加強公益訴訟檢察聽證工作
以看得見的方式守護公共利益
——最高檢第八檢察廳負責人就公益訴訟檢察聽證典型案例答記者問
2021年7月22日,最高人民檢察(cha)院發(fa)布了(le)一(yi)批公(gong)(gong)益訴(su)訟檢察(cha)聽證典型案(an)例(li),這批公(gong)(gong)益訴(su)訟典型案(an)例(li)有(you)哪(na)些特點,下一(yi)步公(gong)(gong)益訴(su)訟聽證工(gong)作將如何開展?最高檢第八檢察(cha)廳廳長胡衛列就相關(guan)問(wen)題回答了(le)記者提問(wen)。
一(yi)、目前檢察(cha)聽證已經覆蓋“四大(da)檢察(cha)”“十大(da)業務”,請問全國檢察(cha)機關公益訴訟聽證工作(zuo)開(kai)展得如何?有哪些主要特點?
答:去年以來,全國檢(jian)察機關公(gong)益訴訟檢(jian)察部(bu)門(men)認真貫(guan)徹(che)落實最高(gao)檢(jian)關于檢(jian)察聽證工作的部(bu)署(shu)要求,積極穩妥開展公(gong)益訴訟聽證工作,取(qu)得(de)了以公(gong)開促(cu)公(gong)正贏公(gong)信(xin)的初步成效(xiao)。
相(xiang)比于其他檢(jian)察(cha)業務聽(ting)(ting)(ting)證(zheng)(zheng)(zheng),公(gong)益訴(su)(su)訟檢(jian)察(cha)聽(ting)(ting)(ting)證(zheng)(zheng)(zheng)工作(zuo)可以(yi)(yi)說是起(qi)步晚、進展快。最高檢(jian)自2000年(nian)(nian)(nian)就明確刑(xing)事申(shen)訴(su)(su)案(an)件公(gong)開(kai)審查(cha)主(zhu)要(yao)(yao)(yao)以(yi)(yi)聽(ting)(ting)(ting)證(zheng)(zheng)(zheng)會形式進行(xing)。之(zhi)后,不(bu)起(qi)訴(su)(su)案(an)件、民事訴(su)(su)訟監督、羈押必要(yao)(yao)(yao)性(xing)審查(cha)等辦(ban)案(an)工作(zuo)也出(chu)臺了相(xiang)關(guan)(guan)規定。因(yin)為公(gong)益訴(su)(su)訟是檢(jian)察(cha)機關(guan)(guan)的(de)一項(xiang)嶄新職能,全面開(kai)展不(bu)到四年(nian)(nian)(nian),按照最高檢(jian)部署,去(qu)年(nian)(nian)(nian)下半年(nian)(nian)(nian)向全國檢(jian)察(cha)機關(guan)(guan)下發通(tong)知,對公(gong)益訴(su)(su)訟辦(ban)案(an)中開(kai)展聽(ting)(ting)(ting)證(zheng)(zheng)(zheng)工作(zuo)提(ti)出(chu)要(yao)(yao)(yao)求,今年(nian)(nian)(nian)年(nian)(nian)(nian)初(chu)進行(xing)了情況通(tong)報。去(qu)年(nian)(nian)(nian)全國公(gong)益訴(su)(su)訟檢(jian)察(cha)聽(ting)(ting)(ting)證(zheng)(zheng)(zheng)案(an)件共1816件,僅(jin)今年(nian)(nian)(nian)一季度就有834件,預計今年(nian)(nian)(nian)全年(nian)(nian)(nian)開(kai)展聽(ting)(ting)(ting)證(zheng)(zheng)(zheng)的(de)案(an)件總(zong)數比去(qu)年(nian)(nian)(nian)將(jiang)有明顯增(zeng)長(chang)。
從工(gong)(gong)作(zuo)開展情況(kuang)看,主要有(you)以下(xia)特(te)點(dian):一(yi)(yi)是(shi)領(ling)(ling)導(dao)重(zhong)(zhong)(zhong)視,有(you)序(xu)推(tui)進。工(gong)(gong)作(zuo)開展初期,各省級(ji)、市級(ji)檢(jian)(jian)(jian)察院(yuan)(yuan)按最高檢(jian)(jian)(jian)要求(qiu),在本轄區內確定1-2個下(xia)級(ji)檢(jian)(jian)(jian)察院(yuan)(yuan)先行(xing)試點(dian),有(you)計劃地(di)組織(zhi)聽(ting)(ting)證(zheng)(zheng),最高檢(jian)(jian)(jian)多次派員赴地(di)方調研(yan)督(du)導(dao)。最高檢(jian)(jian)(jian)分(fen)管副檢(jian)(jian)(jian)察長張雪(xue)樵(qiao)和一(yi)(yi)些省級(ji)院(yuan)(yuan)領(ling)(ling)導(dao)還(huan)親自(zi)主持(chi)公(gong)益(yi)(yi)訴(su)訟(song)(song)聽(ting)(ting)證(zheng)(zheng)會。二是(shi)聚(ju)焦重(zhong)(zhong)(zhong)點(dian)領(ling)(ling)域,彰顯(xian)聽(ting)(ting)證(zheng)(zheng)效果。各地(di)檢(jian)(jian)(jian)察機(ji)關將公(gong)益(yi)(yi)訴(su)訟(song)(song)聽(ting)(ting)證(zheng)(zheng)與“守護(hu)人(ren)(ren)民美好生(sheng)活”專項(xiang)監督(du)活動有(you)機(ji)結(jie)合,將生(sheng)態環境和資源保(bao)護(hu)、食(shi)品藥(yao)品安全(quan)、新領(ling)(ling)域等公(gong)益(yi)(yi)損害(hai)突出且群眾反映強烈問(wen)題作(zuo)為聽(ting)(ting)證(zheng)(zheng)重(zhong)(zhong)(zhong)點(dian),發(fa)揮聽(ting)(ting)證(zheng)(zheng)功能,實(shi)現(xian)維護(hu)公(gong)益(yi)(yi)和推(tui)動社會治理的雙贏(ying)多贏(ying)共贏(ying)。三(san)是(shi)注重(zhong)(zhong)(zhong)健全(quan)完善機(ji)制,規范(fan)聽(ting)(ting)證(zheng)(zheng)運(yun)行(xing)。一(yi)(yi)些檢(jian)(jian)(jian)察機(ji)關結(jie)合實(shi)際出臺有(you)關公(gong)益(yi)(yi)訴(su)訟(song)(song)聽(ting)(ting)證(zheng)(zheng)規范(fan)性文件,對公(gong)益(yi)(yi)訴(su)訟(song)(song)案(an)件的聽(ting)(ting)證(zheng)(zheng)范(fan)圍、聽(ting)(ting)證(zheng)(zheng)程序(xu)及聽(ting)(ting)證(zheng)(zheng)保(bao)障等內容(rong)予以細化,增強可操作(zuo)性。最高檢(jian)(jian)(jian)也正在研(yan)究起草《人(ren)(ren)民檢(jian)(jian)(jian)察院(yuan)(yuan)公(gong)益(yi)(yi)訴(su)訟(song)(song)聽(ting)(ting)證(zheng)(zheng)工(gong)(gong)作(zuo)實(shi)施細則》。
二、這(zhe)批公益訴訟檢察(cha)聽證典型案例(li)有(you)哪些主(zhu)要(yao)特點?
答:這(zhe)批案例各有特色,既體(ti)現了(le)公(gong)益訴(su)訟(song)檢(jian)(jian)察聽證工作的(de)特點,也(ye)反(fan)映了(le)公(gong)益訴(su)訟(song)檢(jian)(jian)察辦案活動的(de)鮮(xian)明特征。
一是涉及領(ling)域全。這(zhe)批案(an)(an)例(li)涵蓋公(gong)(gong)益(yi)訴訟法(fa)定(ding)領(ling)域和新領(ling)域,包括環(huan)境資(zi)源、食品藥品、國(guo)有(you)財產(chan)、國(guo)有(you)土(tu)地、英烈權益(yi)、個人信息、文物保護等諸多方面,表明聽(ting)證工(gong)作可以(yi)在公(gong)(gong)益(yi)訴訟各(ge)個領(ling)域普遍(bian)開展。其中多數是生(sheng)態資(zi)源保護案(an)(an)例(li),如湖南(nan)、河(he)南(nan)檢察機關(guan)辦(ban)理(li)的案(an)(an)件,反(fan)映(ying)檢察機關(guan)緊緊圍(wei)繞中心、服務大局,主動(dong)運用(yong)聽(ting)證方式突破(po)辦(ban)案(an)(an)難點,促(cu)進行政協同(tong)和生(sheng)態修復,保護長江(jiang)、黃河(he)生(sheng)態環(huan)境資(zi)源。
二是適(shi)(shi)(shi)用(yong)范圍廣。公益(yi)(yi)(yi)(yi)訴訟(song)(song)檢察(cha)辦(ban)案流(liu)程(cheng)長、環(huan)節多、情(qing)(qing)形復雜。對為(wei)何(he)要(yao)聽證(zheng)?何(he)種情(qing)(qing)形下適(shi)(shi)(shi)用(yong)聽證(zheng)?目前沒(mei)有(you)明(ming)確具體(ti)的(de)規(gui)定,實踐中面臨諸(zhu)多困惑。這批案例反映了各級公益(yi)(yi)(yi)(yi)訴訟(song)(song)檢察(cha)部門積極主動且富(fu)有(you)成效(xiao)的(de)探(tan)索(suo)和實踐。實踐表明(ming),聽證(zheng)工作既(ji)適(shi)(shi)(shi)用(yong)于(yu)辦(ban)理(li)行(xing)政(zheng)(zheng)公益(yi)(yi)(yi)(yi)訴訟(song)(song)、民事公益(yi)(yi)(yi)(yi)訴訟(song)(song)案件(jian)(jian),也(ye)適(shi)(shi)(shi)用(yong)于(yu)辦(ban)理(li)刑事附帶民事公益(yi)(yi)(yi)(yi)訴訟(song)(song)案件(jian)(jian)。在辦(ban)案的(de)各階段、各環(huan)節,遇到(dao)事實認定、法(fa)律適(shi)(shi)(shi)用(yong)、案件(jian)(jian)處理(li)等問(wen)題(ti),包括(kuo)對公益(yi)(yi)(yi)(yi)損害(hai)事實和程(cheng)度(du)、行(xing)政(zheng)(zheng)機關監(jian)督(du)管(guan)理(li)職責、整(zheng)改方案是否(fou)科學合理(li)、行(xing)政(zheng)(zheng)機關是否(fou)依法(fa)全(quan)面履職、整(zheng)改效(xiao)果如何(he)、是否(fou)可以結案或者提起訴訟(song)(song)等具體(ti)情(qing)(qing)形,只(zhi)要(yao)確有(you)必要(yao)聽取聽證(zheng)員意見(jian)的(de),我們認為(wei)均可以組織(zhi)聽證(zheng)。對此,本批案例也(ye)起到(dao)了具體(ti)的(de)指引(yin)作用(yong)。
三是聽(ting)證(zheng)(zheng)(zheng)(zheng)形(xing)(xing)式多。聽(ting)證(zheng)(zheng)(zheng)(zheng)在公益訴(su)訟辦(ban)案(an)(an)中(zhong)主要作(zuo)為調查的一種方式,因此根(gen)據辦(ban)案(an)(an)需要可以有(you)多種形(xing)(xing)式。比如,適應公益訴(su)訟辦(ban)案(an)(an)一體(ti)化的要求,多個案(an)(an)例中(zhong)采(cai)取上下級院(yuan)、地(di)方院(yuan)和專門(men)院(yuan),以及同一個院(yuan)的刑事(shi)檢(jian)(jian)(jian)察(cha)部門(men)和公益訴(su)訟檢(jian)(jian)(jian)察(cha)部門(men)聯(lian)合(he)組織(zhi)聽(ting)證(zheng)(zheng)(zheng)(zheng)的做法,統(tong)籌(chou)職能、形(xing)(xing)成合(he)力。聽(ting)證(zheng)(zheng)(zheng)(zheng)地(di)點也不局限在檢(jian)(jian)(jian)察(cha)聽(ting)證(zheng)(zheng)(zheng)(zheng)室內,本批案(an)(an)例中(zhong)有(you)的檢(jian)(jian)(jian)察(cha)院(yuan)為了把(ba)事(shi)實(shi)調查清(qing)楚,聽(ting)證(zheng)(zheng)(zheng)(zheng)前組織(zhi)聽(ting)證(zheng)(zheng)(zheng)(zheng)員(yuan)實(shi)地(di)察(cha)看、體(ti)驗(yan),這(zhe)樣聽(ting)證(zheng)(zheng)(zheng)(zheng)員(yuan)在聽(ting)證(zheng)(zheng)(zheng)(zheng)會上發表評議(yi)意見(jian)就更(geng)加客(ke)觀準(zhun)確。
四是(shi)辦案效果好。首先,這(zhe)批案例聽(ting)(ting)證(zheng)(zheng)(zheng)準備工作普遍做得比較(jiao)充分(fen),聽(ting)(ting)證(zheng)(zheng)(zheng)中組織有(you)序,聽(ting)(ting)證(zheng)(zheng)(zheng)評(ping)議(yi)意見成為檢(jian)(jian)察機關(guan)(guan)作出(chu)正(zheng)確決(jue)(jue)定(ding)的(de)重要參考。聽(ting)(ting)證(zheng)(zheng)(zheng)會(hui)(hui)后(hou),一些(xie)老(lao)大難(nan)問(wen)(wen)題很快(kuai)得到解(jie)決(jue)(jue),聽(ting)(ting)證(zheng)(zheng)(zheng)效果也得到社(she)會(hui)(hui)人士和旁聽(ting)(ting)群眾(zhong)的(de)好評(ping)。特別(bie)是(shi)對(dui)于一些(xie)疑難(nan)復雜的(de)專(zhuan)業問(wen)(wen)題,如濕(shi)地資(zi)源、古橋文物、網絡爬蟲、人臉識(shi)別(bie)技術等問(wen)(wen)題,相(xiang)關(guan)(guan)檢(jian)(jian)察院(yuan)善于借助外腦,邀請(qing)有(you)專(zhuan)業知(zhi)識(shi)的(de)人擔任聽(ting)(ting)證(zheng)(zheng)(zheng)員,發揮了(le)關(guan)(guan)鍵(jian)作用。其次,一些(xie)案件中聽(ting)(ting)證(zheng)(zheng)(zheng)不僅(jin)僅(jin)解(jie)決(jue)(jue)個案問(wen)(wen)題,聽(ting)(ting)證(zheng)(zheng)(zheng)員們積極建言獻策還(huan)促(cu)成檢(jian)(jian)察機關(guan)(guan)深入研究諸(zhu)如根治(zhi)停車(che)亂象等相(xiang)關(guan)(guan)社(she)會(hui)(hui)治(zhi)理(li)問(wen)(wen)題,聽(ting)(ting)證(zheng)(zheng)(zheng)會(hui)(hui)后(hou)相(xiang)關(guan)(guan)檢(jian)(jian)察院(yuan)主動向黨(dang)委政府提出(chu)有(you)價(jia)值的(de)報告,切(qie)實發揮法治(zhi)參謀作用。
從公益(yi)訴(su)訟辦案(an)實(shi)踐看,聽(ting)證(zheng)不僅有利(li)于檢(jian)察(cha)(cha)機關全(quan)面、及(ji)時、準確查明案(an)件事實(shi)、正確適用法(fa)律、作(zuo)出處(chu)理決定,增強檢(jian)察(cha)(cha)監督(du)的針對(dui)性和實(shi)效性,還有利(li)于保障群眾的知情權、參(can)與權、監督(du)權,促進司法(fa)公開和司法(fa)民主,形成公益(yi)保護(hu)的共識和合力,推動公益(yi)訴(su)訟檢(jian)察(cha)(cha)工作(zuo)健康發展。
三、下一步,檢察(cha)機關公益訴(su)訟聽證工作重點(dian)是什么?
答:一是(shi)加大(da)(da)推進力度,切(qie)實做到“應聽(ting)證盡聽(ting)證”。各級檢察機關公益訴(su)(su)訟(song)(song)檢察部(bu)門要切(qie)實轉變司法理念,改(gai)進辦案方式,加強組(zu)織領(ling)導,增強工(gong)(gong)作(zuo)(zuo)主(zhu)動性(xing),讓聽(ting)證這項創新制度在(zai)推動公益訴(su)(su)訟(song)(song)檢察工(gong)(gong)作(zuo)(zuo)健(jian)康發(fa)展中發(fa)揮更大(da)(da)作(zuo)(zuo)用。最高檢將要定期通報(bao)各地(di)(di)開展公益訴(su)(su)訟(song)(song)聽(ting)證情況,促進各地(di)(di)交流經(jing)驗做法,努(nu)力推動實現辦理公益訴(su)(su)訟(song)(song)案件聽(ting)證工(gong)(gong)作(zuo)(zuo)各級各院全(quan)覆(fu)蓋。
二是要邊(bian)(bian)實踐邊(bian)(bian)總結,提高聽證工作規(gui)范化(hua)(hua)(hua)水(shui)平。要在(zai)遵循《人民檢察院審查案件(jian)聽證工作規(gui)定》的同時(shi),結合(he)公益訴(su)(su)訟(song)特點和個案具(ju)體情況,積極探索創新,進(jin)(jin)一步細化(hua)(hua)(hua)完善(shan)公益訴(su)(su)訟(song)聽證各階段、各環(huan)節的操作流程(cheng)。最高檢將推動盡(jin)快出臺公益訴(su)(su)訟(song)聽證工作實施細則,進(jin)(jin)一步提升公益訴(su)(su)訟(song)聽證規(gui)范化(hua)(hua)(hua)水(shui)平。
三是加(jia)強(qiang)軟硬(ying)件建(jian)設,著力(li)打造(zao)過硬(ying)的(de)公(gong)(gong)益(yi)訴訟(song)聽證檢(jian)察隊伍。要立足本地實(shi)際(ji),組(zu)建(jian)公(gong)(gong)益(yi)訴訟(song)聽證員專業(ye)人才(cai)庫,有計劃(hua)地組(zu)織專業(ye)培訓。通過專題講座(zuo)、現場(chang)觀摩、交流(liu)輪訓等形式(shi),提升(sheng)公(gong)(gong)益(yi)訴訟(song)聽證檢(jian)察官的(de)業(ye)務能(neng)力(li)、流(liu)程控制、應(ying)急處(chu)置、輿情應(ying)對等能(neng)力(li),為辦好每(mei)一(yi)個聽證案件奠(dian)定(ding)堅實(shi)基礎。
