日前,最高檢(jian)聯合教(jiao)育(yu)(yu)部印發(fa)《檢(jian)察官擔任(ren)法(fa)(fa)治副(fu)校長工作(zuo)規定》(下(xia)稱(cheng)《工作(zuo)規定》)。最高檢(jian)第九檢(jian)察廳負(fu)責人、教(jiao)育(yu)(yu)部政策法(fa)(fa)規司負(fu)責人就相(xiang)關問(wen)題回答了記者提問(wen)。
1.新(xin)修訂的未(wei)成(cheng)年人(ren)保護法、預防未(wei)成(cheng)年人(ren)犯罪(zui)法已(yi)于今年6月(yue)1日施行。最高檢(jian)聯合教育(yu)部(bu)出臺《工作規定》有什么考慮?意義何在?
最(zui)高(gao)人民檢(jian)(jian)察(cha)院第九(jiu)檢(jian)(jian)察(cha)廳(ting)負責(ze)人:少年(nian)(nian)(nian)(nian)(nian)(nian)強(qiang)則(ze)國強(qiang)。青(qing)(qing)少年(nian)(nian)(nian)(nian)(nian)(nian)的(de)(de)(de)(de)價值取向關(guan)(guan)乎國家(jia)和(he)(he)民族(zu)的(de)(de)(de)(de)未(wei)(wei)(wei)(wei)來,全面依法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)國必(bi)須從(cong)娃(wa)(wa)娃(wa)(wa)抓起。近(jin)(jin)年(nian)(nian)(nian)(nian)(nian)(nian)來,全國檢(jian)(jian)察(cha)機關(guan)(guan)與(yu)(yu)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)行政部門(men)緊密配(pei)合,開展(zhan)常態化(hua)“法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)進(jin)(jin)校(xiao)(xiao)園”活動(dong),大(da)力推(tui)進(jin)(jin)檢(jian)(jian)察(cha)官擔任法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)副校(xiao)(xiao)長工(gong)(gong)(gong)作,努力為學(xue)校(xiao)(xiao)、師生、家(jia)長提(ti)供更加優質的(de)(de)(de)(de)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)產品,進(jin)(jin)行了卓(zhuo)有成(cheng)效的(de)(de)(de)(de)探索。2021年(nian)(nian)(nian)(nian)(nian)(nian)6月,新修訂的(de)(de)(de)(de)未(wei)(wei)(wei)(wei)成(cheng)年(nian)(nian)(nian)(nian)(nian)(nian)人(ren)保護法(fa)(fa)(fa)(fa)(fa)(fa)(fa)、預防未(wei)(wei)(wei)(wei)成(cheng)年(nian)(nian)(nian)(nian)(nian)(nian)人(ren)犯罪法(fa)(fa)(fa)(fa)(fa)(fa)(fa)正式(shi)施行,明確規(gui)定公安(an)機關(guan)(guan)、人(ren)民檢(jian)(jian)察(cha)院、人(ren)民法(fa)(fa)(fa)(fa)(fa)(fa)(fa)院和(he)(he)司法(fa)(fa)(fa)(fa)(fa)(fa)(fa)行政部門(men)應當結合實(shi)際,根據涉(she)及未(wei)(wei)(wei)(wei)成(cheng)年(nian)(nian)(nian)(nian)(nian)(nian)人(ren)案件的(de)(de)(de)(de)特點(dian),開展(zhan)未(wei)(wei)(wei)(wei)成(cheng)年(nian)(nian)(nian)(nian)(nian)(nian)人(ren)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣(xuan)傳(chuan)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)工(gong)(gong)(gong)作;學(xue)校(xiao)(xiao)可以(yi)從(cong)司法(fa)(fa)(fa)(fa)(fa)(fa)(fa)和(he)(he)執法(fa)(fa)(fa)(fa)(fa)(fa)(fa)機關(guan)(guan)等單(dan)位聘請法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)副校(xiao)(xiao)長、校(xiao)(xiao)外法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)輔導員。“兩(liang)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)”將開展(zhan)未(wei)(wei)(wei)(wei)成(cheng)年(nian)(nian)(nian)(nian)(nian)(nian)人(ren)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣(xuan)傳(chuan)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)的(de)(de)(de)(de)實(shi)踐探索上升為法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律制度(du)。同時,國家(jia)出(chu)臺(tai)開展(zhan)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣(xuan)傳(chuan)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)的(de)(de)(de)(de)第八個五年(nian)(nian)(nian)(nian)(nian)(nian)規(gui)劃(2021-2025年(nian)(nian)(nian)(nian)(nian)(nian)),要(yao)求加強(qiang)青(qing)(qing)少年(nian)(nian)(nian)(nian)(nian)(nian)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu),全面落實(shi)《青(qing)(qing)少年(nian)(nian)(nian)(nian)(nian)(nian)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)大(da)綱》,教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)引導青(qing)(qing)少年(nian)(nian)(nian)(nian)(nian)(nian)從(cong)小(xiao)養成(cheng)尊法(fa)(fa)(fa)(fa)(fa)(fa)(fa)守法(fa)(fa)(fa)(fa)(fa)(fa)(fa)習(xi)慣。檢(jian)(jian)察(cha)機關(guan)(guan)聯(lian)合教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)行政部門(men)出(chu)臺(tai)《工(gong)(gong)(gong)作規(gui)定》,是把未(wei)(wei)(wei)(wei)成(cheng)年(nian)(nian)(nian)(nian)(nian)(nian)人(ren)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣(xuan)傳(chuan)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)工(gong)(gong)(gong)作放到黨和(he)(he)國家(jia)工(gong)(gong)(gong)作大(da)局(ju)中謀(mou)劃,認真(zhen)貫徹習(xi)近(jin)(jin)平法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)思想關(guan)(guan)于(yu)加強(qiang)青(qing)(qing)少年(nian)(nian)(nian)(nian)(nian)(nian)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)的(de)(de)(de)(de)要(yao)求,落實(shi)新修訂的(de)(de)(de)(de)“兩(liang)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)”的(de)(de)(de)(de)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律規(gui)定,推(tui)動(dong)完善(shan)政府(fu)、司法(fa)(fa)(fa)(fa)(fa)(fa)(fa)機關(guan)(guan)、學(xue)校(xiao)(xiao)、社會(hui)、家(jia)庭共同參與(yu)(yu)的(de)(de)(de)(de)青(qing)(qing)少年(nian)(nian)(nian)(nian)(nian)(nian)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)教(jiao)(jiao)(jiao)育(yu)(yu)(yu)(yu)新格局(ju)的(de)(de)(de)(de)有力舉措。
檢(jian)察(cha)(cha)機關(guan)(guan)作(zuo)(zuo)(zuo)為未(wei)成(cheng)年(nian)(nian)人(ren)保(bao)護(hu)法(fa)(fa)律監督(du)機關(guan)(guan)和(he)唯一參與未(wei)成(cheng)年(nian)(nian)人(ren)司法(fa)(fa)保(bao)護(hu)全(quan)(quan)(quan)過(guo)程的(de)(de)政(zheng)(zheng)法(fa)(fa)機關(guan)(guan),肩負著(zhu)(zhu)加強(qiang)未(wei)成(cheng)年(nian)(nian)人(ren)法(fa)(fa)治(zhi)(zhi)(zhi)宣傳教(jiao)(jiao)育(yu)的(de)(de)重大(da)政(zheng)(zheng)治(zhi)(zhi)(zhi)責任(ren)和(he)法(fa)(fa)治(zhi)(zhi)(zhi)責任(ren)。檢(jian)察(cha)(cha)機關(guan)(guan)積極(ji)(ji)爭(zheng)取(qu)各(ge)級(ji)(ji)教(jiao)(jiao)育(yu)行政(zheng)(zheng)部(bu)門、學校(xiao)(xiao)(xiao)支持,大(da)力推(tui)進(jin)檢(jian)察(cha)(cha)官(guan)擔(dan)(dan)任(ren)法(fa)(fa)治(zhi)(zhi)(zhi)副校(xiao)(xiao)(xiao)長工(gong)(gong)作(zuo)(zuo)(zuo),取(qu)得積極(ji)(ji)成(cheng)效。截至2021年(nian)(nian)9月底,全(quan)(quan)(quan)國共有3.9萬余名檢(jian)察(cha)(cha)官(guan)在(zai)7.7萬余所(suo)學校(xiao)(xiao)(xiao)擔(dan)(dan)任(ren)法(fa)(fa)治(zhi)(zhi)(zhi)副校(xiao)(xiao)(xiao)長,實現全(quan)(quan)(quan)國四級(ji)(ji)院檢(jian)察(cha)(cha)長擔(dan)(dan)任(ren)法(fa)(fa)治(zhi)(zhi)(zhi)副校(xiao)(xiao)(xiao)長全(quan)(quan)(quan)覆蓋。但隨著(zhu)(zhu)工(gong)(gong)作(zuo)(zuo)(zuo)的(de)(de)不(bu)斷深入(ru)推(tui)進(jin),我們(men)也遇(yu)到了一些(xie)新情況新問題(ti),比(bi)如,法(fa)(fa)治(zhi)(zhi)(zhi)副校(xiao)(xiao)(xiao)長的(de)(de)聘(pin)任(ren)和(he)管(guan)理(li)工(gong)(gong)作(zuo)(zuo)(zuo)缺乏規(gui)(gui)范(fan),履(lv)職(zhi)(zhi)內容和(he)履(lv)職(zhi)(zhi)方(fang)式(shi)不(bu)明確(que)等,需要制定(ding)規(gui)(gui)范(fan)性文件,進(jin)一步加強(qiang)和(he)規(gui)(gui)范(fan)檢(jian)察(cha)(cha)官(guan)擔(dan)(dan)任(ren)法(fa)(fa)治(zhi)(zhi)(zhi)副校(xiao)(xiao)(xiao)長工(gong)(gong)作(zuo)(zuo)(zuo)。經與教(jiao)(jiao)育(yu)部(bu)政(zheng)(zheng)策法(fa)(fa)規(gui)(gui)司協商,我們(men)起草了《工(gong)(gong)作(zuo)(zuo)(zuo)規(gui)(gui)定(ding)》,對(dui)檢(jian)察(cha)(cha)官(guan)擔(dan)(dan)任(ren)法(fa)(fa)治(zhi)(zhi)(zhi)副校(xiao)(xiao)(xiao)長的(de)(de)適用(yong)范(fan)圍、主要職(zhi)(zhi)責、履(lv)職(zhi)(zhi)方(fang)式(shi)、任(ren)職(zhi)(zhi)管(guan)理(li)、業(ye)務(wu)培訓、考核評價等作(zuo)(zuo)(zuo)出具體規(gui)(gui)定(ding)。《工(gong)(gong)作(zuo)(zuo)(zuo)規(gui)(gui)定(ding)》的(de)(de)出臺,將推(tui)動法(fa)(fa)治(zhi)(zhi)(zhi)教(jiao)(jiao)育(yu)納入(ru)學校(xiao)(xiao)(xiao)教(jiao)(jiao)育(yu)體系,在(zai)增強(qiang)青少年(nian)(nian)法(fa)(fa)治(zhi)(zhi)(zhi)意識和(he)法(fa)(fa)治(zhi)(zhi)(zhi)素養,強(qiang)化(hua)青少年(nian)(nian)綜合司法(fa)(fa)保(bao)護(hu),助力平安校(xiao)(xiao)(xiao)園建(jian)設(she),維護(hu)社會和(he)諧穩(wen)定(ding)方(fang)面具有積極(ji)(ji)意義。
2.《工作規定》由(you)最高檢和教(jiao)育部聯合發文,教(jiao)育部將(jiang)采(cai)取哪些措施,支持(chi)檢察官法治副校長(chang)充分(fen)履職?
教育部政策法規(gui)司負責(ze)人:中小(xiao)(xiao)學(xue)(xue)聘任法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang),對于(yu)加強(qiang)青少年法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)宣傳教(jiao)育(yu)、完(wan)善學(xue)(xue)校(xiao)(xiao)(xiao)管(guan)(guan)理體制(zhi)、提(ti)高學(xue)(xue)校(xiao)(xiao)(xiao)治(zhi)(zhi)(zhi)(zhi)(zhi)理水(shui)(shui)平是(shi)行之有(you)效的(de)方式。教(jiao)育(yu)部一直高度重(zhong)視,積極與最高檢(jian)等有(you)關(guan)部門(men)協調配合,推(tui)動在中小(xiao)(xiao)學(xue)(xue)普遍建(jian)(jian)立(li)實(shi)(shi)施(shi)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)制(zhi)度。下一步,我們(men)將(jiang)(jiang)進一步密切合作(zuo)(zuo)(zuo)(zuo)(zuo)、完(wan)善工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)機制(zhi),支(zhi)(zhi)持(chi)檢(jian)察(cha)官(guan)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)充分履職。一是(shi)規范法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)任職管(guan)(guan)理。教(jiao)育(yu)行政部門(men)將(jiang)(jiang)會同檢(jian)察(cha)院等有(you)關(guan)機關(guan)建(jian)(jian)立(li)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)人員庫并實(shi)(shi)行動態管(guan)(guan)理,確保法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)不缺位。二(er)是(shi)促進法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)提(ti)高履職能力。教(jiao)育(yu)行政部門(men)將(jiang)(jiang)充分發揮(hui)自身優勢,制(zhi)定實(shi)(shi)施(shi)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)培訓(xun)方案和規劃,創新培訓(xun)方式,豐富(fu)培訓(xun)內容(rong),提(ti)升培訓(xun)效果,提(ti)高法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)履職水(shui)(shui)平。三是(shi)支(zhi)(zhi)持(chi)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)開展(zhan)(zhan)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)。指導(dao)學(xue)(xue)校(xiao)(xiao)(xiao)將(jiang)(jiang)支(zhi)(zhi)持(chi)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)履職納入整體工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)規劃,為(wei)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)開展(zhan)(zhan)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)提(ti)供(gong)必要的(de)便利條件,建(jian)(jian)立(li)有(you)效的(de)溝通聯(lian)絡機制(zhi)和日常(chang)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)協調機制(zhi),積極支(zhi)(zhi)持(chi)、配合法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)開展(zhan)(zhan)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)。四是(shi)激勵法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)履職盡責(ze)。指導(dao)學(xue)(xue)校(xiao)(xiao)(xiao)建(jian)(jian)立(li)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)評價制(zhi)度,對法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)的(de)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)情況作(zuo)(zuo)(zuo)(zuo)(zuo)出評價,為(wei)派出機關(guan)提(ti)供(gong)業績考(kao)核、評獎(jiang)評優的(de)參(can)考(kao)依據。同時,教(jiao)育(yu)行政部門(men)也(ye)將(jiang)(jiang)會同相關(guan)部門(men),對開展(zhan)(zhan)法(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)副(fu)(fu)(fu)(fu)校(xiao)(xiao)(xiao)長(chang)(chang)(chang)(chang)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)(zuo)成(cheng)績突(tu)出的(de)單位和個人,按照有(you)關(guan)規定給(gei)予表彰、獎(jiang)勵。
3.檢察官擔(dan)任法(fa)治副校(xiao)長,要履行哪些主要職責?
最高人民檢察院第九檢察廳(ting)負責人:《工作規(gui)定》第(di)六條、第(di)七條規(gui)定了(le)法(fa)(fa)治副校(xiao)(xiao)長的(de)履(lv)職(zhi)(zhi)內容(rong)。2018年10月,最高(gao)人民(min)檢(jian)(jian)察(cha)(cha)(cha)院向教(jiao)育(yu)部發出《中華人民(min)共(gong)和(he)國最高(gao)人民(min)檢(jian)(jian)察(cha)(cha)(cha)院檢(jian)(jian)察(cha)(cha)(cha)建(jian)議(yi)書》(高(gao)檢(jian)(jian)建(jian)〔2018〕1號(hao)),分析(xi)校(xiao)(xiao)園(yuan)安全(quan)(quan)中存(cun)在(zai)的(de)突出問題,提出有針對性的(de)意見(jian)和(he)建(jian)議(yi)。各地檢(jian)(jian)察(cha)(cha)(cha)機(ji)關在(zai)開展“法(fa)(fa)治進校(xiao)(xiao)園(yuan)”活動(dong)中,聯合(he)教(jiao)育(yu)行(xing)政部門狠抓“一號(hao)檢(jian)(jian)察(cha)(cha)(cha)建(jian)議(yi)”落(luo)實(shi),對加強校(xiao)(xiao)園(yuan)安全(quan)(quan)建(jian)設、預(yu)(yu)(yu)防校(xiao)(xiao)園(yuan)性侵(qin)犯(fan)罪發揮(hui)了(le)積極作用。《工作規(gui)定》第(di)六條根據新(xin)修(xiu)訂的(de)未(wei)成(cheng)年人保(bao)護(hu)法(fa)(fa)、預(yu)(yu)(yu)防未(wei)成(cheng)年人犯(fan)罪法(fa)(fa)加強學(xue)校(xiao)(xiao)保(bao)護(hu)的(de)要求(qiu),結合(he)檢(jian)(jian)察(cha)(cha)(cha)機(ji)關法(fa)(fa)治副校(xiao)(xiao)長工作的(de)實(shi)踐(jian)經驗,著重(zhong)強調了(le)檢(jian)(jian)察(cha)(cha)(cha)機(ji)關開展法(fa)(fa)治副校(xiao)(xiao)長工作的(de)重(zhong)點(dian)內容(rong),要求(qiu)著力督(du)促學(xue)校(xiao)(xiao)落(luo)實(shi)“一號(hao)檢(jian)(jian)察(cha)(cha)(cha)建(jian)議(yi)”,落(luo)實(shi)強制(zhi)報告制(zhi)度、入職(zhi)(zhi)查詢制(zhi)度,協助(zhu)學(xue)校(xiao)(xiao)建(jian)立完(wan)善預(yu)(yu)(yu)防性侵(qin)害、性騷擾(rao)和(he)預(yu)(yu)(yu)防學(xue)生欺凌等校(xiao)(xiao)園(yuan)安全(quan)(quan)防控工作機(ji)制(zhi),也是司法(fa)(fa)保(bao)護(hu)融入學(xue)校(xiao)(xiao)保(bao)護(hu)的(de)具體措施。
隨著檢(jian)察機關法(fa)治(zhi)副校(xiao)(xiao)(xiao)(xiao)長工作(zuo)的(de)深入開(kai)展,法(fa)治(zhi)副校(xiao)(xiao)(xiao)(xiao)長越來(lai)越凸顯“實(shi)職(zhi)(zhi)化”,不(bu)(bu)(bu)僅開(kai)展未(wei)成年人法(fa)治(zhi)宣傳(chuan)教育,還(huan)參與校(xiao)(xiao)(xiao)(xiao)園安全(quan)建設,協助學(xue)(xue)校(xiao)(xiao)(xiao)(xiao)開(kai)展安全(quan)管理(li)(li)和(he)依法(fa)治(zhi)理(li)(li),加強(qiang)未(wei)成年學(xue)(xue)生(sheng)保護。為此,《工作(zuo)規定》結合(he)法(fa)治(zhi)副校(xiao)(xiao)(xiao)(xiao)長工作(zuo)實(shi)踐,進一步擴展了法(fa)治(zhi)副校(xiao)(xiao)(xiao)(xiao)長的(de)履職(zhi)(zhi)范圍(wei)。在第七條(tiao)明確(que)了法(fa)治(zhi)副校(xiao)(xiao)(xiao)(xiao)長除了開(kai)展法(fa)治(zhi)宣傳(chuan)教育工作(zuo)外,還(huan)應當(dang)指導學(xue)(xue)校(xiao)(xiao)(xiao)(xiao)落實(shi)未(wei)成年人保護責任(ren),開(kai)展未(wei)成年人犯罪預防,會同學(xue)(xue)校(xiao)(xiao)(xiao)(xiao)、相(xiang)關部(bu)門,聯(lian)合(he)司法(fa)社工等對相(xiang)對不(bu)(bu)(bu)起(qi)訴、附條(tiao)件(jian)不(bu)(bu)(bu)起(qi)訴,以(yi)及(ji)被(bei)判處非監禁刑的(de)學(xue)(xue)生(sheng)實(shi)施精(jing)準(zhun)幫教、家庭教育指導,協助學(xue)(xue)校(xiao)(xiao)(xiao)(xiao)依法(fa)處理(li)(li)安全(quan)事(shi)故糾紛,參與學(xue)(xue)校(xiao)(xiao)(xiao)(xiao)周(zhou)邊環境治(zhi)理(li)(li)等。比(bi)如,發(fa)現(xian)校(xiao)(xiao)(xiao)(xiao)園周(zhou)邊存在食(shi)品(pin)安全(quan)問題,可(ke)以(yi)通過公益訴訟推動相(xiang)關職(zhi)(zhi)能部(bu)門依法(fa)履職(zhi)(zhi)加強(qiang)管理(li)(li),防止(zhi)危害學(xue)(xue)生(sheng)食(shi)品(pin)安全(quan)事(shi)件(jian)發(fa)生(sheng)。
4.法治(zhi)副校長開展工作,有哪(na)些具體方式?
最高人民檢察院第(di)九檢察廳(ting)負責人:2020年以來(lai),各級檢(jian)察機關積極適(shi)應疫情(qing)防控(kong)常(chang)態,在(zai)教育行政部門、學校的大力支持下,創新法(fa)(fa)治(zhi)(zhi)教育方式(shi)。如加強網(wang)課(ke)建設,內(nei)蒙古(gu)自治(zhi)(zhi)區鄂爾(er)多斯市檢(jian)察院開設“守護娜荷芽•遠程法(fa)(fa)治(zhi)(zhi)課(ke)堂”,與教體局專網(wang)互連互通(tong),一(yi)(yi)次(ci)講座可全覆蓋6萬余名學生。法(fa)(fa)治(zhi)(zhi)宣(xuan)(xuan)傳(chuan)教育“停(ting)課(ke)不(bu)停(ting)學”,形成了線上線下一(yi)(yi)體的法(fa)(fa)治(zhi)(zhi)宣(xuan)(xuan)傳(chuan)教育新態勢。
但是,隨(sui)著法(fa)治(zhi)副校(xiao)長(chang)(chang)履職(zhi)范(fan)圍(wei)的不斷拓展(zhan)(zhan),各地也反映法(fa)治(zhi)副校(xiao)長(chang)(chang)履職(zhi)方式(shi)亟(ji)需進一步明確(que)。《工作規定(ding)(ding)》列舉(ju)了法(fa)治(zhi)副校(xiao)長(chang)(chang)的履職(zhi)方式(shi),包括參(can)與制定(ding)(ding)學(xue)校(xiao)相關制度、開展(zhan)(zhan)法(fa)治(zhi)教育(yu)、法(fa)治(zhi)體驗(yan)、法(fa)治(zhi)學(xue)習、建(jian)設法(fa)治(zhi)社團、提(ti)供法(fa)律咨詢,舉(ju)辦法(fa)治(zhi)培訓等。同(tong)時,《工作規定(ding)(ding)》還(huan)提(ti)出可以結(jie)合學(xue)校(xiao)工作安排、檢察機(ji)關案件辦理情(qing)況,在開學(xue)季、畢(bi)業季、“六一”兒童節、國家(jia)憲(xian)法(fa)日(ri)、國際禁(jin)毒日(ri)等重要時間節點開展(zhan)(zhan)工作,使法(fa)治(zhi)副校(xiao)長(chang)(chang)履職(zhi)方式(shi)不斷豐富(fu)。
