日前,教(jiao)育部印發《中小學教(jiao)育懲戒規則(ze)(試行(xing))》(以(yi)下簡稱《規則(ze)》)。教(jiao)育部政策法規司負責人回答了記者的提問。
一、請簡單介紹一下《規則》制定出臺的背景和過程。
教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)懲(cheng)戒(jie)(jie)(jie)問(wen)(wen)題長期(qi)以來一(yi)直是(shi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)領域中(zhong)(zhong)(zhong)央關(guan)(guan)(guan)心、社會(hui)(hui)關(guan)(guan)(guan)注(zhu)、群(qun)眾關(guan)(guan)(guan)切的(de)(de)(de)(de)熱(re)點問(wen)(wen)題。2019年6月,《中(zhong)(zhong)(zhong)共中(zhong)(zhong)(zhong)央 國(guo)(guo)務院關(guan)(guan)(guan)于(yu)深(shen)化教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)教(jiao)(jiao)(jiao)學(xue)改革(ge)全面(mian)(mian)提(ti)高(gao)義務教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)質量的(de)(de)(de)(de)意(yi)見(jian)(jian)》對制定教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)懲(cheng)戒(jie)(jie)(jie)有關(guan)(guan)(guan)實(shi)施細(xi)則(ze)(ze)(ze)提(ti)出明(ming)確(que)要求。中(zhong)(zhong)(zhong)央領導同志多次作出指示(shi)批示(shi),“兩(liang)會(hui)(hui)”代表(biao)、委(wei)員提(ti)出許多有關(guan)(guan)(guan)建議(yi)、提(ti)案,基層(ceng)學(xue)校(xiao)(xiao)校(xiao)(xiao)長、教(jiao)(jiao)(jiao)師普遍希望國(guo)(guo)家明(ming)確(que)規(gui)則(ze)(ze)(ze),解(jie)決老師不敢管、不愿管、不會(hui)(hui)管學(xue)生(sheng)這一(yi)突出問(wen)(wen)題,大多數家長也對此表(biao)示(shi)支(zhi)持(chi)。教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)懲(cheng)戒(jie)(jie)(jie)問(wen)(wen)題是(shi)一(yi)個小(xiao)切口,卻(que)關(guan)(guan)(guan)系(xi)到(dao)學(xue)校(xiao)(xiao)全面(mian)(mian)貫徹黨的(de)(de)(de)(de)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)方(fang)針(zhen)、落(luo)實(shi)立德樹人根本任務的(de)(de)(de)(de)大戰略(lve),關(guan)(guan)(guan)系(xi)到(dao)營造(zao)良好(hao)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)生(sheng)態(tai)的(de)(de)(de)(de)大問(wen)(wen)題。教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)部(bu)自2019年開(kai)始組(zu)織研究(jiu)《規(gui)則(ze)(ze)(ze)》的(de)(de)(de)(de)起(qi)草(cao),開(kai)展了(le)(le)深(shen)入(ru)的(de)(de)(de)(de)理(li)論(lun)研究(jiu),并廣(guang)泛聽取了(le)(le)地方(fang)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)行政部(bu)門、學(xue)校(xiao)(xiao)、教(jiao)(jiao)(jiao)師等各方(fang)面(mian)(mian)的(de)(de)(de)(de)意(yi)見(jian)(jian),還面(mian)(mian)向社會(hui)(hui)公開(kai)征(zheng)求了(le)(le)意(yi)見(jian)(jian),受到(dao)了(le)(le)高(gao)度關(guan)(guan)(guan)注(zhu),共收到(dao)6400余條具體修(xiu)改意(yi)見(jian)(jian),其中(zhong)(zhong)(zhong)對《規(gui)則(ze)(ze)(ze)》持(chi)支(zhi)持(chi)態(tai)度的(de)(de)(de)(de)超過八成(cheng)。在(zai)委(wei)托中(zhong)(zhong)(zhong)國(guo)(guo)教(jiao)(jiao)(jiao)科院開(kai)展的(de)(de)(de)(de)一(yi)項全國(guo)(guo)家長問(wen)(wen)卷調查中(zhong)(zhong)(zhong),收到(dao)123820份有效(xiao)問(wen)(wen)卷,贊同國(guo)(guo)家出臺(tai)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)懲(cheng)戒(jie)(jie)(jie)相(xiang)關(guan)(guan)(guan)政策法律的(de)(de)(de)(de)家長達(da)84.13%。起(qi)草(cao)部(bu)門全面(mian)(mian)梳理(li)了(le)(le)相(xiang)關(guan)(guan)(guan)意(yi)見(jian)(jian),經(jing)反復(fu)修(xiu)改形成(cheng)現在(zai)的(de)(de)(de)(de)《規(gui)則(ze)(ze)(ze)》。因此,《規(gui)則(ze)(ze)(ze)》出臺(tai)是(shi)建立在(zai)科學(xue)研判(pan)、廣(guang)集(ji)民意(yi)、慎重決策基礎上(shang)的(de)(de)(de)(de),有利于(yu)將教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)懲(cheng)戒(jie)(jie)(jie)全面(mian)(mian)納(na)入(ru)法治軌(gui)道。
二、制定《規則》的法律依據是什么?
《教(jiao)(jiao)育(yu)(yu)(yu)法(fa)(fa)》規(gui)定(ding)(ding),學(xue)(xue)校(xiao)及其他(ta)(ta)教(jiao)(jiao)育(yu)(yu)(yu)機(ji)構有(you)對受教(jiao)(jiao)育(yu)(yu)(yu)者實(shi)(shi)施(shi)處分的(de)(de)(de)(de)權(quan)(quan)(quan)(quan)利(li);《義務教(jiao)(jiao)育(yu)(yu)(yu)法(fa)(fa)》規(gui)定(ding)(ding),對違反學(xue)(xue)校(xiao)管(guan)(guan)理制度的(de)(de)(de)(de)學(xue)(xue)生(sheng)(sheng),學(xue)(xue)校(xiao)應當予(yu)以批評(ping)教(jiao)(jiao)育(yu)(yu)(yu);《教(jiao)(jiao)師(shi)(shi)法(fa)(fa)》規(gui)定(ding)(ding),教(jiao)(jiao)師(shi)(shi)有(you)評(ping)定(ding)(ding)學(xue)(xue)生(sheng)(sheng)品行(xing)的(de)(de)(de)(de)評(ping)價權(quan)(quan)(quan)(quan),并提出(chu)(chu)教(jiao)(jiao)師(shi)(shi)應當制止(zhi)有(you)害(hai)于(yu)學(xue)(xue)生(sheng)(sheng)的(de)(de)(de)(de)行(xing)為(wei)(wei)或者其他(ta)(ta)侵犯(fan)學(xue)(xue)生(sheng)(sheng)合法(fa)(fa)權(quan)(quan)(quan)(quan)益的(de)(de)(de)(de)行(xing)為(wei)(wei),批評(ping)和(he)抵制有(you)害(hai)于(yu)學(xue)(xue)生(sheng)(sheng)健(jian)康成長(chang)的(de)(de)(de)(de)現象(xiang);最新(xin)修(xiu)訂(ding)的(de)(de)(de)(de)《未(wei)成年人保護法(fa)(fa)》規(gui)定(ding)(ding),對實(shi)(shi)施(shi)欺凌的(de)(de)(de)(de)未(wei)成年學(xue)(xue)生(sheng)(sheng),學(xue)(xue)校(xiao)應當根(gen)據(ju)欺凌行(xing)為(wei)(wei)的(de)(de)(de)(de)性質和(he)程度,依法(fa)(fa)加強管(guan)(guan)教(jiao)(jiao)。法(fa)(fa)律雖然(ran)沒(mei)有(you)直接(jie)使用教(jiao)(jiao)育(yu)(yu)(yu)懲戒(jie)的(de)(de)(de)(de)概念(nian),但這一(yi)概念(nian)已經約定(ding)(ding)俗成,被社會和(he)教(jiao)(jiao)育(yu)(yu)(yu)界(jie)普遍認同,符合我(wo)們(men)的(de)(de)(de)(de)文化傳統和(he)教(jiao)(jiao)育(yu)(yu)(yu)實(shi)(shi)踐,也是(shi)教(jiao)(jiao)育(yu)(yu)(yu)權(quan)(quan)(quan)(quan)的(de)(de)(de)(de)題中應有(you)之義。制定(ding)(ding)《規(gui)則(ze)》是(shi)確權(quan)(quan)(quan)(quan)、也是(shi)限權(quan)(quan)(quan)(quan),出(chu)(chu)發(fa)點(dian)就是(shi)將法(fa)(fa)律規(gui)定(ding)(ding)的(de)(de)(de)(de)學(xue)(xue)校(xiao)、教(jiao)(jiao)師(shi)(shi)的(de)(de)(de)(de)教(jiao)(jiao)育(yu)(yu)(yu)權(quan)(quan)(quan)(quan)進(jin)一(yi)步細(xi)化,對法(fa)(fa)律禁(jin)止(zhi)的(de)(de)(de)(de)體罰等教(jiao)(jiao)師(shi)(shi)不(bu)當管(guan)(guan)理行(xing)為(wei)(wei)劃(hua)出(chu)(chu)紅線(xian),推動落(luo)實(shi)(shi)黨和(he)國家教(jiao)(jiao)育(yu)(yu)(yu)方(fang)針,促(cu)進(jin)學(xue)(xue)生(sheng)(sheng)全(quan)面發(fa)展。《規(gui)則(ze)》名稱叫“規(gui)則(ze)”而不(bu)是(shi)“辦法(fa)(fa)”,也是(shi)考慮不(bu)是(shi)簡單規(gui)定(ding)(ding)怎么(me)實(shi)(shi)施(shi)教(jiao)(jiao)育(yu)(yu)(yu)懲戒(jie),而是(shi)著力健(jian)全(quan)規(gui)則(ze),細(xi)化法(fa)(fa)律規(gui)定(ding)(ding),強化可(ke)(ke)操作性和(he)可(ke)(ke)監督性,規(gui)范學(xue)(xue)校(xiao)、教(jiao)(jiao)師(shi)(shi)、學(xue)(xue)生(sheng)(sheng)、家長(chang)各方(fang)行(xing)為(wei)(wei),尋求最佳平衡點(dian)。同時(shi),考慮到有(you)關教(jiao)(jiao)育(yu)(yu)(yu)法(fa)(fa)律如(ru)《教(jiao)(jiao)師(shi)(shi)法(fa)(fa)》可(ke)(ke)能做出(chu)(chu)修(xiu)改,教(jiao)(jiao)育(yu)(yu)(yu)懲戒(jie)的(de)(de)(de)(de)實(shi)(shi)施(shi)也要(yao)不(bu)斷通過實(shi)(shi)踐健(jian)全(quan)完善(shan),《規(gui)則(ze)》將在一(yi)段時(shi)間(jian)后適時(shi)進(jin)行(xing)評(ping)估,并進(jin)行(xing)修(xiu)訂(ding)、完善(shan)。
三、如何界定教育懲戒的概念和實施范圍?
《規(gui)(gui)(gui)則(ze)》第二條(tiao)明(ming)確規(gui)(gui)(gui)定(ding)(ding),教(jiao)(jiao)育(yu)(yu)懲戒(jie)是(shi)指“學(xue)(xue)校、教(jiao)(jiao)師(shi)基于(yu)(yu)教(jiao)(jiao)育(yu)(yu)目的(de)(de)(de)(de),對(dui)違(wei)規(gui)(gui)(gui)違(wei)紀學(xue)(xue)生(sheng)進行(xing)管理、訓導或者以規(gui)(gui)(gui)定(ding)(ding)方(fang)式(shi)予以矯治,促使(shi)學(xue)(xue)生(sheng)引(yin)以為(wei)戒(jie)、認(ren)(ren)識(shi)和改正錯(cuo)誤(wu)的(de)(de)(de)(de)教(jiao)(jiao)育(yu)(yu)行(xing)為(wei)”。這(zhe)一(yi)規(gui)(gui)(gui)定(ding)(ding),首先明(ming)確了(le)(le)教(jiao)(jiao)育(yu)(yu)懲戒(jie)的(de)(de)(de)(de)屬性(xing),其(qi)是(shi)在(zai)(zai)教(jiao)(jiao)育(yu)(yu)過(guo)程中發生(sheng)的(de)(de)(de)(de),學(xue)(xue)校、教(jiao)(jiao)師(shi)行(xing)使(shi)教(jiao)(jiao)育(yu)(yu)權(quan)的(de)(de)(de)(de)一(yi)種具體方(fang)式(shi),而(er)(er)不(bu)(bu)是(shi)單獨賦予學(xue)(xue)校、教(jiao)(jiao)師(shi)一(yi)種權(quan)力。其(qi)次,明(ming)確了(le)(le)實(shi)施(shi)的(de)(de)(de)(de)對(dui)象和方(fang)式(shi),是(shi)對(dui)違(wei)規(gui)(gui)(gui)違(wei)紀學(xue)(xue)生(sheng)的(de)(de)(de)(de)管理、訓導和矯治。第三,強調了(le)(le)行(xing)為(wei)的(de)(de)(de)(de)目的(de)(de)(de)(de)性(xing),即是(shi)要(yao)使(shi)學(xue)(xue)生(sheng)認(ren)(ren)識(shi)和改正錯(cuo)誤(wu),而(er)(er)不(bu)(bu)能為(wei)了(le)(le)懲戒(jie)而(er)(er)懲戒(jie)。關于(yu)(yu)《規(gui)(gui)(gui)則(ze)》的(de)(de)(de)(de)適用(yong)范(fan)圍(wei)(wei),高校學(xue)(xue)生(sheng)已有(you)《普(pu)通高等(deng)學(xue)(xue)校學(xue)(xue)生(sheng)管理規(gui)(gui)(gui)定(ding)(ding)》予以規(gui)(gui)(gui)范(fan),而(er)(er)學(xue)(xue)前幼兒認(ren)(ren)知和行(xing)為(wei)控制(zhi)能力較低,特殊(shu)教(jiao)(jiao)育(yu)(yu)學(xue)(xue)校學(xue)(xue)生(sheng)身心發展存在(zai)(zai)障礙(ai),都不(bu)(bu)適宜實(shi)施(shi)教(jiao)(jiao)育(yu)(yu)懲戒(jie),因此《規(gui)(gui)(gui)則(ze)》將教(jiao)(jiao)育(yu)(yu)懲戒(jie)的(de)(de)(de)(de)實(shi)施(shi)范(fan)圍(wei)(wei)限定(ding)(ding)在(zai)(zai)普(pu)通中小學(xue)(xue)校、中等(deng)職(zhi)業學(xue)(xue)校。
四、實施教育懲戒要把握哪些原則?
《規(gui)(gui)(gui)則》明確,實(shi)(shi)施(shi)(shi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie)應(ying)(ying)(ying)當(dang)遵循教(jiao)(jiao)(jiao)育(yu)(yu)(yu)性、合(he)(he)法性、適(shi)(shi)當(dang)性的原(yuan)(yuan)則,主要(yao)體現在:一(yi)是強調教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie)應(ying)(ying)(ying)當(dang)符(fu)合(he)(he)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)規(gui)(gui)(gui)律,注(zhu)重(zhong)(zhong)育(yu)(yu)(yu)人(ren)效果,堅持(chi)育(yu)(yu)(yu)人(ren)為本。要(yao)基(ji)于關愛(ai)學生(sheng)(sheng)的宗旨,注(zhu)重(zhong)(zhong)人(ren)文關懷,達到(dao)(dao)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)學生(sheng)(sheng)遵守規(gui)(gui)(gui)則、增(zeng)強自律、改(gai)(gai)過(guo)向(xiang)上的目的。基(ji)于這(zhe)一(yi)原(yuan)(yuan)則,《規(gui)(gui)(gui)則》規(gui)(gui)(gui)定(ding),教(jiao)(jiao)(jiao)師對學生(sheng)(sheng)實(shi)(shi)施(shi)(shi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie)后(hou),應(ying)(ying)(ying)當(dang)注(zhu)重(zhong)(zhong)與學生(sheng)(sheng)的溝通和幫扶,對改(gai)(gai)正(zheng)錯(cuo)誤的學生(sheng)(sheng)及時予(yu)以(yi)表揚、鼓(gu)勵;學生(sheng)(sheng)受(shou)到(dao)(dao)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie)或者紀律處(chu)分后(hou),能夠誠懇認(ren)錯(cuo)、積極(ji)改(gai)(gai)正(zheng)的,可以(yi)提前解除(chu)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie)或者紀律處(chu)分。二是明確實(shi)(shi)施(shi)(shi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie)要(yao)遵循法治(zhi)原(yuan)(yuan)則,做到(dao)(dao)客觀(guan)公(gong)正(zheng)、合(he)(he)法合(he)(he)規(gui)(gui)(gui)。要(yao)以(yi)事先公(gong)布(bu)的規(gui)(gui)(gui)則為依(yi)據,尊重(zhong)(zhong)學生(sheng)(sheng)基(ji)本權利和人(ren)格尊嚴。《規(gui)(gui)(gui)則》要(yao)求,校規(gui)(gui)(gui)校紀中(zhong)的行為規(gui)(gui)(gui)范和教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie)措施(shi)(shi)應(ying)(ying)(ying)當(dang)明確,并應(ying)(ying)(ying)事先公(gong)布(bu),未經公(gong)布(bu)的校規(gui)(gui)(gui)校紀不得施(shi)(shi)行;還規(gui)(gui)(gui)定(ding)實(shi)(shi)施(shi)(shi)較重(zhong)(zhong)或者嚴重(zhong)(zhong)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie),要(yao)事前聽取陳述申辯、事后(hou)給予(yu)救濟。三是要(yao)求實(shi)(shi)施(shi)(shi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)(cheng)(cheng)戒(jie)應(ying)(ying)(ying)當(dang)選(xuan)擇適(shi)(shi)當(dang)措施(shi)(shi),與學生(sheng)(sheng)過(guo)錯(cuo)程(cheng)度相適(shi)(shi)應(ying)(ying)(ying)。《規(gui)(gui)(gui)則》要(yao)求要(yao)綜(zong)合(he)(he)考慮學生(sheng)(sheng)的一(yi)貫表現、主觀(guan)認(ren)識、悔(hui)過(guo)態度以(yi)及家庭環境(jing)等因(yin)素,以(yi)求最(zui)佳育(yu)(yu)(yu)人(ren)效果。
五、對學生的哪些行為可以實施教育懲戒?
《規(gui)(gui)則》對(dui)應(ying)當(dang)給予(yu)教(jiao)(jiao)(jiao)育(yu)懲戒(jie)的(de)(de)(de)情(qing)形作了具體(ti)化,規(gui)(gui)定在(zai)(zai)確(que)有(you)必要(yao)的(de)(de)(de)情(qing)況下,學(xue)校(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)(shi)(shi)可以在(zai)(zai)學(xue)生(sheng)(sheng)存在(zai)(zai)不服從(cong)、擾(rao)亂(luan)秩序(xu)、行(xing)為(wei)(wei)失范、具有(you)危(wei)(wei)險(xian)性、侵(qin)犯(fan)(fan)權益等(deng)情(qing)形時實施(shi)(shi)教(jiao)(jiao)(jiao)育(yu)懲戒(jie)。不服從(cong),指學(xue)生(sheng)(sheng)主(zhu)觀不完成(cheng)其(qi)基本的(de)(de)(de)學(xue)習任(ren)務,包括(kuo)(kuo)故(gu)意不完成(cheng)教(jiao)(jiao)(jiao)學(xue)任(ren)務要(yao)求或者不服從(cong)學(xue)校(xiao)(xiao)的(de)(de)(de)教(jiao)(jiao)(jiao)育(yu)、管(guan)理要(yao)求;擾(rao)亂(luan)秩序(xu),包括(kuo)(kuo)擾(rao)亂(luan)課堂秩序(xu)和學(xue)校(xiao)(xiao)教(jiao)(jiao)(jiao)育(yu)教(jiao)(jiao)(jiao)學(xue)秩序(xu),即學(xue)生(sheng)(sheng)的(de)(de)(de)個體(ti)行(xing)為(wei)(wei)已經在(zai)(zai)一(yi)定范圍(wei)產生(sheng)(sheng)了不良影響;行(xing)為(wei)(wei)失范,主(zhu)要(yao)指吸煙、飲酒(jiu)以及其(qi)他(ta)違反(fan)學(xue)生(sheng)(sheng)守則的(de)(de)(de)行(xing)為(wei)(wei);具有(you)危(wei)(wei)險(xian)性,指學(xue)生(sheng)(sheng)實施(shi)(shi)有(you)害自(zi)己(ji)或者他(ta)人身心健康的(de)(de)(de)危(wei)(wei)險(xian)行(xing)為(wei)(wei);侵(qin)犯(fan)(fan)權益,指學(xue)生(sheng)(sheng)打罵同(tong)學(xue)、老師(shi)(shi)(shi),欺凌同(tong)學(xue)或者侵(qin)害他(ta)人合法權益的(de)(de)(de)行(xing)為(wei)(wei)。此外,《規(gui)(gui)則》與《預防未成(cheng)年人犯(fan)(fan)罪(zui)(zui)法》相銜接,規(gui)(gui)定學(xue)生(sheng)(sheng)實施(shi)(shi)屬于《預防未成(cheng)年人犯(fan)(fan)罪(zui)(zui)法》規(gui)(gui)定的(de)(de)(de)不良行(xing)為(wei)(wei)或者嚴重不良行(xing)為(wei)(wei)的(de)(de)(de),學(xue)校(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)(shi)(shi)應(ying)當(dang)予(yu)以制止并實施(shi)(shi)教(jiao)(jiao)(jiao)育(yu)懲戒(jie),加強管(guan)教(jiao)(jiao)(jiao)。
六、學校、教師可以采取哪些教育懲戒措施?

教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)是一門(men)藝術(shu),教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)戒(jie)(jie)是這(zhe)門(men)藝術(shu)中(zhong)尤為(wei)特殊(shu)的(de)(de)(de)部(bu)分,既要(yao)(yao)(yao)遵循教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)規(gui)(gui)(gui)律原則,又要(yao)(yao)(yao)靈活運用,重視方式方法和實(shi)(shi)(shi)(shi)(shi)際。《規(gui)(gui)(gui)則》為(wei)此作了多層(ceng)次(ci)(ci)的(de)(de)(de)規(gui)(gui)(gui)定。首(shou)先,要(yao)(yao)(yao)求學(xue)校(xiao)、教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)提(ti)高能(neng)(neng)力,會用善用。《規(gui)(gui)(gui)則》專門(men)規(gui)(gui)(gui)定,學(xue)校(xiao)應當(dang)有(you)針對性地(di)加強對教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)的(de)(de)(de)培訓(xun),促(cu)進教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)更新教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)理(li)念(nian)、改進教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)方式方法,提(ti)高教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)正確(que)(que)履(lv)行(xing)(xing)職(zhi)責的(de)(de)(de)意(yi)識與能(neng)(neng)力。教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)應當(dang)審(shen)慎使(shi)(shi)用教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)戒(jie)(jie),與鼓勵、勸導、積極管(guan)教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)等(deng)(deng)教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)方式相結合,確(que)(que)有(you)必要(yao)(yao)(yao)再(zai)合理(li)使(shi)(shi)用。其次(ci)(ci),強化保(bao)障,保(bao)證能(neng)(neng)用敢(gan)用。由于(yu)輿論壓(ya)(ya)力、安全(quan)風險壓(ya)(ya)力等(deng)(deng),實(shi)(shi)(shi)(shi)(shi)踐中(zhong)教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)往往顧(gu)慮重重,不敢(gan)實(shi)(shi)(shi)(shi)(shi)施教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)戒(jie)(jie)。《規(gui)(gui)(gui)則》明(ming)(ming)確(que)(que),學(xue)校(xiao)應當(dang)支持(chi)、監督(du)教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)正當(dang)履(lv)行(xing)(xing)職(zhi)務(wu),教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)戒(jie)(jie)是教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)的(de)(de)(de)職(zhi)務(wu)行(xing)(xing)為(wei),教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)正常(chang)履(lv)職(zhi)產生(sheng)的(de)(de)(de)糾(jiu)紛和法律后果(guo)應由學(xue)校(xiao)承(cheng)擔。教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)因實(shi)(shi)(shi)(shi)(shi)施教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)戒(jie)(jie)與學(xue)生(sheng)及其家長發生(sheng)糾(jiu)紛,學(xue)校(xiao)應當(dang)及時進行(xing)(xing)處(chu)理(li),教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)無過錯的(de)(de)(de),不得因教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)實(shi)(shi)(shi)(shi)(shi)施教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)戒(jie)(jie)而給予其處(chu)分或者其他不利處(chu)理(li)。即使(shi)(shi)因為(wei)教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)實(shi)(shi)(shi)(shi)(shi)施教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)戒(jie)(jie)與家長產生(sheng)糾(jiu)紛,也要(yao)(yao)(yao)通(tong)(tong)過合理(li)合法的(de)(de)(de)正當(dang)渠道(dao)解決,家長威脅、侮辱、傷害教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)的(de)(de)(de),學(xue)校(xiao)、教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)部(bu)門(men)、公安機關要(yao)(yao)(yao)依法予以追究(jiu),維(wei)護教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)合法權益。最后,健全(quan)監督(du),避免濫(lan)用。《規(gui)(gui)(gui)則》明(ming)(ming)確(que)(que)了教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)(cheng)戒(jie)(jie)后的(de)(de)(de)救濟渠道(dao),包括校(xiao)內申訴(su)、向主(zhu)管(guan)部(bu)門(men)申訴(su),符合法定受理(li)條件的(de)(de)(de)還可以進行(xing)(xing)行(xing)(xing)政復議和行(xing)(xing)政訴(su)訟;明(ming)(ming)確(que)(que)教(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)(jiao)師(shi)(shi)(shi)(shi)(shi)(shi)(shi)(shi)不當(dang)實(shi)(shi)(shi)(shi)(shi)施管(guan)理(li)行(xing)(xing)為(wei)要(yao)(yao)(yao)承(cheng)擔相應責任(ren)。《規(gui)(gui)(gui)則》健全(quan)了監督(du)機制,暢通(tong)(tong)了救濟渠道(dao)。
十一、如何發揮家長在學生管理中的作用,形成育人合力?
教(jiao)(jiao)(jiao)育(yu)是學(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)和家(jia)(jia)(jia)(jia)(jia)(jia)庭的共同(tong)職(zhi)(zhi)責,家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)的理解、支(zhi)持和配(pei)合(he)是學(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)(shi)正常(chang)實(shi)(shi)施(shi)教(jiao)(jiao)(jiao)育(yu)管(guan)理的重(zhong)要方面。《規(gui)(gui)(gui)(gui)則》從多個角度對家(jia)(jia)(jia)(jia)(jia)(jia)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)協作進(jin)行(xing)(xing)(xing)了規(gui)(gui)(gui)(gui)定(ding)(ding)。首先(xian),明確了家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)在學(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)制定(ding)(ding)教(jiao)(jiao)(jiao)育(yu)懲戒具體規(gui)(gui)(gui)(gui)則,以及教(jiao)(jiao)(jiao)育(yu)懲戒實(shi)(shi)施(shi)、監(jian)督(du)救濟等過程中的參與(yu)權、監(jian)督(du)權。規(gui)(gui)(gui)(gui)定(ding)(ding)學(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)制定(ding)(ding)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)規(gui)(gui)(gui)(gui)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)紀(ji)應(ying)當(dang)提交(jiao)家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)委(wei)員會討論,并應(ying)當(dang)利用多種途(tu)徑向家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)進(jin)行(xing)(xing)(xing)宣講,有條(tiao)件的還可以吸(xi)收(shou)家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)加入(ru)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)規(gui)(gui)(gui)(gui)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)紀(ji)執行(xing)(xing)(xing)委(wei)員會,監(jian)督(du)教(jiao)(jiao)(jiao)育(yu)懲戒實(shi)(shi)施(shi)。要求實(shi)(shi)施(shi)教(jiao)(jiao)(jiao)育(yu)懲戒前后,學(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)(shi)應(ying)當(dang)要根據情況告知(zhi)家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang),學(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)成立(li)學(xue)(xue)(xue)(xue)(xue)生(sheng)申(shen)訴委(wei)員會時(shi)(shi)要吸(xi)收(shou)家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)代(dai)表參加,學(xue)(xue)(xue)(xue)(xue)生(sheng)申(shen)訴委(wei)員會的人員構成、受理范(fan)圍(wei)及處(chu)理程序等要向家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)公(gong)布。同(tong)時(shi)(shi)強調,學(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)(shi)應(ying)當(dang)重(zhong)視家(jia)(jia)(jia)(jia)(jia)(jia)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)協作,積極與(yu)家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)溝通,爭取家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)理解、支(zhi)持和配(pei)合(he)實(shi)(shi)施(shi)教(jiao)(jiao)(jiao)育(yu)懲戒;家(jia)(jia)(jia)(jia)(jia)(jia)長(chang)(chang)(chang)應(ying)當(dang)履(lv)行(xing)(xing)(xing)對子女的教(jiao)(jiao)(jiao)育(yu)職(zhi)(zhi)責,尊重(zhong)教(jiao)(jiao)(jiao)師(shi)(shi)的教(jiao)(jiao)(jiao)育(yu)權利,配(pei)合(he)學(xue)(xue)(xue)(xue)(xue)校(xiao)(xiao)(xiao)(xiao)(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)(shi)對違規(gui)(gui)(gui)(gui)違紀(ji)學(xue)(xue)(xue)(xue)(xue)生(sheng)進(jin)行(xing)(xing)(xing)管(guan)教(jiao)(jiao)(jiao)。
十二、《規則》規定了教育部門的哪些職責?
按照《規(gui)則(ze)》規(gui)定(ding),主(zhu)管(guan)教(jiao)(jiao)(jiao)育(yu)部(bu)門對學(xue)(xue)(xue)校(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)實施(shi)(shi)教(jiao)(jiao)(jiao)育(yu)懲(cheng)戒(jie)要(yao)履(lv)行指(zhi)導(dao)、支持、評價(jia)和監督(du)(du)的(de)(de)(de)(de)職(zhi)責(ze)(ze)。一是加(jia)(jia)強指(zhi)導(dao)。《規(gui)則(ze)》規(gui)定(ding),教(jiao)(jiao)(jiao)育(yu)部(bu)門要(yao)指(zhi)導(dao)學(xue)(xue)(xue)校(xiao)(xiao)制定(ding)教(jiao)(jiao)(jiao)育(yu)懲(cheng)戒(jie)的(de)(de)(de)(de)實施(shi)(shi)細則(ze)以及相關的(de)(de)(de)(de)校(xiao)(xiao)規(gui)校(xiao)(xiao)紀,建(jian)立(li)工作機制,統籌推進《規(gui)則(ze)》的(de)(de)(de)(de)實施(shi)(shi)。二是加(jia)(jia)大(da)支持。教(jiao)(jiao)(jiao)育(yu)部(bu)門要(yao)作為(wei)學(xue)(xue)(xue)校(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)依(yi)(yi)法(fa)(fa)履(lv)行教(jiao)(jiao)(jiao)育(yu)懲(cheng)戒(jie)職(zhi)責(ze)(ze)的(de)(de)(de)(de)堅強后盾,協調處理(li)相關糾(jiu)(jiu)紛,當家長威脅(xie)、侮辱、傷害教(jiao)(jiao)(jiao)師(shi)時,應當依(yi)(yi)法(fa)(fa)保護教(jiao)(jiao)(jiao)師(shi)人身安全,必(bi)要(yao)時請(qing)公安機關、司法(fa)(fa)機關協助處理(li)。三是加(jia)(jia)強監管(guan)。要(yao)建(jian)立(li)學(xue)(xue)(xue)校(xiao)(xiao)教(jiao)(jiao)(jiao)育(yu)懲(cheng)戒(jie)辦法(fa)(fa)、校(xiao)(xiao)規(gui)校(xiao)(xiao)紀的(de)(de)(de)(de)備(bei)案審(shen)查機制,及時發現并糾(jiu)(jiu)正存(cun)在不(bu)合法(fa)(fa)、不(bu)合規(gui)的(de)(de)(de)(de)規(gui)定(ding)。要(yao)建(jian)立(li)受理(li)學(xue)(xue)(xue)生或(huo)家長對教(jiao)(jiao)(jiao)育(yu)懲(cheng)戒(jie)決定(ding)不(bu)服提起復(fu)核(he)申(shen)請(qing)的(de)(de)(de)(de)受理(li)機制,履(lv)行監督(du)(du)職(zhi)責(ze)(ze)。四是考(kao)核(he)評價(jia)。要(yao)把學(xue)(xue)(xue)校(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)在管(guan)理(li)學(xue)(xue)(xue)生、實施(shi)(shi)教(jiao)(jiao)(jiao)育(yu)懲(cheng)戒(jie)中貫徹法(fa)(fa)治原則(ze)、依(yi)(yi)法(fa)(fa)履(lv)行職(zhi)責(ze)(ze)的(de)(de)(de)(de)情(qing)況,納入對學(xue)(xue)(xue)校(xiao)(xiao)的(de)(de)(de)(de)考(kao)核(he)內(nei)容當中,督(du)(du)促、引導(dao)學(xue)(xue)(xue)校(xiao)(xiao)依(yi)(yi)法(fa)(fa)治校(xiao)(xiao)、依(yi)(yi)法(fa)(fa)辦學(xue)(xue)(xue)。
十三、貫徹落實《規則》有什么舉措?
各(ge)地(di)(di)各(ge)校(xiao)(xiao)要把學習宣(xuan)傳(chuan)《規(gui)(gui)(gui)則(ze)》作(zuo)(zuo)為一項長期(qi)任務,并切實(shi)抓好《規(gui)(gui)(gui)則(ze)》的貫(guan)徹落(luo)(luo)實(shi)。一是(shi)加強(qiang)宣(xuan)傳(chuan),營(ying)造(zao)氛圍。近(jin)期(qi)要集中做(zuo)好《規(gui)(gui)(gui)則(ze)》學習宣(xuan)傳(chuan)工(gong)作(zuo)(zuo),確保在2021年(nian)春(chun)季(ji)學期(qi)開(kai)(kai)學前后,通(tong)過(guo)(guo)多(duo)種形(xing)式(shi)將《規(gui)(gui)(gui)則(ze)》精神和要求(qiu)(qiu)傳(chuan)達宣(xuan)傳(chuan)到(dao)位。二是(shi)加強(qiang)指導(dao),明(ming)確要求(qiu)(qiu)。各(ge)地(di)(di)要組織(zhi)開(kai)(kai)展(zhan)多(duo)種形(xing)式(shi)的培訓(xun)和研討,通(tong)過(guo)(guo)專家(jia)輔導(dao)、案(an)例(li)分析等多(duo)種形(xing)式(shi),準(zhun)確理(li)解文件精神、準(zhun)確把握工(gong)作(zuo)(zuo)要求(qiu)(qiu),爭取做(zuo)到(dao)全覆蓋(gai),提高學校(xiao)(xiao)、教(jiao)(jiao)(jiao)師(shi)的教(jiao)(jiao)(jiao)育(yu)(yu)(yu)管理(li)能力和依法治理(li)水平。教(jiao)(jiao)(jiao)育(yu)(yu)(yu)部將組織(zhi)編制教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)戒實(shi)施指導(dao)手(shou)冊,加強(qiang)指導(dao)。三是(shi)健(jian)全制度,落(luo)(luo)細落(luo)(luo)小(xiao)。各(ge)地(di)(di)要指導(dao)學校(xiao)(xiao)開(kai)(kai)展(zhan)校(xiao)(xiao)規(gui)(gui)(gui)校(xiao)(xiao)紀的修訂工(gong)作(zuo)(zuo),健(jian)全《規(gui)(gui)(gui)則(ze)》提出的校(xiao)(xiao)規(gui)(gui)(gui)校(xiao)(xiao)紀執行委(wei)員會(hui)、學生申訴委(wei)員會(hui)等各(ge)種制度,健(jian)全教(jiao)(jiao)(jiao)育(yu)(yu)(yu)懲(cheng)戒實(shi)施和監(jian)管、救濟的工(gong)作(zuo)(zuo)機制。
