為貫徹實施《中(zhong)華人民(min)(min)共(gong)和國人民(min)(min)陪審(shen)員法(fa)》(以下(xia)簡(jian)(jian)稱《人民(min)(min)陪審(shen)員法(fa)》),規范人民(min)(min)陪審(shen)員選任工作,日前,司法(fa)部(bu)(bu)、最高人民(min)(min)法(fa)院、公安部(bu)(bu)印(yin)發《人民(min)(min)陪審(shen)員選任辦(ban)(ban)法(fa)》(以下(xia)簡(jian)(jian)稱《辦(ban)(ban)法(fa)》)。司法(fa)部(bu)(bu)有(you)關負責人就(jiu)《辦(ban)(ban)法(fa)》有(you)關問題回答了記者的提問。
問:請介紹一下制定《辦法》的相關背景。
答:黨(dang)的(de)(de)十九大報告指出,要(yao)健(jian)全人(ren)民(min)(min)當(dang)家(jia)作主的(de)(de)制度體(ti)(ti)系,保障(zhang)人(ren)民(min)(min)的(de)(de)知情權(quan)、參與(yu)權(quan)、表達權(quan)、監督(du)權(quan)。人(ren)民(min)(min)陪審員制度是(shi)中國(guo)特色(se)社會主義司法(fa)制度的(de)(de)重要(yao)組(zu)成部分,是(shi)人(ren)民(min)(min)群眾參與(yu)司法(fa)、監督(du)司法(fa)的(de)(de)有效(xiao)形式,是(shi)人(ren)民(min)(min)民(min)(min)主在司法(fa)領域的(de)(de)重要(yao)體(ti)(ti)現(xian)。
《人(ren)民(min)陪(pei)審員法(fa)》于(yu)4月27日經第十(shi)三屆全(quan)國人(ren)民(min)代(dai)表(biao)大會常務委員會第二次會議審議通(tong)過(guo),并自公布之日起施行。《人(ren)民(min)陪(pei)審員法(fa)》的(de)(de)頒布實施,是(shi)黨領(ling)導人(ren)民(min)治(zhi)理國家、深化全(quan)面依(yi)法(fa)治(zhi)國戰略的(de)(de)重要舉措,體現(xian)了以人(ren)民(min)為(wei)中(zhong)心的(de)(de)發展思想,對于(yu)保障(zhang)公民(min)參與國家事務管理的(de)(de)民(min)主權利(li)、提高人(ren)民(min)陪(pei)審員制度的(de)(de)公信力(li)和權威(wei)性(xing),具有重要意義。
《人民(min)(min)(min)(min)陪審員法(fa)(fa)》對人民(min)(min)(min)(min)陪審員選任(ren)(ren)機關、選任(ren)(ren)對象、選任(ren)(ren)方式做(zuo)了(le)明(ming)(ming)確(que)(que)規定,這既(ji)是(shi)對人民(min)(min)(min)(min)陪審員制(zhi)度的(de)完(wan)善,也為更好地(di)組織開展人民(min)(min)(min)(min)陪審員選任(ren)(ren)工作提供了(le)堅實(shi)的(de)法(fa)(fa)律保障。該法(fa)(fa)首次確(que)(que)立了(le)司法(fa)(fa)行(xing)政機關選任(ren)(ren)、人大常委(wei)會任(ren)(ren)命、法(fa)(fa)院使用的(de)工作機制(zhi),調整了(le)人民(min)(min)(min)(min)陪審員選任(ren)(ren)機關,明(ming)(ming)確(que)(que)了(le)人民(min)(min)(min)(min)陪審員選任(ren)(ren)工作由以前的(de)基(ji)層人民(min)(min)(min)(min)法(fa)(fa)院牽(qian)頭負責(ze)變為司法(fa)(fa)行(xing)政機關牽(qian)頭負責(ze)。這有利于(yu)實(shi)現人民(min)(min)(min)(min)陪審員選用分離,有利于(yu)加(jia)強監督(du)制(zhi)約,進(jin)一步(bu)豐富和(he)完(wan)善了(le)人民(min)(min)(min)(min)陪審員制(zhi)度運行(xing)機制(zhi),確(que)(que)保了(le)人民(min)(min)(min)(min)陪審員制(zhi)度的(de)公信力和(he)權威性,標(biao)志著我國人民(min)(min)(min)(min)陪審員制(zhi)度進(jin)入了(le)新的(de)發展階段(duan)。
為貫徹實施《人(ren)民(min)(min)(min)陪(pei)審(shen)員(yuan)法(fa)》,正確履行人(ren)民(min)(min)(min)陪(pei)審(shen)員(yuan)選(xuan)任職(zhi)責,司(si)法(fa)部(bu)會同(tong)最(zui)高人(ren)民(min)(min)(min)法(fa)院、公安部(bu)共同(tong)制定《人(ren)民(min)(min)(min)陪(pei)審(shen)員(yuan)選(xuan)任辦(ban)法(fa)》,對人(ren)民(min)(min)(min)陪(pei)審(shen)員(yuan)的選(xuan)任機關、選(xuan)任范圍、選(xuan)任方式等做出具體規定。
問:請介紹一下《辦法》的主要內容。
答:《辦法(fa)》全面貫徹《人民(min)陪審(shen)員法(fa)》對(dui)選任(ren)工(gong)(gong)作的要求(qiu),著眼于建設(she)一支代(dai)表廣泛、群眾基礎扎實的高素質(zhi)人民(min)陪審(shen)員隊伍,堅(jian)持問題導向,細化選任(ren)程序(xu),增強選任(ren)工(gong)(gong)作的可(ke)操作性(xing)。
《辦(ban)法(fa)(fa)》一共31條,主(zhu)要包(bao)括人(ren)(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)選(xuan)任(ren)原則、選(xuan)任(ren)機(ji)(ji)構(gou)、選(xuan)任(ren)條件、選(xuan)任(ren)程序等內(nei)容(rong)。《辦(ban)法(fa)(fa)》規(gui)定人(ren)(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)選(xuan)任(ren)工(gong)作應當堅持依法(fa)(fa)民主(zhu)、公(gong)開公(gong)正、協同高效的原則。《辦(ban)法(fa)(fa)》進一步明(ming)確了人(ren)(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)選(xuan)任(ren)工(gong)作由司(si)法(fa)(fa)行(xing)政機(ji)(ji)關(guan)(guan)(guan)會同基層人(ren)(ren)(ren)民法(fa)(fa)院、公(gong)安(an)機(ji)(ji)關(guan)(guan)(guan)組織開展。省、市兩(liang)級司(si)法(fa)(fa)行(xing)政機(ji)(ji)關(guan)(guan)(guan)負(fu)責(ze)人(ren)(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)選(xuan)任(ren)工(gong)作的指(zhi)導監(jian)(jian)督(du)(du),縣級司(si)法(fa)(fa)行(xing)政機(ji)(ji)關(guan)(guan)(guan)負(fu)責(ze)人(ren)(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)選(xuan)任(ren)工(gong)作的具體實施(shi)。司(si)法(fa)(fa)行(xing)政機(ji)(ji)關(guan)(guan)(guan)、基層人(ren)(ren)(ren)民法(fa)(fa)院、公(gong)安(an)機(ji)(ji)關(guan)(guan)(guan)應當加強溝通(tong)聯系,建立協調配合機(ji)(ji)制。人(ren)(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)選(xuan)任(ren)過程中,要自覺接受人(ren)(ren)(ren)大監(jian)(jian)督(du)(du)和社會監(jian)(jian)督(du)(du)。
問:請問《辦法》對人民陪審員的選任方式是如何規定的?
答:人(ren)(ren)民(min)(min)(min)陪(pei)審(shen)(shen)員(yuan)(yuan)的(de)(de)選任是人(ren)(ren)民(min)(min)(min)陪(pei)審(shen)(shen)員(yuan)(yuan)制(zhi)度(du)運行的(de)(de)基礎,是推進司法(fa)民(min)(min)(min)主這一核心價(jia)(jia)值的(de)(de)重要(yao)體現(xian),人(ren)(ren)民(min)(min)(min)陪(pei)審(shen)(shen)員(yuan)(yuan)的(de)(de)選任在很大程度(du)上影響(xiang)人(ren)(ren)民(min)(min)(min)陪(pei)審(shen)(shen)員(yuan)(yuan)制(zhi)度(du)的(de)(de)政治功能和(he)司法(fa)價(jia)(jia)值的(de)(de)實(shi)現(xian)。為落實(shi)《人(ren)(ren)民(min)(min)(min)陪(pei)審(shen)(shen)員(yuan)(yuan)法(fa)》關于人(ren)(ren)民(min)(min)(min)陪(pei)審(shen)(shen)員(yuan)(yuan)選任方(fang)式的(de)(de)規定,《辦法(fa)》明確了以(yi)隨機(ji)抽選為主、以(yi)個人(ren)(ren)申請和(he)組織推薦(jian)為輔(fu)的(de)(de)人(ren)(ren)民(min)(min)(min)陪(pei)審(shen)(shen)員(yuan)(yuan)選任方(fang)式。
一(yi)是隨(sui)機(ji)(ji)(ji)(ji)(ji)(ji)抽選(xuan)(xuan)(xuan)(xuan)為主的(de)(de)(de)(de)方式。隨(sui)機(ji)(ji)(ji)(ji)(ji)(ji)抽選(xuan)(xuan)(xuan)(xuan)是人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)陪(pei)(pei)(pei)審(shen)(shen)(shen)(shen)(shen)員(yuan)制度改革的(de)(de)(de)(de)一(yi)項重大(da)機(ji)(ji)(ji)(ji)(ji)(ji)制創新。通(tong)過隨(sui)機(ji)(ji)(ji)(ji)(ji)(ji)抽選(xuan)(xuan)(xuan)(xuan)方式,可以使(shi)更多的(de)(de)(de)(de)人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)群(qun)眾有機(ji)(ji)(ji)(ji)(ji)(ji)會(hui)參(can)(can)與(yu)司(si)法(fa)(fa)(fa)審(shen)(shen)(shen)(shen)(shen)判活動,實(shi)地感受法(fa)(fa)(fa)庭審(shen)(shen)(shen)(shen)(shen)判氛圍。同(tong)(tong)(tong)(tong)(tong)(tong)時(shi),隨(sui)機(ji)(ji)(ji)(ji)(ji)(ji)抽選(xuan)(xuan)(xuan)(xuan)可吸收社(she)會(hui)不同(tong)(tong)(tong)(tong)(tong)(tong)行(xing)業、不同(tong)(tong)(tong)(tong)(tong)(tong)職業、不同(tong)(tong)(tong)(tong)(tong)(tong)年齡(ling)、不同(tong)(tong)(tong)(tong)(tong)(tong)民(min)(min)(min)族人(ren)(ren)(ren)(ren)(ren)(ren)員(yuan)參(can)(can)與(yu),最(zui)大(da)程度地實(shi)現人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)陪(pei)(pei)(pei)審(shen)(shen)(shen)(shen)(shen)員(yuan)的(de)(de)(de)(de)廣泛性和代表性。《辦(ban)法(fa)(fa)(fa)》規(gui)范了隨(sui)機(ji)(ji)(ji)(ji)(ji)(ji)抽選(xuan)(xuan)(xuan)(xuan)的(de)(de)(de)(de)程序步驟(zou),以及(ji)隨(sui)機(ji)(ji)(ji)(ji)(ji)(ji)抽選(xuan)(xuan)(xuan)(xuan)候(hou)(hou)(hou)(hou)(hou)選(xuan)(xuan)(xuan)(xuan)人(ren)(ren)(ren)(ren)(ren)(ren)、建(jian)立候(hou)(hou)(hou)(hou)(hou)選(xuan)(xuan)(xuan)(xuan)人(ren)(ren)(ren)(ren)(ren)(ren)信息庫、候(hou)(hou)(hou)(hou)(hou)選(xuan)(xuan)(xuan)(xuan)人(ren)(ren)(ren)(ren)(ren)(ren)資格審(shen)(shen)(shen)(shen)(shen)查(cha)、征求意見、確(que)定人(ren)(ren)(ren)(ren)(ren)(ren)選(xuan)(xuan)(xuan)(xuan)等內(nei)容。第(di)(di)一(yi)次(ci)隨(sui)機(ji)(ji)(ji)(ji)(ji)(ji)抽選(xuan)(xuan)(xuan)(xuan),由司(si)法(fa)(fa)(fa)行(xing)政(zheng)機(ji)(ji)(ji)(ji)(ji)(ji)關(guan)(guan)會(hui)同(tong)(tong)(tong)(tong)(tong)(tong)基層人(ren)(ren)(ren)(ren)(ren)(ren)民(min)(min)(min)法(fa)(fa)(fa)院(yuan)、公安機(ji)(ji)(ji)(ji)(ji)(ji)關(guan)(guan),從轄區(qu)內(nei)年滿28 二是個(ge)人申請和組織推薦為輔的(de)(de)(de)方式。考慮(lv)到在實(shi)際(ji)審(shen)(shen)(shen)判(pan)中有(you)時需(xu)要具備特定(ding)專業知識和素養的(de)(de)(de)人民陪(pei)審(shen)(shen)(shen)員,《辦法》依據(ju)《人民陪(pei)審(shen)(shen)(shen)員法》的(de)(de)(de)規定(ding),明確根據(ju)審(shen)(shen)(shen)判(pan)工(gong)作的(de)(de)(de)需(xu)要,可以由組織推薦和個(ge)人申請方式產(chan)生(sheng)一(yi)(yi)定(ding)比例的(de)(de)(de)陪(pei)審(shen)(shen)(shen)員,這是對“隨機(ji)抽選(xuan)”選(xuan)任(ren)方式的(de)(de)(de)有(you)益補充。通過(guo)這種方式產(chan)生(sheng)的(de)(de)(de)陪(pei)審(shen)(shen)(shen)員不得超過(guo)陪(pei)審(shen)(shen)(shen)員名額數的(de)(de)(de)五分之一(yi)(yi),既滿足(zu)審(shen)(shen)(shen)判(pan)工(gong)作實(shi)際(ji)需(xu)要,又保證人民陪(pei)審(shen)(shen)(shen)員的(de)(de)(de)廣(guang)泛性。
問:根據《辦法》,如何開展人民陪審員候選人的資格審查?
答:《辦(ban)法(fa)》要求司(si)法(fa)行政機關(guan)充分發揮司(si)法(fa)所職能作(zuo)用(yong),會同人民法(fa)院、公安(an)機關(guan)共(gong)同做(zuo)好候選人資格審查工(gong)作(zuo)。
一是準確(que)把握人(ren)(ren)民(min)(min)陪(pei)(pei)審員(yuan)(yuan)選任(ren)的禁止性條(tiao)(tiao)件。人(ren)(ren)民(min)(min)陪(pei)(pei)審員(yuan)(yuan)選任(ren)要嚴格按照《人(ren)(ren)民(min)(min)陪(pei)(pei)審員(yuan)(yuan)法》第六(liu)條(tiao)(tiao)、第七(qi)條(tiao)(tiao)的規定(ding),排除一些國家機(ji)關工作人(ren)(ren)員(yuan)(yuan)不(bu)適宜擔任(ren)人(ren)(ren)民(min)(min)陪(pei)(pei)審員(yuan)(yuan)的情(qing)形(xing);以及受(shou)過刑事處罰(fa),被(bei)(bei)開除公(gong)職,被(bei)(bei)吊銷律(lv)師(shi)、公(gong)證(zheng)員(yuan)(yuan)執業證(zheng)書,被(bei)(bei)納入失信(xin)被(bei)(bei)執行人(ren)(ren)名單,因(yin)受(shou)懲戒被(bei)(bei)免除人(ren)(ren)民(min)(min)陪(pei)(pei)審員(yuan)(yuan)職務(wu)等不(bu)得(de)擔任(ren)人(ren)(ren)民(min)(min)陪(pei)(pei)審員(yuan)(yuan)的情(qing)形(xing)。
二是人民(min)法(fa)院、公安、司(si)法(fa)行(xing)政部(bu)門(men)按照(zhao)各自職(zhi)權進行(xing)審(shen)查。按照(zhao)《人民(min)陪審(shen)員法(fa)》第(di)十條規(gui)定,公安機關(guan)主(zhu)要是提供掌握(wo)的犯罪記錄,如候選(xuan)人是否(fou)因犯罪受過刑事處罰、是否(fou)正在被(bei)刑事起訴或已被(bei)刑事拘留、逮(dai)捕等(deng);基層人民(min)法(fa)院主(zhu)要提供候選(xuan)人是否(fou)被(bei)納(na)入失信被(bei)執行(xing)人名單等(deng)審(shen)查結果(guo)。
三是(shi)司法(fa)(fa)行政(zheng)機關對(dui)人(ren)民陪(pei)審員進(jin)行全面(mian)(mian)資格(ge)審查(cha)。司法(fa)(fa)行政(zheng)機關按照《人(ren)民陪(pei)審員法(fa)(fa)》第五條(tiao)、第六條(tiao)、第七條(tiao)規定,在公安機關、人(ren)民法(fa)(fa)院定向審查(cha)的(de)(de)基(ji)礎上,聯合法(fa)(fa)庭、派出所,通(tong)過多(duo)種(zhong)渠道,查(cha)詢了解(jie)人(ren)民陪(pei)審員候選(xuan)(xuan)人(ren)在遵紀守法(fa)(fa)、誠實守信等方(fang)面(mian)(mian)的(de)(de)情(qing)況,確保(bao)不(bu)符合條(tiao)件的(de)(de)人(ren)員不(bu)被納(na)入選(xuan)(xuan)任范圍。必要時,可以采(cai)取到候選(xuan)(xuan)人(ren)所在單(dan)位(wei)、社區實地走訪了解(jie)、聽取群(qun)眾代表(biao)和(he)基(ji)層組織意見(jian)、組織進(jin)行面(mian)(mian)談等多(duo)種(zhong)形式對(dui)候選(xuan)(xuan)人(ren)進(jin)行審查(cha),全面(mian)(mian)掌握候選(xuan)(xuan)人(ren)的(de)(de)政(zheng)治素質、工作(zuo)能(neng)力和(he)群(qun)眾評價(jia),確保(bao)選(xuan)(xuan)任質量。
問:《辦法》還明確了哪些程序規定?
答:除上述(shu)程序之外,《辦法》還對(dui)人民陪(pei)審(shen)員名(ming)額確定、公告、公示、任命、增補和宣誓等程序作出(chu)了(le)規定。
一是名額(e)確(que)定(ding)。基層人(ren)(ren)(ren)民(min)(min)法(fa)(fa)院根據審(shen)判(pan)案件的(de)需要(yao)以及本轄區(qu)人(ren)(ren)(ren)口數(shu)量、地(di)域面積、民(min)(min)族狀(zhuang)況等(deng)因素,并(bing)結合上(shang)(shang)級(ji)(ji)人(ren)(ren)(ren)民(min)(min)法(fa)(fa)院隨機抽取人(ren)(ren)(ren)民(min)(min)陪審(shen)員(yuan)的(de)需要(yao),提(ti)出不低(di)于本院法(fa)(fa)官數(shu)三(san)倍(bei)的(de)人(ren)(ren)(ren)民(min)(min)陪審(shen)員(yuan)名額(e)數(shu)的(de)意(yi)見(jian),報上(shang)(shang)一級(ji)(ji)人(ren)(ren)(ren)民(min)(min)法(fa)(fa)院審(shen)核后,提(ti)請同級(ji)(ji)人(ren)(ren)(ren)民(min)(min)代表(biao)大會(hui)常務委員(yuan)會(hui)確(que)定(ding)。人(ren)(ren)(ren)民(min)(min)陪審(shen)員(yuan)名額(e)數(shu)可以根據實際(ji)情況進行調整,基層人(ren)(ren)(ren)民(min)(min)法(fa)(fa)院應(ying)當將(jiang)名額(e)數(shu)及時通報同級(ji)(ji)司法(fa)(fa)行政機關(guan)。
二是公(gong)(gong)(gong)(gong)(gong)告(gao)(gao)、公(gong)(gong)(gong)(gong)(gong)示(shi)和任(ren)(ren)命。為(wei)使(shi)人(ren)(ren)(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)員選(xuan)任(ren)(ren)程序、結果接受(shou)社會(hui)的廣泛監(jian)督,并(bing)加強(qiang)對人(ren)(ren)(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)制度的宣傳,《辦(ban)法(fa)(fa)(fa)》規定(ding)了(le)選(xuan)任(ren)(ren)公(gong)(gong)(gong)(gong)(gong)告(gao)(gao)、擬任(ren)(ren)公(gong)(gong)(gong)(gong)(gong)示(shi)、人(ren)(ren)(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)員名(ming)單公(gong)(gong)(gong)(gong)(gong)告(gao)(gao)程序。司(si)法(fa)(fa)(fa)行政(zheng)機關會(hui)同(tong)(tong)基層人(ren)(ren)(ren)民(min)(min)法(fa)(fa)(fa)院、公(gong)(gong)(gong)(gong)(gong)安(an)機關,向社會(hui)公(gong)(gong)(gong)(gong)(gong)告(gao)(gao)選(xuan)任(ren)(ren)名(ming)額、選(xuan)任(ren)(ren)條件(jian)、選(xuan)任(ren)(ren)程序等有(you)關事項,吸(xi)引公(gong)(gong)(gong)(gong)(gong)民(min)(min)參與,公(gong)(gong)(gong)(gong)(gong)告(gao)(gao)期為(wei)三十(shi)日。人(ren)(ren)(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)員經公(gong)(gong)(gong)(gong)(gong)示(shi)并(bing)提請人(ren)(ren)(ren)大任(ren)(ren)命后,基層人(ren)(ren)(ren)民(min)(min)法(fa)(fa)(fa)院應當會(hui)同(tong)(tong)司(si)法(fa)(fa)(fa)行政(zheng)機關向社會(hui)公(gong)(gong)(gong)(gong)(gong)告(gao)(gao)。為(wei)充(chong)分(fen)體現人(ren)(ren)(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)員代(dai)表性(xing)(xing)、廣泛性(xing)(xing),《辦(ban)法(fa)(fa)(fa)》還對人(ren)(ren)(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)員任(ren)(ren)期作了(le)細(xi)化規定(ding),明確公(gong)(gong)(gong)(gong)(gong)民(min)(min)被選(xuan)為(wei)人(ren)(ren)(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)員不得(de)超(chao)過兩次,也就(jiu)是任(ren)(ren)職時(shi)間累計不超(chao)過十(shi)年。同(tong)(tong)時(shi)規定(ding)公(gong)(gong)(gong)(gong)(gong)民(min)(min)不得(de)同(tong)(tong)時(shi)在兩個以(yi)上的基層人(ren)(ren)(ren)民(min)(min)法(fa)(fa)(fa)院擔(dan)任(ren)(ren)人(ren)(ren)(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)員,確保更(geng)多的公(gong)(gong)(gong)(gong)(gong)民(min)(min)可以(yi)參與到司(si)法(fa)(fa)(fa)審(shen)(shen)判中來。
三(san)是(shi)增(zeng)(zeng)補(bu)(bu)和(he)宣(xuan)誓。為(wei)進一(yi)步明確(que)啟動增(zeng)(zeng)補(bu)(bu)程(cheng)序的時(shi)機,《辦法》規(gui)定人(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)缺額數超過基層人(ren)(ren)民法院人(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)名(ming)額數十分之一(yi)的,或者因(yin)審(shen)(shen)判(pan)工(gong)作需(xu)要,可以適時(shi)增(zeng)(zeng)補(bu)(bu)人(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)。為(wei)簡(jian)化增(zeng)(zeng)補(bu)(bu)程(cheng)序、提升增(zeng)(zeng)補(bu)(bu)效率,《辦法》規(gui)定增(zeng)(zeng)補(bu)(bu)人(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)擬任(ren)命人(ren)(ren)選(xuan)從通過資格審(shen)(shen)查(cha)的人(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)候選(xuan)人(ren)(ren)名(ming)單中(zhong)隨機抽選(xuan)確(que)定。為(wei)增(zeng)(zeng)強人(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)的社(she)會責(ze)任(ren)感和(he)職(zhi)業榮譽(yu)感,《辦法》規(gui)定人(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)經人(ren)(ren)民代表(biao)大會常務委員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)會任(ren)命后,應(ying)當公開進行就職(zhi)宣(xuan)誓,并參(can)考《人(ren)(ren)民陪(pei)審(shen)(shen)員(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)宣(xuan)誓規(gui)定(試行)》對誓詞(ci)內容(rong)予以明確(que)。
問:司法行政機關如何加強人民陪審員選任工作保障?
答:做好人民(min)陪審(shen)員選任工作,責任大,任務重,社會關(guan)注度高,司法行政(zheng)機關(guan)主要在五(wu)個(ge)方面(mian)強化工作保障。
一(yi)是加強(qiang)組織領導(dao)(dao)。各級司法行(xing)(xing)(xing)政(zheng)機(ji)關(guan)(guan)要增強(qiang)政(zheng)治意識、大局意識,把貫徹實(shi)(shi)施(shi)《人(ren)民(min)陪審員法》工(gong)作(zuo)(zuo)擺上重(zhong)要議事日(ri)程。省(區(qu)、市)和(he)市(地)級司法行(xing)(xing)(xing)政(zheng)機(ji)關(guan)(guan)要切實(shi)(shi)加強(qiang)領導(dao)(dao),堅(jian)持問(wen)題(ti)導(dao)(dao)向,針(zhen)對(dui)實(shi)(shi)際工(gong)作(zuo)(zuo)中的(de)困難和(he)問(wen)題(ti),研究政(zheng)策措施(shi),加強(qiang)工(gong)作(zuo)(zuo)保障和(he)指(zhi)導(dao)(dao)監督。縣級司法行(xing)(xing)(xing)政(zheng)機(ji)關(guan)(guan)要會同(tong)人(ren)民(min)法院、公安機(ji)關(guan)(guan)進一(yi)步細(xi)化措施(shi),抓好人(ren)民(min)陪審員選任(ren)的(de)具(ju)體(ti)組織實(shi)(shi)施(shi)。鄉鎮(街(jie)道(dao))司法所要加強(qiang)與基層(ceng)派出(chu)所、法庭的(de)配合,密切聯系(xi)村居(社區(qu)),做好對(dui)廣大群眾的(de)動員宣(xuan)傳、信息采集核查等工(gong)作(zuo)(zuo)。
二是強(qiang)化協(xie)作(zuo)配合(he)。司法(fa)行(xing)政(zheng)機關(guan)要(yao)主動(dong)加強(qiang)與人(ren)民法(fa)院、公安(an)機關(guan)等(deng)部(bu)門的(de)溝(gou)通(tong)協(xie)調,共(gong)同(tong)(tong)制定人(ren)民陪審員選任工作(zuo)具體實施方案,明確責任分工,強(qiang)化部(bu)門銜(xian)接(jie),形(xing)成共(gong)同(tong)(tong)做好人(ren)民陪審員選任工作(zuo)的(de)合(he)力。要(yao)總結開展人(ren)民陪審員工作(zuo)的(de)經(jing)驗做法(fa),健全(quan)完善聯(lian)席(xi)會(hui)議、信息通(tong)報(bao)反(fan)饋、聯(lian)合(he)走訪調查、信息共(gong)享等(deng)制度,形(xing)成協(xie)同(tong)(tong)高效、良(liang)性互動(dong)的(de)工作(zuo)機制。
三是推動(dong)信(xin)息共(gong)(gong)享(xiang)。司法行(xing)政機(ji)關(guan)要加快研發(fa)人(ren)民(min)陪審員(yuan)選(xuan)(xuan)任(ren)(ren)信(xin)息管理系(xi)統,通過信(xin)息系(xi)統實(shi)(shi)現兩次隨機(ji)抽(chou)選(xuan)(xuan),會同公(gong)安(an)機(ji)關(guan)、人(ren)民(min)法院(yuan)開展人(ren)民(min)陪審員(yuan)候選(xuan)(xuan)人(ren)信(xin)息采集工作,建(jian)立人(ren)民(min)陪審員(yuan)候選(xuan)(xuan)人(ren)信(xin)息庫,切(qie)實(shi)(shi)提升選(xuan)(xuan)任(ren)(ren)工作質量(liang)和(he)效率。要加強信(xin)息數據共(gong)(gong)享(xiang),實(shi)(shi)現司法行(xing)政機(ji)關(guan)與(yu)公(gong)安(an)機(ji)關(guan)、人(ren)民(min)法院(yuan)以及相(xiang)關(guan)部門之間(jian)的系(xi)統對接和(he)信(xin)息共(gong)(gong)享(xiang),完善人(ren)民(min)陪審員(yuan)人(ren)選(xuan)(xuan)信(xin)息,為人(ren)民(min)陪審員(yuan)選(xuan)(xuan)用銜接打下(xia)堅實(shi)(shi)基礎。
四是(shi)落實保(bao)(bao)(bao)障政策。要主動爭取黨委政府重(zhong)視,健(jian)(jian)全(quan)完善工(gong)(gong)(gong)作(zuo)(zuo)保(bao)(bao)(bao)障機(ji)制(zhi)。爭取有關部門的(de)(de)支持,建立健(jian)(jian)全(quan)人(ren)(ren)民(min)陪(pei)(pei)審(shen)員選任(ren)管理工(gong)(gong)(gong)作(zuo)(zuo)機(ji)構(gou),配齊配強工(gong)(gong)(gong)作(zuo)(zuo)人(ren)(ren)員,落實辦公場所,確保(bao)(bao)(bao)這項新的(de)(de)工(gong)(gong)(gong)作(zuo)(zuo)有人(ren)(ren)抓、有人(ren)(ren)管。司法(fa)部正會(hui)同(tong)(tong)最高人(ren)(ren)民(min)法(fa)院(yuan)、財政部制(zhi)定人(ren)(ren)民(min)陪(pei)(pei)審(shen)員工(gong)(gong)(gong)作(zuo)(zuo)經費保(bao)(bao)(bao)障意見(jian),將司法(fa)行政機(ji)關開(kai)展人(ren)(ren)民(min)陪(pei)(pei)審(shen)員選任(ren)工(gong)(gong)(gong)作(zuo)(zuo)以及配合人(ren)(ren)民(min)法(fa)院(yuan)開(kai)展管理工(gong)(gong)(gong)作(zuo)(zuo)所必(bi)需(xu)的(de)(de)工(gong)(gong)(gong)作(zuo)(zuo)經費,納入同(tong)(tong)級(ji)財政預算予以足額保(bao)(bao)(bao)障。
五是加大普法宣(xuan)(xuan)傳(chuan)。要把學習宣(xuan)(xuan)傳(chuan)貫徹人(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)(shen)員(yuan)法納入“七五”普法重(zhong)要內容,通過多種形式,廣泛宣(xuan)(xuan)傳(chuan)人(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)(shen)員(yuan)法的重(zhong)要意(yi)(yi)義(yi)和主(zhu)要內容,宣(xuan)(xuan)傳(chuan)人(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)(shen)員(yuan)制(zhi)度的特色和優勢,增進(jin)社會各界和廣大人(ren)民(min)(min)群眾(zhong)對(dui)人(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)(shen)員(yuan)制(zhi)度的了解(jie)和認同,提(ti)高參與人(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)(shen)工作(zuo)(zuo)的積極(ji)性和主(zhu)動性。要主(zhu)動做好(hao)與人(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)(shen)員(yuan)的溝通協調工作(zuo)(zuo),定期(qi)向他(ta)們(men)反映社情民(min)(min)意(yi)(yi),提(ti)高他(ta)們(men)做好(hao)人(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)(shen)員(yuan)的責任感(gan),增強人(ren)民(min)(min)陪(pei)(pei)審(shen)(shen)(shen)工作(zuo)(zuo)質(zhi)效(xiao)。
