問:勞動爭議處理工(gong)作堅持“預(yu)防為主、基層為主、調解為主”方針,《通知》在加強拖欠農民(min)工(gong)工(gong)資爭議預(yu)防調解方面采取了哪些措施(shi)?
答:加(jia)強(qiang)(qiang)源(yuan)頭預防,通過爭(zheng)議(yi)(yi)(yi)(yi)雙(shuang)方(fang)(fang)當事(shi)人自主協商或者第三(san)方(fang)(fang)居(ju)中調(diao)(diao)解(jie)(jie)化解(jie)(jie)勞動(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)(yi),將我國(guo)“和為貴”的(de)傳統文化理念與(yu)說服(fu)疏導(dao)“息訴止訟”的(de)柔性化調(diao)(diao)解(jie)(jie)手段結(jie)合起(qi)來,能夠達到“案(an)結(jie)事(shi)了人和”的(de)目(mu)的(de)。《通知(zhi)》主要(yao)(yao)采取以下(xia)工(gong)(gong)(gong)(gong)(gong)作措施:一是(shi)(shi)加(jia)大(da)農(nong)民(min)(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)支付法律法規宣傳力(li)(li)度,推(tui)行勞動(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)(yi)仲(zhong)(zhong)裁(cai)(cai)(cai)建(jian)議(yi)(yi)(yi)(yi)書、司法建(jian)議(yi)(yi)(yi)(yi)書制(zhi)度,多種方(fang)(fang)式引(yin)導(dao)用(yong)人單位依(yi)法履(lv)行按時(shi)(shi)(shi)足(zu)額支付農(nong)民(min)(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)義(yi)務,進一步發揮工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)組(zu)(zu)織(zhi)在(zai)協商解(jie)(jie)決爭(zheng)議(yi)(yi)(yi)(yi)中的(de)作用(yong),提高協商和解(jie)(jie)成功率(lv)。二是(shi)(shi)發揮基層(ceng)調(diao)(diao)解(jie)(jie)組(zu)(zu)織(zhi)作用(yong),根據拖欠(qian)農(nong)民(min)(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)爭(zheng)議(yi)(yi)(yi)(yi)特點引(yin)導(dao)當事(shi)人靈活(huo)選擇調(diao)(diao)解(jie)(jie)方(fang)(fang)案(an),特別(bie)是(shi)(shi)加(jia)強(qiang)(qiang)調(diao)(diao)解(jie)(jie)與(yu)仲(zhong)(zhong)裁(cai)(cai)(cai)銜接,要(yao)(yao)求勞動(dong)(dong)(dong)人事(shi)爭(zheng)議(yi)(yi)(yi)(yi)仲(zhong)(zhong)裁(cai)(cai)(cai)委員(yuan)會(hui)(hui)(以下(xia)簡(jian)稱(cheng)仲(zhong)(zhong)裁(cai)(cai)(cai)委員(yuan)會(hui)(hui))對符(fu)合條件的(de)仲(zhong)(zhong)裁(cai)(cai)(cai)審(shen)查(cha)申請(qing)要(yao)(yao)當場受理,并(bing)將處理時(shi)(shi)(shi)限從(cong)《勞動(dong)(dong)(dong)人事(shi)爭(zheng)議(yi)(yi)(yi)(yi)仲(zhong)(zhong)裁(cai)(cai)(cai)辦案(an)規則》(以下(xia)簡(jian)稱(cheng)《辦案(an)規則》)規定的(de)五(wu)個工(gong)(gong)(gong)(gong)(gong)作日(ri)縮短為三(san)個工(gong)(gong)(gong)(gong)(gong)作日(ri),切實提高審(shen)查(cha)效率(lv),增強(qiang)(qiang)調(diao)(diao)解(jie)(jie)協議(yi)(yi)(yi)(yi)執行力(li)(li)。三(san)是(shi)(shi)加(jia)強(qiang)(qiang)拖欠(qian)農(nong)民(min)(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)重大(da)集(ji)體勞動(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)(yi)調(diao)(diao)處。要(yao)(yao)求各地人力(li)(li)資(zi)源(yuan)社會(hui)(hui)保障(zhang)部門制(zhi)訂應急工(gong)(gong)(gong)(gong)(gong)作預案(an),會(hui)(hui)同工(gong)(gong)(gong)(gong)(gong)會(hui)(hui)、企(qi)業(ye)代(dai)表組(zu)(zu)織(zhi)及時(shi)(shi)(shi)介入,通過主動(dong)(dong)(dong)約(yue)談用(yong)人單位、引(yin)入社會(hui)(hui)力(li)(li)量等措施強(qiang)(qiang)化調(diao)(diao)解(jie)(jie)效果。
問(wen):《通知》對集中限時辦結超審(shen)限拖欠(qian)農民工工資(zi)爭議(yi)仲裁案(an)件進行了(le)部署,是(shi)出(chu)于(yu)什(shen)么考慮?
答:近(jin)年來,受宏觀經濟環境變化、新技術新業態(tai)(tai)新模式發展等因素影響,勞動人事(shi)爭(zheng)議(yi)(yi)案(an)(an)(an)件(jian)總(zong)量大(da)與處(chu)理難度(du)(du)大(da)態(tai)(tai)勢并存(cun)。2019年上(shang)半年,全(quan)國(guo)各級勞動人事(shi)爭(zheng)議(yi)(yi)調解(jie)仲裁(cai)(cai)機(ji)構共處(chu)理爭(zheng)議(yi)(yi)案(an)(an)(an)件(jian)99.1萬件(jian),同(tong)比上(shang)升19.2%,案(an)(an)(an)件(jian)總(zong)量再(zai)創歷史新高。同(tong)時,勞動關系復(fu)雜化、爭(zheng)議(yi)(yi)主(zhu)體多元(yuan)化、訴求多樣化帶來爭(zheng)議(yi)(yi)處(chu)理難度(du)(du)不斷增大(da),部分地區(qu)仲裁(cai)(cai)機(ji)構“案(an)(an)(an)多人少”矛盾(dun)更(geng)加凸顯。雖(sui)然(ran)各地仲裁(cai)(cai)機(ji)構通(tong)(tong)過多種方式完(wan)善制度(du)(du)、優(you)化程序、深(shen)挖(wa)辦案(an)(an)(an)潛力,但案(an)(an)(an)件(jian)超(chao)審限現象(xiang)在一些地區(qu)仍然(ran)存(cun)在,影響到農(nong)民工(gong)(gong)當事(shi)人的(de)獲得感。對此,《通(tong)(tong)知》進行了專門部署,要求各地仲裁(cai)(cai)機(ji)構組織精干力量采取優(you)先調解(jie)、優(you)先開庭、優(you)先裁(cai)(cai)決等措施,通(tong)(tong)過倒排時間表(biao)、記賬銷號等方式,將(jiang)2019年7月31日以前超(chao)審限未辦結的(de)拖欠(qian)農(nong)民工(gong)(gong)工(gong)(gong)資爭(zheng)議(yi)(yi)案(an)(an)(an)件(jian)限期全(quan)部辦結,基本杜(du)絕(jue)拖欠(qian)農(nong)民工(gong)(gong)工(gong)(gong)資爭(zheng)議(yi)(yi)案(an)(an)(an)件(jian)超(chao)審限現象(xiang)。
問:《通知》在提(ti)高拖(tuo)欠農民工(gong)工(gong)資爭議仲裁質效方(fang)面采取了哪些(xie)超常規措施?
答:2016年,我部(bu)辦(ban)公廳印發(fa)了(le)《關(guan)于進(jin)一(yi)步做好農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)爭(zheng)議(yi)(yi)調解仲裁(cai)(cai)工(gong)(gong)作的(de)(de)通(tong)(tong)知(zhi)》,指(zhi)導(dao)各地(di)建立(li)健全(quan)工(gong)(gong)作機(ji)(ji)制(zhi),依(yi)(yi)法及時處(chu)(chu)理(li)(li)(li)了(le)大量拖欠農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)爭(zheng)議(yi)(yi)案(an)件。但對(dui)標對(dui)表黨中央關(guan)于根(gen)治(zhi)拖欠農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)的(de)(de)要(yao)(yao)(yao)求,還存(cun)在部(bu)門協調力度(du)(du)(du)不夠、工(gong)(gong)作措施常規化等問題(ti)。對(dui)此,《通(tong)(tong)知(zhi)》主要(yao)(yao)(yao)采取以下超(chao)常規措施:一(yi)是(shi)暢通(tong)(tong)仲裁(cai)(cai)“綠(lv)色通(tong)(tong)道”。要(yao)(yao)(yao)求仲裁(cai)(cai)機(ji)(ji)構進(jin)一(yi)步知(zhi)重負重、擔(dan)當作為,對(dui)符合條件的(de)(de)爭(zheng)議(yi)(yi)當天立(li)案(an),并在三個(ge)工(gong)(gong)作日內一(yi)次(ci)性(xing)通(tong)(tong)知(zhi)有關(guan)事(shi)項,落實(shi)《辦(ban)案(an)規則(ze)》簡(jian)易處(chu)(chu)理(li)(li)(li)規定,將(jiang)簡(jian)單小額案(an)件審限縮短至三十日內,進(jin)一(yi)步提高拖欠農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)爭(zheng)議(yi)(yi)案(an)件處(chu)(chu)理(li)(li)(li)效率(lv)。二是(shi)增強(qiang)案(an)件處(chu)(chu)理(li)(li)(li)效果。要(yao)(yao)(yao)求仲裁(cai)(cai)委員會(hui)可根(gen)據(ju)(ju)農(nong)民(min)工(gong)(gong)申請依(yi)(yi)法主動(dong)收集證據(ju)(ju),適用(yong)先行調解、終局裁(cai)(cai)決等規定,對(dui)重大案(an)件實(shi)行仲裁(cai)(cai)機(ji)(ji)構負責(ze)人(ren)(ren)掛牌(pai)督辦(ban)制(zhi)度(du)(du)(du)等,依(yi)(yi)法提高爭(zheng)議(yi)(yi)案(an)件仲裁(cai)(cai)終結(jie)率(lv)。三是(shi)加強(qiang)仲裁(cai)(cai)與訴訟(song)銜(xian)接。要(yao)(yao)(yao)求人(ren)(ren)力資(zi)(zi)(zi)源社會(hui)保障部(bu)門會(hui)同人(ren)(ren)民(min)法院(yuan)共同研究拖欠農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)爭(zheng)議(yi)(yi)處(chu)(chu)理(li)(li)(li)重點問題(ti),統一(yi)裁(cai)(cai)審法律適用(yong)標準,落實(shi)保全(quan)、執行等聯(lian)動(dong)機(ji)(ji)制(zhi),特別(bie)提出了(le)建立(li)裁(cai)(cai)審證據(ju)(ju)銜(xian)接制(zhi)度(du)(du)(du),這是(shi)繼2017年人(ren)(ren)社部(bu)與最高人(ren)(ren)民(min)法院(yuan)共同印發(fa)《關(guan)于加強(qiang)勞動(dong)人(ren)(ren)事(shi)爭(zheng)議(yi)(yi)仲裁(cai)(cai)與訴訟(song)銜(xian)接機(ji)(ji)制(zhi)建設的(de)(de)意見》、2018年全(quan)國各省級(ji)及多數地(di)市級(ji)人(ren)(ren)力資(zi)(zi)(zi)源社會(hui)保障部(bu)門與人(ren)(ren)民(min)法院(yuan)建立(li)裁(cai)(cai)審銜(xian)接機(ji)(ji)制(zhi)后的(de)(de)又一(yi)項重要(yao)(yao)(yao)成果,切(qie)實(shi)發(fa)揮(hui)仲裁(cai)(cai)準司法制(zhi)度(du)(du)(du)的(de)(de)“前置、終結(jie)、三方、效率(lv)”的(de)(de)作用(yong),充分發(fa)揮(hui)勞動(dong)人(ren)(ren)事(shi)爭(zheng)議(yi)(yi)處(chu)(chu)理(li)(li)(li)“攔水壩”的(de)(de)制(zhi)度(du)(du)(du)效能。

答:司法(fa)(fa)是維(wei)護社會公平正義的(de)(de)(de)最后一道(dao)防線(xian),運用(yong)(yong)法(fa)(fa)治思維(wei)和(he)法(fa)(fa)治方(fang)式處理(li)拖欠(qian)農(nong)(nong)(nong)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)勞(lao)動(dong)爭議(yi),必須(xu)切實(shi)(shi)發揮司法(fa)(fa)的(de)(de)(de)引領、推動(dong)和(he)保(bao)(bao)(bao)障作用(yong)(yong)。對(dui)此(ci),《通(tong)知(zhi)》作出以下規(gui)定:一是完(wan)善案(an)(an)件(jian)審理(li)機(ji)制。暢(chang)通(tong)立案(an)(an)“綠色通(tong)道(dao)”,按照普通(tong)民(min)(min)(min)(min)(min)(min)事(shi)案(an)(an)件(jian)受(shou)理(li)有工(gong)(gong)(gong)資(zi)(zi)欠(qian)條的(de)(de)(de)拖欠(qian)農(nong)(nong)(nong)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)爭議(yi),進一步暢(chang)通(tong)農(nong)(nong)(nong)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)當事(shi)人(ren)維(wei)權渠道(dao);合(he)理(li)分(fen)配舉證(zheng)責任,主動(dong)依職權調查(cha),充分(fen)考慮農(nong)(nong)(nong)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)舉證(zheng)能力不足的(de)(de)(de)實(shi)(shi)際情況;充分(fen)發揮簡易程(cheng)序和(he)小額速裁機(ji)制功能,提(ti)高(gao)案(an)(an)件(jian)處理(li)效率(lv)。二是加大(da)案(an)(an)件(jian)執(zhi)行(xing)力度(du)(du)。將(jiang)拖欠(qian)農(nong)(nong)(nong)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)爭議(yi)案(an)(an)件(jian)作為重點民(min)(min)(min)(min)(min)(min)生案(an)(an)件(jian)納入速執(zhi)程(cheng)序,優先安排人(ren)力、物(wu)力,用(yong)(yong)足、用(yong)(yong)盡執(zhi)行(xing)措施;規(gui)范裁審執(zhi)行(xing)程(cheng)序銜接,強化仲(zhong)裁裁決書(shu)(shu)、調解書(shu)(shu)的(de)(de)(de)執(zhi)行(xing)力度(du)(du),保(bao)(bao)(bao)障仲(zhong)裁處理(li)結果落實(shi)(shi)落地;及時給予執(zhi)行(xing)救助,保(bao)(bao)(bao)障困難農(nong)(nong)(nong)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)生活等。三是落實(shi)(shi)案(an)(an)件(jian)保(bao)(bao)(bao)全規(gui)定。對(dui)農(nong)(nong)(nong)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)追(zhui)索(suo)工(gong)(gong)(gong)資(zi)(zi)案(an)(an)件(jian)申(shen)請財產(chan)保(bao)(bao)(bao)全的(de)(de)(de),一般不應(ying)要求擔(dan)保(bao)(bao)(bao);對(dui)當事(shi)人(ren)沒有提(ti)出申(shen)請的(de)(de)(de),人(ren)民(min)(min)(min)(min)(min)(min)法(fa)(fa)院可(ke)依職權采取(qu)保(bao)(bao)(bao)全措施;對(dui)農(nong)(nong)(nong)民(min)(min)(min)(min)(min)(min)工(gong)(gong)(gong)在仲(zhong)裁階(jie)段(duan)提(ti)出財產(chan)保(bao)(bao)(bao)全申(shen)請的(de)(de)(de),人(ren)民(min)(min)(min)(min)(min)(min)法(fa)(fa)院要依法(fa)(fa)快(kuai)速審查(cha)并及時作出裁定等,有效保(bao)(bao)(bao)障案(an)(an)件(jian)執(zhi)行(xing)。
