中國(guo)銀(yin)保監會有關部門負責人就《銀(yin)行保險(xian)機構聲譽風險(xian)管理辦法(試行)》答記者問
為提高行業聲譽風險(xian)管(guan)理(li)水平,指導銀行保(bao)險(xian)機構有效防范化解聲譽風險(xian),維護(hu)金(jin)融穩定和市場信(xin)心,銀保(bao)監會近日印發《銀行保(bao)險(xian)機構聲譽風險(xian)管(guan)理(li)辦法(試行)》(以下簡稱(cheng)《辦法》),有關部門負責人就相關問(wen)題回答了記者提問(wen)。
一、《辦法》制定的背景是什么?
2008年(nian)金(jin)融(rong)危機后,聲(sheng)譽(yu)風(feng)險管(guan)(guan)理(li)(li)(li)逐漸(jian)成(cheng)為(wei)金(jin)融(rong)機構(gou)(gou)風(feng)險管(guan)(guan)理(li)(li)(li)體(ti)系的重要組成(cheng)部分。原(yuan)銀監(jian)會、原(yuan)保(bao)監(jian)會分別于2009年(nian)和2014年(nian)出(chu)(chu)臺了專項聲(sheng)譽(yu)風(feng)險管(guan)(guan)理(li)(li)(li)指(zhi)引(yin),并在(zai)工作實(shi)踐中積(ji)累(lei)了大量具有中國(guo)特色的監(jian)管(guan)(guan)經驗,行(xing)(xing)業(ye)機構(gou)(gou)也在(zai)貫徹執行(xing)(xing)過(guo)程中探索總結出(chu)(chu)許多有益做法(fa)。當前,金(jin)融(rong)業(ye)聲(sheng)譽(yu)風(feng)險形勢復雜嚴峻,有關制(zhi)(zhi)度規范(fan)已不能完全適(shi)應新形勢、新變(bian)化,因此,銀保(bao)監(jian)會著眼于完善(shan)聲(sheng)譽(yu)風(feng)險管(guan)(guan)理(li)(li)(li)制(zhi)(zhi)度體(ti)系,吸收固化聲(sheng)譽(yu)風(feng)險管(guan)(guan)理(li)(li)(li)良好(hao)做法(fa),對原(yuan)先兩部聲(sheng)譽(yu)風(feng)險管(guan)(guan)理(li)(li)(li)指(zhi)引(yin)進行(xing)(xing)修訂,制(zhi)(zhi)訂了《銀行(xing)(xing)保(bao)險機構(gou)(gou)聲(sheng)譽(yu)風(feng)險管(guan)(guan)理(li)(li)(li)辦(ban)法(fa)(試行(xing)(xing))》,形成(cheng)融(rong)合統一的聲(sheng)譽(yu)風(feng)險監(jian)管(guan)(guan)制(zhi)(zhi)度,指(zhi)導行(xing)(xing)業(ye)機構(gou)(gou)加強(qiang)聲(sheng)譽(yu)風(feng)險管(guan)(guan)理(li)(li)(li)、優化完善(shan)體(ti)制(zhi)(zhi)機制(zhi)(zhi)、有效(xiao)防范(fan)應對聲(sheng)譽(yu)風(feng)險。
二(er)、《辦法》的主要適用對象(xiang)是哪(na)些機構?
《辦(ban)法》保留了原兩部指引的(de)適用(yong)(yong)對象,即商業銀(yin)行(xing)和保險公司(si)。同時,考慮到(dao)聲譽風(feng)(feng)險態勢和行(xing)業重要性,還增(zeng)加了信托公司(si)、保險集(ji)團(控股)公司(si)作為直接適用(yong)(yong)對象。此外,還明確銀(yin)保監會及(ji)派出機(ji)構批(pi)準設立的(de)其(qi)他金(jin)融(rong)機(ji)構參照《辦(ban)法》執行(xing),引導各種類型的(de)金(jin)融(rong)行(xing)業機(ji)構共同提(ti)高聲譽風(feng)(feng)險管理水平。
三、《辦法》明確了聲(sheng)譽風險管理的基本原(yuan)則(ze),應如(ru)何理解?
《辦法》首次明(ming)確了聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li)“前瞻性、匹配性、全(quan)覆蓋、有(you)效(xiao)性”四項重要(yao)(yao)原(yuan)(yuan)(yuan)則(ze)(ze)(ze)(ze)(ze)。“前瞻性原(yuan)(yuan)(yuan)則(ze)(ze)(ze)(ze)(ze)”重點強調樹立預防為(wei)主的聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li)理(li)念(nian),要(yao)(yao)求(qiu)加強源(yuan)頭防控、關口前移,定期審視,提升聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li)的預見(jian)性。“匹配性原(yuan)(yuan)(yuan)則(ze)(ze)(ze)(ze)(ze)”要(yao)(yao)求(qiu)聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li)工(gong)(gong)作(zuo)不僅要(yao)(yao)與機(ji)(ji)構自身經營狀(zhuang)況(kuang)、治理(li)結(jie)(jie)構、業務特點等相適應,同時(shi)也要(yao)(yao)符(fu)合外部環境動態變化(hua),不斷(duan)調整完(wan)善(shan)。“全(quan)覆蓋原(yuan)(yuan)(yuan)則(ze)(ze)(ze)(ze)(ze)”明(ming)確機(ji)(ji)構各(ge)層級、各(ge)條(tiao)線都(dou)應重視聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li),建立完(wan)善(shan)的聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li)架構體(ti)系(xi)。“有(you)效(xiao)性原(yuan)(yuan)(yuan)則(ze)(ze)(ze)(ze)(ze)”指出(chu)聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li)以防控風(feng)(feng)(feng)險(xian)(xian)(xian)、有(you)效(xiao)處(chu)置、修復形象為(wei)最終標(biao)準(zhun),制(zhi)度設計、機(ji)(ji)制(zhi)構建和組織(zhi)落(luo)實都(dou)應圍繞這一標(biao)準(zhun)來展(zhan)開。四項原(yuan)(yuan)(yuan)則(ze)(ze)(ze)(ze)(ze)從工(gong)(gong)作(zuo)實際出(chu)發,統領(ling)行業聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li)各(ge)項工(gong)(gong)作(zuo)任務,既(ji)通用于不同類型機(ji)(ji)構,同時(shi)也為(wei)各(ge)家(jia)機(ji)(ji)構結(jie)(jie)合自身特點開展(zhan)有(you)效(xiao)聲(sheng)(sheng)(sheng)譽(yu)(yu)(yu)風(feng)(feng)(feng)險(xian)(xian)(xian)管(guan)(guan)理(li)留出(chu)空間,體(ti)現了務實為(wei)本、解決(jue)問題(ti)、面向未來的監(jian)管(guan)(guan)理(li)念(nian)。
四、《辦法》如何強化聲譽風險管(guan)理主(zhu)體責(ze)任?
《辦(ban)法》明確規定(ding)“銀行(xing)保險(xian)機構承擔聲譽風險(xian)管(guan)理的主體(ti)(ti)責(ze)任(ren)”,并(bing)對機構各(ge)層級、各(ge)部門的工作(zuo)責(ze)任(ren)也進(jin)行(xing)了明確,力圖解決聲譽風險(xian)管(guan)理與業務經營發展(zhan)“兩(liang)張皮”的問題。此外(wai),《辦(ban)法》還(huan)將主體(ti)(ti)責(ze)任(ren)進(jin)一(yi)步(bu)落實落細,從全(quan)流程(cheng)管(guan)理和常態化建(jian)(jian)設兩(liang)個維度提(ti)出監(jian)管(guan)要求,強(qiang)調各(ge)機構要認(ren)真做好事(shi)前評估、事(shi)中(zhong)應(ying)對、事(shi)后總結的七(qi)環節閉(bi)環管(guan)理工作(zuo),同時應(ying)開(kai)展(zhan)著眼長遠的七(qi)方面日常基礎工作(zuo),建(jian)(jian)立長效管(guan)理機制。
五、《辦法》對(dui)于問責(ze)處(chu)罰有何(he)規定(ding)的?
《辦法(fa)(fa)》要(yao)求(qiu)行(xing)業(ye)機(ji)構(gou)(gou)(gou)以黨的(de)政治(zhi)建設為(wei)統領,強(qiang)化公司治(zhi)理(li)(li)在(zai)聲(sheng)譽風(feng)險(xian)管(guan)(guan)理(li)(li)中(zhong)的(de)作(zuo)用,旨在(zai)通過建立健全中(zhong)國特(te)色(se)銀行(xing)保險(xian)機(ji)構(gou)(gou)(gou)聲(sheng)譽風(feng)險(xian)管(guan)(guan)理(li)(li)體系(xi),為(wei)推(tui)動(dong)銀行(xing)保險(xian)機(ji)構(gou)(gou)(gou)完善聲(sheng)譽風(feng)險(xian)管(guan)(guan)理(li)(li)、加強(qiang)公司治(zhi)理(li)(li)、實現科(ke)學穩健發(fa)展、防(fang)(fang)范化解金融(rong)風(feng)險(xian)提(ti)供堅(jian)強(qiang)保證。還要(yao)求(qiu)機(ji)構(gou)(gou)(gou)將(jiang)聲(sheng)譽事件(jian)的(de)防(fang)(fang)范處(chu)置情(qing)況(kuang)納入考核范圍,對引發(fa)聲(sheng)譽事件(jian)或(huo)預防(fang)(fang)及處(chu)置不當造成重(zhong)(zhong)大損失(shi)或(huo)嚴(yan)重(zhong)(zhong)不良影(ying)響的(de)相(xiang)關人(ren)員和(he)聲(sheng)譽風(feng)險(xian)管(guan)(guan)理(li)(li)部門、其他職能(neng)部門、分支機(ji)構(gou)(gou)(gou)等應依(yi)(yi)法(fa)(fa)依(yi)(yi)規進行(xing)問(wen)責(ze)追責(ze)。《辦法(fa)(fa)》同時明確了監(jian)管(guan)(guan)機(ji)構(gou)(gou)(gou)可采取(qu)監(jian)督管(guan)(guan)理(li)(li)談話、責(ze)令(ling)限期改正、責(ze)令(ling)機(ji)構(gou)(gou)(gou)紀(ji)律處(chu)分等監(jian)管(guan)(guan)措施,并(bing)可根據情(qing)節嚴(yan)重(zhong)(zhong)程度,依(yi)(yi)據現行(xing)有關法(fa)(fa)律條(tiao)款(kuan)進行(xing)處(chu)罰(fa),實現了聲(sheng)譽風(feng)險(xian)監(jian)管(guan)(guan)與(yu)上位(wei)法(fa)(fa)的(de)緊密銜接,提(ti)升了聲(sheng)譽風(feng)險(xian)監(jian)管(guan)(guan)的(de)權(quan)威性、嚴(yan)肅性和(he)可操(cao)作(zuo)性。
六、《辦(ban)法(fa)》如何(he)保護金(jin)融(rong)消費者合法(fa)權益(yi)?
《辦法(fa)(fa)》要(yao)求銀行(xing)保(bao)險機構(gou)承擔社會(hui)(hui)責任(ren)、誠實(shi)(shi)守信(xin)經營、提(ti)供(gong)優質高效服(fu)務,重(zhong)視聲譽資(zi)本積累,制(zhi)定并實(shi)(shi)施員工教育(yu)和(he)(he)培訓計劃(hua),這(zhe)將推動(dong)機構(gou)更加重(zhong)視消費者(zhe)體驗,努力提(ti)升服(fu)務意(yi)識和(he)(he)服(fu)務能力。同時(shi),《辦法(fa)(fa)》要(yao)求銀行(xing)保(bao)險機構(gou)主動(dong)接受社會(hui)(hui)輿(yu)論監督,及(ji)時(shi)準確公開信(xin)息,將有利于(yu)減少(shao)信(xin)息不對稱,保(bao)障消費者(zhe)的(de)知情權。此外,《辦法(fa)(fa)》要(yao)求銀行(xing)保(bao)險機構(gou)建立與投訴(su)、舉報、調解、訴(su)訟(song)等聯(lian)動(dong)的(de)聲譽風險防范機制(zhi),及(ji)時(shi)回應和(he)(he)解決(jue)消費者(zhe)合(he)理訴(su)求,這(zhe)將有利于(yu)促進機構(gou)進一步重(zhong)視消費者(zhe)訴(su)求,保(bao)護(hu)消費者(zhe)合(he)法(fa)(fa)權益。
