印發(fa)(fa)的《法治(zhi)政(zheng)(zheng)(zheng)府(fu)(fu)建設實施(shi)綱(gang)要(2015-2020 年)》對(dui)(dui)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范(fan)性文(wen)(wen)件(jian)(jian)(jian)合(he)法性審查(cha)和(he)(he)備(bei)案監(jian)(jian)督提出(chu)明確要求(qiu)。近(jin)年來(lai),各(ge)地(di)區(qu)、各(ge)部(bu)門(men)不斷加(jia)強(qiang)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范(fan)性文(wen)(wen)件(jian)(jian)(jian)制(zhi)定(ding)(ding)(ding)(ding)(ding)和(he)(he)監(jian)(jian)督管(guan)(guan)理工(gong)作,31 個(ge)(ge)省、自治(zhi)區(qu)、直(zhi)轄(xia)市人(ren)民(min)(min)政(zheng)(zheng)(zheng)府(fu)(fu)和(he)(he)37 個(ge)(ge)較大的市人(ren)民(min)(min)政(zheng)(zheng)(zheng)府(fu)(fu)先后出(chu)臺有(you)關行(xing)(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范(fan)性文(wen)(wen)件(jian)(jian)(jian)制(zhi)定(ding)(ding)(ding)(ding)(ding)、監(jian)(jian)督、管(guan)(guan)理和(he)(he)備(bei)案的規(gui)(gui)章150 部(bu)(現(xian)行(xing)(xing)(xing)有(you)效的 78 部(bu))。總(zong)的來(lai)看,各(ge)地(di)區(qu)、各(ge)部(bu)門(men)積極采取措施(shi)提升行(xing)(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范(fan)性文(wen)(wen)件(jian)(jian)(jian)質量,取得了(le)一定(ding)(ding)(ding)(ding)(ding)成效,但(dan)一些地(di)方(fang)和(he)(he)部(bu)門(men)亂發(fa)(fa)文(wen)(wen)、出(chu)臺“奇葩(pa)”文(wen)(wen)件(jian)(jian)(jian)的現(xian)象還(huan)(huan)不同程(cheng)度存在,群眾反映很大。比如,有(you)的強(qiang)制(zhi)要求(qiu)企業(ye)辦(ban)(ban)理誠信(xin)檔案時捆綁不合(he)理條件(jian)(jian)(jian),有(you)的指定(ding)(ding)(ding)(ding)(ding)消費本地(di)產品,甚(shen)至還(huan)(huan)有(you)的規(gui)(gui)定(ding)(ding)(ding)(ding)(ding)取消職工(gong)休(xiu)假(jia)、禁止(zhi)城(cheng)鄉居民(min)(min)復(fu)婚辦(ban)(ban)酒席。這類文(wen)(wen)件(jian)(jian)(jian)嚴重(zhong)(zhong)侵犯了(le)公(gong)民(min)(min)、法人(ren)和(he)(he)其他(ta)組(zu)織(zhi)的合(he)法權(quan)益,極大損害了(le)政(zheng)(zheng)(zheng)府(fu)(fu)公(gong)信(xin)力。造成這些問題的原因,既(ji)有(you)治(zhi)理理念(nian)和(he)(he)方(fang)式(shi)問題,也有(you)不按法定(ding)(ding)(ding)(ding)(ding)程(cheng)序出(chu)臺政(zheng)(zheng)(zheng)策文(wen)(wen)件(jian)(jian)(jian)問題,還(huan)(huan)有(you)監(jian)(jian)督不力、責任(ren)追究(jiu)機制(zhi)不健全等方(fang)面(mian)的問題。為加(jia)強(qiang)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)規(gui)(gui)范(fan)性文(wen)(wen)件(jian)(jian)(jian)制(zhi)定(ding)(ding)(ding)(ding)(ding)和(he)(he)監(jian)(jian)督管(guan)(guan)理、有(you)效遏止(zhi)“奇葩(pa)”政(zheng)(zheng)(zheng)策文(wen)(wen)件(jian)(jian)(jian)出(chu)臺,國務院辦(ban)(ban)公(gong)廳印發(fa)(fa)《通知》,從(cong)3 個(ge)(ge)方(fang)面(mian)有(you)針(zhen)對(dui)(dui)性地(di)規(gui)(gui)定(ding)(ding)(ding)(ding)(ding)了(le)11 項措施(shi)。
記者:在《通知》起草過程中針對實際問題主要把握了哪些原則?
有關負責人:在起草過(guo)程中,重(zhong)點(dian)把(ba)握了(le)以下五點(dian):一(yi)(yi)是(shi)(shi)全面(mian)貫徹落實習近平新時代(dai)中國(guo)特色社會主義思想和(he)黨的(de)(de)(de)十九(jiu)大精神,按照黨的(de)(de)(de)十九(jiu)大關(guan)于“堅持(chi)全面(mian)依(yi)法(fa)(fa)治(zhi)國(guo)” “深(shen)化依(yi)法(fa)(fa)治(zhi)國(guo)實踐”的(de)(de)(de)部(bu)署要(yao)求,把(ba)加(jia)強(qiang)(qiang)行(xing)政(zheng)規(gui)(gui)(gui)范(fan)性(xing)文件制(zhi)(zhi)定和(he)監督(du)(du)管(guan)理(li)作(zuo)(zuo)為(wei)全面(mian)貫徹落實黨的(de)(de)(de)十九(jiu)大關(guan)于“維護國(guo)家法(fa)(fa)制(zhi)(zhi)統一(yi)(yi)、尊(zun)嚴、權(quan)威”的(de)(de)(de)重(zhong)要(yao)方(fang)式,作(zuo)(zuo)為(wei)建設(she)法(fa)(fa)治(zhi)政(zheng)府、推進(jin)依(yi)法(fa)(fa)行(xing)政(zheng)的(de)(de)(de)重(zhong)要(yao)內容。二是(shi)(shi)始終把(ba)國(guo)務院領導(dao)同志(zhi)的(de)(de)(de)重(zhong)要(yao)批示精神作(zuo)(zuo)為(wei)起草工作(zuo)(zuo)的(de)(de)(de)重(zhong)要(yao)原(yuan)則,堅持(chi)法(fa)(fa)定職責必須(xu)為(wei)、法(fa)(fa)無(wu)授權(quan)不可為(wei),切(qie)(qie)實規(gui)(gui)(gui)范(fan)制(zhi)(zhi)發程序,健(jian)全責任(ren)機制(zhi)(zhi)。三是(shi)(shi)堅持(chi)與糾(jiu)正(zheng)“四風(feng)(feng)”相結合(he),把(ba)進(jin)一(yi)(yi)步加(jia)強(qiang)(qiang)行(xing)政(zheng)規(gui)(gui)(gui)范(fan)性(xing)文件制(zhi)(zhi)定和(he)監督(du)(du)管(guan)理(li)作(zuo)(zuo)為(wei)糾(jiu)正(zheng)“四風(feng)(feng)”、加(jia)強(qiang)(qiang)作(zuo)(zuo)風(feng)(feng)建設(she)的(de)(de)(de)重(zhong)要(yao)抓(zhua)手。四是(shi)(shi)堅持(chi)問題導(dao)向,緊(jin)緊(jin)圍繞當(dang)前“奇葩”文件存在的(de)(de)(de)主要(yao)問題和(he)產(chan)生(sheng)原(yuan)因進(jin)行(xing)制(zhi)(zhi)度設(she)計,切(qie)(qie)實增強(qiang)(qiang)針對(dui)性(xing)和(he)有效(xiao)性(xing)。五是(shi)(shi)注重(zhong)與現(xian)有規(gui)(gui)(gui)定相結合(he),認真研究梳(shu)理(li)國(guo)務院辦(ban)公廳(ting)近年來(lai)關(guan)于加(jia)強(qiang)(qiang)文件審(shen)核把(ba)關(guan)的(de)(de)(de)有關(guan)規(gui)(gui)(gui)定,以及一(yi)(yi)些(xie)地方(fang)和(he)部(bu)門就加(jia)強(qiang)(qiang)行(xing)政(zheng)規(gui)(gui)(gui)范(fan)性(xing)文件制(zhi)(zhi)定和(he)監督(du)(du)管(guan)理(li)作(zuo)(zuo)出的(de)(de)(de)規(gui)(gui)(gui)定,對(dui)實踐中的(de)(de)(de)好(hao)經驗(yan)、好(hao)做法(fa)(fa)進(jin)行(xing)了(le)總結提升和(he)創新發展。
記者:《通知》在防止亂發文方面提出了哪些要求?
有關負責人:《通知》提出(chu)(chu),要(yao)嚴(yan)格依法(fa)行(xing)(xing)政(zheng)(zheng)、切實防止亂(luan)發(fa)(fa)文(wen)(wen)(wen)(wen)。從嚴(yan)禁越權(quan)(quan)(quan)(quan)發(fa)(fa)文(wen)(wen)(wen)(wen)、嚴(yan)控發(fa)(fa)文(wen)(wen)(wen)(wen)數量(liang)(liang)兩(liang)個方(fang)面(mian)作(zuo)了明確要(yao)求。一是各地區、各部(bu)門要(yao)堅持法(fa)定(ding)職責必須為、法(fa)無(wu)授(shou)權(quan)(quan)(quan)(quan)不(bu)(bu)(bu)(bu)(bu)(bu)可為,嚴(yan)格按照(zhao)法(fa)定(ding)權(quan)(quan)(quan)(quan)限(xian)(xian)履(lv)行(xing)(xing)法(fa)定(ding)職責,嚴(yan)禁以部(bu)門內(nei)(nei)(nei)設機構名義發(fa)(fa)文(wen)(wen)(wen)(wen)。制(zhi)(zhi)發(fa)(fa)行(xing)(xing)政(zheng)(zheng)規(gui)范性文(wen)(wen)(wen)(wen)件(jian)要(yao)嚴(yan)守五個“不(bu)(bu)(bu)(bu)(bu)(bu)得(de)”,即不(bu)(bu)(bu)(bu)(bu)(bu)得(de)增(zeng)(zeng)加法(fa)律(lv)、法(fa)規(gui)規(gui)定(ding)之(zhi)外的(de)行(xing)(xing)政(zheng)(zheng)權(quan)(quan)(quan)(quan)力事項(xiang)或者(zhe)(zhe)減(jian)少(shao)法(fa)定(ding)職責;不(bu)(bu)(bu)(bu)(bu)(bu)得(de)設定(ding)行(xing)(xing)政(zheng)(zheng)許(xu)可、行(xing)(xing)政(zheng)(zheng)處罰、行(xing)(xing)政(zheng)(zheng)強制(zhi)(zhi)等事項(xiang),增(zeng)(zeng)加辦理(li)行(xing)(xing)政(zheng)(zheng)許(xu)可事項(xiang)的(de)條(tiao)件(jian),規(gui)定(ding)出(chu)(chu)具循環證明、重復(fu)證明、無(wu)謂證明的(de)內(nei)(nei)(nei)容;不(bu)(bu)(bu)(bu)(bu)(bu)得(de)剝(bo)奪、減(jian)損(sun)公(gong)民、法(fa)人和(he)其他(ta)組(zu)織的(de)合法(fa)權(quan)(quan)(quan)(quan)益或者(zhe)(zhe)增(zeng)(zeng)加其義務(wu),侵(qin)犯公(gong)民人身權(quan)(quan)(quan)(quan)、財產權(quan)(quan)(quan)(quan)、人格權(quan)(quan)(quan)(quan)、勞動權(quan)(quan)(quan)(quan)、休息權(quan)(quan)(quan)(quan)等基本權(quan)(quan)(quan)(quan)利;不(bu)(bu)(bu)(bu)(bu)(bu)得(de)超越職權(quan)(quan)(quan)(quan)規(gui)定(ding)應由市(shi)場(chang)(chang)調節、企業(ye)和(he)社會自律(lv)、公(gong)民自我管理(li)的(de)事項(xiang);不(bu)(bu)(bu)(bu)(bu)(bu)得(de)違法(fa)制(zhi)(zhi)定(ding)含(han)有(you)(you)排(pai)除和(he)限(xian)(xian)制(zhi)(zhi)公(gong)平競爭內(nei)(nei)(nei)容的(de)措施(shi),違法(fa)干預和(he)影響(xiang)市(shi)場(chang)(chang)主體正常生(sheng)產經營活動,違法(fa)設置不(bu)(bu)(bu)(bu)(bu)(bu)合理(li)的(de)市(shi)場(chang)(chang)準入和(he)退出(chu)(chu)條(tiao)件(jian)等。二是凡(fan)法(fa)律(lv)、法(fa)規(gui)、規(gui)章和(he)上級行(xing)(xing)政(zheng)(zheng)規(gui)范性文(wen)(wen)(wen)(wen)件(jian)已作(zuo)明確規(gui)定(ding)的(de),現行(xing)(xing)文(wen)(wen)(wen)(wen)件(jian)規(gui)定(ding)已有(you)(you)部(bu)署且(qie)仍然(ran)適用的(de),不(bu)(bu)(bu)(bu)(bu)(bu)再重復(fu)發(fa)(fa)文(wen)(wen)(wen)(wen);對內(nei)(nei)(nei)容相近、能歸并(bing)的(de)盡量(liang)(liang)歸并(bing),對可發(fa)(fa)可不(bu)(bu)(bu)(bu)(bu)(bu)發(fa)(fa)、沒有(you)(you)實質內(nei)(nei)(nei)容的(de)文(wen)(wen)(wen)(wen)件(jian)一律(lv)不(bu)(bu)(bu)(bu)(bu)(bu)發(fa)(fa),嚴(yan)禁照(zhao)抄(chao)照(zhao)搬照(zhao)轉上級文(wen)(wen)(wen)(wen)件(jian),以文(wen)(wen)(wen)(wen)件(jian)“落實”文(wen)(wen)(wen)(wen)件(jian)。同時,還對提高(gao)辦文(wen)(wen)(wen)(wen)質量(liang)(liang)提出(chu)(chu)要(yao)求,制(zhi)(zhi)定(ding)的(de)行(xing)(xing)政(zheng)(zheng)規(gui)范性文(wen)(wen)(wen)(wen)件(jian)要(yao)講求實效,文(wen)(wen)(wen)(wen)字(zi)表述要(yao)嚴(yan)謹、精煉、準確。
記者:《通知》在嚴格行政規范性文件制發程序方面都對哪些環節作出規定?
有關負責人:為防(fang)止文(wen)件(jian)制(zhi)發(fa)的隨意性,《通知》明確(que)了行(xing)政(zheng)規(gui)范(fan)(fan)性文(wen)件(jian)制(zhi)發(fa)必(bi)須(xu)遵(zun)循的步驟(zou)和工作環節,對加強行(xing)政(zheng)規(gui)范(fan)(fan)性文(wen)件(jian)制(zhi)發(fa)程(cheng)序管理、健全工作機制(zhi)、完善工作流程(cheng)、保(bao)證文(wen)件(jian)制(zhi)發(fa)工作規(gui)范(fan)(fan)有序作出明確(que)規(gui)定。要求重要行(xing)政(zheng)規(gui)范(fan)(fan)性文(wen)件(jian)要嚴(yan)格經過(guo)認真評估論證、廣泛征求意見(jian)、嚴(yan)格審核把關、堅持集體審議、及時公開(kai)發(fa)布(bu)等5 個環節。
認真評估(gu)(gu)論證(zheng),就是要(yao)(yao)(yao)求起(qi)草部門(men)在起(qi)草行(xing)政規(gui)范性文件時,要(yao)(yao)(yao)對有關(guan)行(xing)政措施(shi)的施(shi)行(xing)效果(guo)和可能產生的影響進行(xing)評估(gu)(gu),對制定該文件是否符合法律法規(gui)和國家政策(ce)、是否符合社會(hui)主義核心價值觀、是否符合公平競爭審查(cha)要(yao)(yao)(yao)求進行(xing)把關(guan)。論證(zheng)評估(gu)(gu)結論是起(qi)草文件的重要(yao)(yao)(yao)依據,經評估(gu)(gu)認為不需(xu)要(yao)(yao)(yao)制定的,不得啟動制定程(cheng)序。
廣泛征求(qiu)意(yi)見(jian),就(jiu)是要(yao)求(qiu)除依法(fa)應當保密的外,對(dui)涉及群眾(zhong)切身利(li)(li)益(yi)或者對(dui)公民、法(fa)人和(he)其他(ta)組織權利(li)(li)義(yi)務有重大影(ying)響的文件,起草部門要(yao)向社(she)會(hui)公開(kai)征求(qiu)意(yi)見(jian)。對(dui)涉及社(she)會(hui)公眾(zhong)重大利(li)(li)益(yi)事項調整(zheng)的,起草部門要(yao)深入調查研究,采取座談會(hui)、論證會(hui)、實地(di)走(zou)訪(fang)等形式充分聽取各方面意(yi)見(jian),特(te)別是要(yao)征求(qiu)利(li)(li)益(yi)相(xiang)關方的意(yi)見(jian),并(bing)要(yao)求(qiu)建(jian)立意(yi)見(jian)溝通(tong)協商反饋(kui)機制,對(dui)相(xiang)對(dui)集中的意(yi)見(jian)建(jian)議不予采納的,公布時(shi)要(yao)說明理由(you)。
嚴格審(shen)(shen)核(he)(he)把關(guan),就是(shi)要(yao)求(qiu)建立程序(xu)完備、權責一致、相(xiang)互(hu)銜接(jie)、運(yun)行(xing)高效的(de)(de)(de)(de)行(xing)政規范性(xing)文(wen)件合法(fa)(fa)(fa)(fa)性(xing)審(shen)(shen)核(he)(he)機(ji)(ji)(ji)制(zhi)(zhi)(zhi)。起(qi)草部門(men)(men)要(yao)及時將(jiang)送審(shen)(shen)稿及有關(guan)材料報送制(zhi)(zhi)(zhi)定機(ji)(ji)(ji)關(guan)的(de)(de)(de)(de)辦公機(ji)(ji)(ji)構或者(zhe)負(fu)責合法(fa)(fa)(fa)(fa)性(xing)審(shen)(shen)核(he)(he)的(de)(de)(de)(de)機(ji)(ji)(ji)構。制(zhi)(zhi)(zhi)定機(ji)(ji)(ji)關(guan)的(de)(de)(de)(de)辦公機(ji)(ji)(ji)構要(yao)對起(qi)草部門(men)(men)是(shi)否嚴格依照(zhao)規定的(de)(de)(de)(de)程序(xu)起(qi)草,是(shi)否廣泛聽(ting)取意見(jian),是(shi)否進行(xing)評估(gu)論證進行(xing)審(shen)(shen)核(he)(he)。制(zhi)(zhi)(zhi)定機(ji)(ji)(ji)關(guan)負(fu)責合法(fa)(fa)(fa)(fa)性(xing)審(shen)(shen)核(he)(he)的(de)(de)(de)(de)機(ji)(ji)(ji)構要(yao)對文(wen)件的(de)(de)(de)(de)制(zhi)(zhi)(zhi)定主(zhu)體(ti)、程序(xu)、有關(guan)內容等(deng)是(shi)否符合法(fa)(fa)(fa)(fa)律、法(fa)(fa)(fa)(fa)規、規章(zhang)的(de)(de)(de)(de)規定,及時進行(xing)合法(fa)(fa)(fa)(fa)性(xing)審(shen)(shen)核(he)(he)。未(wei)經(jing)合法(fa)(fa)(fa)(fa)性(xing)審(shen)(shen)核(he)(he)或者(zhe)經(jing)審(shen)(shen)核(he)(he)不合法(fa)(fa)(fa)(fa)的(de)(de)(de)(de),不得提交集體(ti)審(shen)(shen)議。
堅持集(ji)體(ti)審議,就是(shi)要(yao)(yao)求(qiu)制定(ding)(ding)行政規范性(xing)文件要(yao)(yao)實行集(ji)體(ti)研究(jiu)討論決定(ding)(ding)制度,防止違(wei)法決策(ce)(ce)、專斷(duan)決策(ce)(ce)、“拍腦袋(dai)”決策(ce)(ce)。地方政府(fu)(fu)制定(ding)(ding)的(de)行政規范性(xing)文件要(yao)(yao)經本(ben)級(ji)政府(fu)(fu)常務會議或全體(ti)會議審議決定(ding)(ding),政府(fu)(fu)部(bu)門(men)制定(ding)(ding)的(de)行政規范性(xing)文件要(yao)(yao)經本(ben)部(bu)門(men)辦公會議審議決定(ding)(ding)。集(ji)體(ti)審議要(yao)(yao)充(chong)分(fen)發揚民主,充(chong)分(fen)發表意見(jian)(jian),集(ji)體(ti)討論情況(kuang)和決定(ding)(ding)應當如實記錄,不同意見(jian)(jian)如實載明。
及(ji)時公開發布(bu),就是要求在行政(zheng)規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)通過或批準(zhun)之后,制定機(ji)關要對行政(zheng)規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)實行統一登(deng)記、統一編號、統一印發,并及(ji)時通過政(zheng)府公報、政(zheng)務(wu)網站、政(zheng)務(wu)新媒體(ti)、廣播(bo)、電視、報紙、公示欄等平(ping)臺公開向社會發布(bu),不得以內部(bu)文(wen)件(jian)(jian)形(xing)式下發執行,未經公布(bu)的行政(zheng)規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)不得作為行政(zheng)管(guan)(guan)理(li)依據(ju)。要逐步構(gou)建權威發布(bu)、信(xin)息共享(xiang)、動態(tai)更新的行政(zheng)規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)工作信(xin)息平(ping)臺,以大數據(ju)等技(ji)術(shu)手(shou)段實現對行政(zheng)規(gui)(gui)范(fan)性(xing)(xing)(xing)(xing)文(wen)件(jian)(jian)的標(biao)準(zhun)化、精細(xi)化、動態(tai)化管(guan)(guan)理(li)。
記者:《通知》在健全責任機制方面有什么措施?
有關負責人:為了確保《通(tong)(tong)知》規(gui)定(ding)(ding)的(de)(de)各項措施落到實(shi)處,就進一步健(jian)全(quan)行(xing)政(zheng)(zheng)規(gui)范性(xing)文件的(de)(de)監(jian)督(du)(du)管(guan)(guan)理(li)(li)和(he)責(ze)(ze)任(ren)追究作(zuo)出(chu)規(gui)定(ding)(ding)。一是健(jian)全(quan)責(ze)(ze)任(ren)追究機制。要(yao)(yao)(yao)(yao)求(qiu)地(di)方(fang)各級(ji)人(ren)民政(zheng)(zheng)府(fu)(fu)(fu)要(yao)(yao)(yao)(yao)對(dui)所屬部門(men)(men)、上(shang)級(ji)人(ren)民政(zheng)(zheng)府(fu)(fu)(fu)要(yao)(yao)(yao)(yao)對(dui)下級(ji)人(ren)民政(zheng)(zheng)府(fu)(fu)(fu)、各部門(men)(men)要(yao)(yao)(yao)(yao)對(dui)本部門(men)(men)制發(fa)的(de)(de)行(xing)政(zheng)(zheng)規(gui)范性(xing)文件加強監(jian)督(du)(du)檢查(cha)(cha),發(fa)現(xian)存在侵犯公民、法人(ren)和(he)其他組織合法權益,嚴重(zhong)(zhong)損(sun)害政(zheng)(zheng)府(fu)(fu)(fu)形(xing)象(xiang)和(he)公信(xin)力的(de)(de),要(yao)(yao)(yao)(yao)加大(da)查(cha)(cha)處力度,對(dui)負有責(ze)(ze)任(ren)的(de)(de)人(ren)員(yuan)依(yi)(yi)法依(yi)(yi)紀追究責(ze)(ze)任(ren)。對(dui)問題頻發(fa)、造成嚴重(zhong)(zhong)后果的(de)(de)地(di)方(fang)和(he)部門(men)(men),要(yao)(yao)(yao)(yao)通(tong)(tong)過約談或者(zhe)專門(men)(men)督(du)(du)導等方(fang)式督(du)(du)促整改,必要(yao)(yao)(yao)(yao)時向社會曝(pu)光(guang)。二(er)是加強督(du)(du)查(cha)(cha)考核(he)。要(yao)(yao)(yao)(yao)求(qiu)完善行(xing)政(zheng)(zheng)規(gui)范性(xing)文件制發(fa)管(guan)(guan)理(li)(li)制度,充分發(fa)揮政(zheng)(zheng)府(fu)(fu)(fu)督(du)(du)查(cha)(cha)機制作(zuo)用(yong),將行(xing)政(zheng)(zheng)規(gui)范性(xing)文件制定(ding)(ding)和(he)監(jian)督(du)(du)管(guan)(guan)理(li)(li)工作(zuo)納入(ru)法治(zhi)政(zheng)(zheng)府(fu)(fu)(fu)建設督(du)(du)察的(de)(de)內(nei)容,并作(zuo)為依(yi)(yi)法行(xing)政(zheng)(zheng)考核(he)內(nei)容列入(ru)法治(zhi)政(zheng)(zheng)府(fu)(fu)(fu)建設考評指(zhi)標(biao)體系。建立(li)督(du)(du)查(cha)(cha)情況通(tong)(tong)報(bao)制度,對(dui)工作(zuo)落實(shi)好的(de)(de),予以通(tong)(tong)報(bao)表揚;對(dui)工作(zuo)落實(shi)不力的(de)(de),予以通(tong)(tong)報(bao)批評。

有關負責人:主要(yao)(yao)規(gui)定了4 項制(zhi)(zhi)度機(ji)(ji)制(zhi)(zhi)。一是(shi)(shi)完善備(bei)(bei)案監(jian)(jian)督(du)(du)制(zhi)(zhi)度。對(dui)制(zhi)(zhi)定機(ji)(ji)關(guan)(guan)及時按照規(gui)定程(cheng)序和時限報送有(you)關(guan)(guan)機(ji)(ji)關(guan)(guan)備(bei)(bei)案,主動接(jie)受監(jian)(jian)督(du)(du)作出明確規(gui)定,要(yao)(yao)做到有(you)件(jian)(jian)(jian)必(bi)備(bei)(bei)、有(you)備(bei)(bei)必(bi)審(shen)、有(you)錯(cuo)必(bi)糾。二(er)是(shi)(shi)健全(quan)(quan)(quan)動態(tai)清理(li)(li)工(gong)作機(ji)(ji)制(zhi)(zhi)。要(yao)(yao)求制(zhi)(zhi)定機(ji)(ji)關(guan)(guan)要(yao)(yao)根據全(quan)(quan)(quan)面深化改革、全(quan)(quan)(quan)面依法(fa)(fa)治國要(yao)(yao)求和經(jing)濟社會發展需要(yao)(yao)以及上位(wei)法(fa)(fa)制(zhi)(zhi)定、修改、廢止情況,及時對(dui)本地區、本部門行(xing)(xing)政(zheng)規(gui)范性文件(jian)(jian)(jian)進(jin)行(xing)(xing)清理(li)(li)。三是(shi)(shi)建(jian)立(li)建(jian)議(yi)審(shen)查(cha)制(zhi)(zhi)度。暢通(tong)民(min)意訴求渠道,公民(min)、法(fa)(fa)人和其他組織認為行(xing)(xing)政(zheng)規(gui)范性文件(jian)(jian)(jian)與上位(wei)法(fa)(fa)相抵觸(chu)的,可以向(xiang)有(you)權機(ji)(ji)關(guan)(guan)提出審(shen)查(cha)建(jian)議(yi)。四是(shi)(shi)健全(quan)(quan)(quan)審(shen)查(cha)協作機(ji)(ji)制(zhi)(zhi)。要(yao)(yao)求政(zheng)府備(bei)(bei)案工(gong)作機(ji)(ji)構要(yao)(yao)加強與黨(dang)委、人大系統(tong)備(bei)(bei)案工(gong)作機(ji)(ji)構的協作配(pei)合,建(jian)立(li)備(bei)(bei)案審(shen)查(cha)銜接(jie)聯動機(ji)(ji)制(zhi)(zhi)。同時,探索(suo)與人民(min)法(fa)(fa)院、人民(min)檢察院建(jian)立(li)行(xing)(xing)政(zheng)規(gui)范性文件(jian)(jian)(jian)審(shen)查(cha)銜接(jie)工(gong)作機(ji)(ji)制(zhi)(zhi),推動司法(fa)(fa)監(jian)(jian)督(du)(du)與行(xing)(xing)政(zheng)監(jian)(jian)督(du)(du)形成合力,及時發現并糾正違法(fa)(fa)文件(jian)(jian)(jian)。

有關負責人:首先,強(qiang)調(diao)(diao)各地區(qu)、各部門要(yao)(yao)提高政(zheng)治(zhi)站位,要(yao)(yao)以習近(jin)平(ping)新時(shi)代中國特色社會(hui)(hui)主(zhu)義思(si)想(xiang)為指導,按照黨的(de)十九大提出的(de)“建(jian)設(she)人民滿意的(de)服務(wu)型(xing)政(zheng)府(fu)(fu)”和“建(jian)設(she)法(fa)(fa)治(zhi)政(zheng)府(fu)(fu)”的(de)要(yao)(yao)求,從協調(diao)(diao)推進(jin)“四個全面”的(de)戰略高度(du),充分認識(shi)加強(qiang)行(xing)政(zheng)規范(fan)性(xing)(xing)文件(jian)制定和監(jian)督管理(li)工作(zuo)對完善政(zheng)府(fu)(fu)治(zhi)理(li)體系、提高政(zheng)府(fu)(fu)公信(xin)力的(de)重(zhong)(zhong)要(yao)(yao)作(zuo)用,把加強(qiang)規范(fan)性(xing)(xing)文件(jian)制定和監(jian)督管理(li)作(zuo)為深(shen)入貫徹(che)落實黨中央、國務(wu)院決策部署和推進(jin)依法(fa)(fa)行(xing)政(zheng)、建(jian)設(she)法(fa)(fa)治(zhi)政(zheng)府(fu)(fu)的(de)重(zhong)(zhong)要(yao)(yao)內容,作(zuo)為糾正(zheng)“四風”、加強(qiang)作(zuo)風建(jian)設(she)的(de)重(zhong)(zhong)要(yao)(yao)方式,切(qie)實抓(zhua)緊(jin)抓(zhua)好,確(que)保(bao)出臺的(de)規范(fan)性(xing)(xing)文件(jian)符合法(fa)(fa)律法(fa)(fa)規和國家政(zheng)策,符合社會(hui)(hui)主(zhu)義核心價值觀。
其次,要(yao)求各地區、各部(bu)門抓緊(jin)開展自查自糾活動,對本地區、本部(bu)門發現的(de)(de)違反法律法規(gui)和國家政(zheng)(zheng)策(ce),侵犯人民(min)群眾(zhong)合法權益的(de)(de) “奇葩”文件(jian),要(yao)及時予以糾正。針(zhen)對當前(qian)機構改(gai)革(ge),強調(diao)要(yao)協(xie)調(diao)做(zuo)好政(zheng)(zheng)府機構改(gai)革(ge)過程中行(xing)(xing)政(zheng)(zheng)規(gui)范性文件(jian)清理(li)和實施(shi)的(de)(de)銜(xian)接(jie)工(gong)(gong)作,新組建或者職(zhi)責(ze)調(diao)整的(de)(de)部(bu)門要(yao)對本部(bu)門負責(ze)實施(shi)的(de)(de)行(xing)(xing)政(zheng)(zheng)規(gui)范性文件(jian)進行(xing)(xing)清理(li),需要(yao)修改(gai)的(de)(de),及時進行(xing)(xing)修改(gai);不需要(yao)修改(gai)的(de)(de),做(zuo)好繼(ji)續實施(shi)的(de)(de)銜(xian)接(jie)工(gong)(gong)作,確(que)保(bao)依法履職(zhi)。
