近日(ri),最高人民檢察院、全國婦聯、中國關(guan)(guan)心(xin)下一代工(gong)作(zuo)委員(yuan)會共(gong)同印發《關(guan)(guan)于在(zai)辦理涉未成(cheng)年(nian)人案件中全面開展家(jia)庭教(jiao)育(yu)指導(dao)工(gong)作(zuo)的意(yi)見(jian)》(下稱《意(yi)見(jian)》),大力推動涉案未成(cheng)年(nian)人家(jia)庭教(jiao)育(yu)指導(dao)工(gong)作(zuo),三部(bu)門有關(guan)(guan)負責(ze)人就《意(yi)見(jian)》相關(guan)(guan)問(wen)題回答了記(ji)者的提問(wen)。
不良家庭環境不當監護方式是誘發犯罪深層次原因
記者:請介紹一下(xia)《意見》出臺的(de)背景。
最高檢第九檢察廳負責人:家庭教(jiao)育是教(jiao)育的基(ji)礎和起點(dian),關乎(hu)未(wei)成(cheng)年(nian)(nian)(nian)人(ren)終身發(fa)(fa)展,也關乎(hu)國家發(fa)(fa)展、民(min)族進步(bu)、社會穩定。近年(nian)(nian)(nian)來(lai),未(wei)成(cheng)年(nian)(nian)(nian)人(ren)保護和預防未(wei)成(cheng)年(nian)(nian)(nian)人(ren)犯(fan)罪工作持續(xu)加強、成(cheng)效明顯,但形勢(shi)依然不容(rong)(rong)樂觀。侵(qin)(qin)害未(wei)成(cheng)年(nian)(nian)(nian)人(ren)犯(fan)罪高發(fa)(fa)多發(fa)(fa),性侵(qin)(qin)害、欺凌(ling)、虐待等成(cheng)為社會痛點(dian)和治理(li)難點(dian)。未(wei)成(cheng)年(nian)(nian)(nian)人(ren)犯(fan)罪雖總體數(shu)量有所下降,但犯(fan)罪低齡化(hua)等問題不容(rong)(rong)忽(hu)視。通過對大量個案的分析,我們發(fa)(fa)現不良家庭環(huan)境、不當監護方式是未(wei)成(cheng)年(nian)(nian)(nian)人(ren)走上(shang)違(wei)法(fa)犯(fan)罪道路或(huo)者受到(dao)不法(fa)侵(qin)(qin)害的深層(ceng)次原因。
今(jin)年(nian)(nian)(nian)6月1日(ri),新(xin)修訂(ding)的(de)(de)(de)未(wei)成(cheng)(cheng)年(nian)(nian)(nian)人(ren)(ren)保護(hu)(hu)法(fa)(fa)和預(yu)防未(wei)成(cheng)(cheng)年(nian)(nian)(nian)人(ren)(ren)犯罪法(fa)(fa)正式實(shi)施。“兩法(fa)(fa)”明(ming)確(que)規(gui)定(ding)了(le)監(jian)(jian)護(hu)(hu)人(ren)(ren)及家(jia)庭(ting)成(cheng)(cheng)員的(de)(de)(de)家(jia)庭(ting)教育(yu)(yu)職責(ze),強調未(wei)成(cheng)(cheng)年(nian)(nian)(nian)人(ren)(ren)的(de)(de)(de)父(fu)母(mu)或(huo)者其他監(jian)(jian)護(hu)(hu)人(ren)(ren)對未(wei)成(cheng)(cheng)年(nian)(nian)(nian)人(ren)(ren)的(de)(de)(de)預(yu)防犯罪教育(yu)(yu)負有直(zhi)接(jie)(jie)責(ze)任(ren),同時,明(ming)確(que)公安機關(guan)、檢察機關(guan)、人(ren)(ren)民法(fa)(fa)院(yuan)在辦理(li)(li)案(an)件過程(cheng)中(zhong)發現(xian)實(shi)施嚴重不良行(xing)(xing)為的(de)(de)(de)未(wei)成(cheng)(cheng)年(nian)(nian)(nian)人(ren)(ren)的(de)(de)(de)父(fu)母(mu)或(huo)者其他監(jian)(jian)護(hu)(hu)人(ren)(ren)不依法(fa)(fa)履行(xing)(xing)監(jian)(jian)護(hu)(hu)職責(ze)的(de)(de)(de),可以(yi)責(ze)令其接(jie)(jie)受家(jia)庭(ting)教育(yu)(yu)指(zhi)導(dao)(dao)。根據黨中(zhong)央的(de)(de)(de)部署(shu)要(yao)(yao)求、未(wei)成(cheng)(cheng)年(nian)(nian)(nian)人(ren)(ren)保護(hu)(hu)的(de)(de)(de)形(xing)勢需要(yao)(yao)和法(fa)(fa)律(lv)的(de)(de)(de)明(ming)確(que)規(gui)定(ding),最高檢、全(quan)國婦(fu)聯(lian)、關(guan)工委決(jue)定(ding)在辦理(li)(li)涉(she)未(wei)成(cheng)(cheng)年(nian)(nian)(nian)人(ren)(ren)案(an)件中(zhong)全(quan)面開展家(jia)庭(ting)教育(yu)(yu)指(zhi)導(dao)(dao)工作。

最高檢第九檢察廳負責人:未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)保(bao)(bao)(bao)護(hu)(hu)(hu)(hu)工(gong)作(zuo)(zuo)需要(yao)(yao)家(jia)庭(ting)(ting)(ting)(ting)、學(xue)校(xiao)、社會、網絡、政府、司法共同(tong)發(fa)力。近年(nian)(nian)(nian)(nian)來,檢察機關相繼(ji)推動(dong)建立(li)侵害(hai)未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)案件強(qiang)制報告、入職(zhi)(zhi)查詢等制度,努力為未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)營(ying)造(zao)安全、純凈的(de)(de)(de)(de)外(wai)部環境(jing)。然(ran)(ran)而,外(wai)部環境(jing)的(de)(de)(de)(de)優化(hua)固(gu)然(ran)(ran)重要(yao)(yao),內部環境(jing)的(de)(de)(de)(de)改善更加(jia)關鍵。家(jia)庭(ting)(ting)(ting)(ting)是未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)健(jian)(jian)康成(cheng)長(chang)的(de)(de)(de)(de)基礎(chu),沒有(you)(you)良好(hao)的(de)(de)(de)(de)家(jia)教(jiao)家(jia)風,未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)很難(nan)養成(cheng)良好(hao)的(de)(de)(de)(de)行(xing)為規(gui)范。開(kai)展(zhan)涉(she)案未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)家(jia)庭(ting)(ting)(ting)(ting)教(jiao)育(yu)(yu)指導(dao)(dao)工(gong)作(zuo)(zuo)既是當前(qian)未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)保(bao)(bao)(bao)護(hu)(hu)(hu)(hu)和(he)(he)(he)(he)犯罪(zui)預(yu)防工(gong)作(zuo)(zuo)的(de)(de)(de)(de)現實需要(yao)(yao),也是國(guo)家(jia)對(dui)(dui)家(jia)庭(ting)(ting)(ting)(ting)保(bao)(bao)(bao)護(hu)(hu)(hu)(hu)的(de)(de)(de)(de)監(jian)(jian)(jian)督(du)和(he)(he)(he)(he)支持。其(qi)意(yi)義可以概括為以下幾方面:首先,對(dui)(dui)不(bu)(bu)當家(jia)庭(ting)(ting)(ting)(ting)教(jiao)育(yu)(yu)的(de)(de)(de)(de)干(gan)預(yu)和(he)(he)(he)(he)指導(dao)(dao)是未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)保(bao)(bao)(bao)護(hu)(hu)(hu)(hu)的(de)(de)(de)(de)必然(ran)(ran)要(yao)(yao)求。未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)保(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法規(gui)定父(fu)母或(huo)者(zhe)其(qi)他(ta)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)人(ren)(ren)(ren)(ren)(ren)應當創造(zao)良好(hao)、和(he)(he)(he)(he)睦的(de)(de)(de)(de)家(jia)庭(ting)(ting)(ting)(ting)環境(jing),依法履(lv)行(xing)對(dui)(dui)未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)的(de)(de)(de)(de)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)職(zhi)(zhi)責(ze)和(he)(he)(he)(he)撫養義務。對(dui)(dui)于司法辦(ban)案中發(fa)現的(de)(de)(de)(de)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)人(ren)(ren)(ren)(ren)(ren)違反監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)義務,監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)不(bu)(bu)力、教(jiao)育(yu)(yu)不(bu)(bu)當的(de)(de)(de)(de)問(wen)(wen)題,我們有(you)(you)責(ze)任(ren)也有(you)(you)義務進行(xing)干(gan)預(yu)和(he)(he)(he)(he)指導(dao)(dao)。其(qi)次,強(qiang)化(hua)家(jia)庭(ting)(ting)(ting)(ting)教(jiao)育(yu)(yu)指導(dao)(dao)有(you)(you)利(li)于預(yu)防未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)犯罪(zui)和(he)(he)(he)(he)遭受(shou)侵害(hai)。家(jia)庭(ting)(ting)(ting)(ting)是人(ren)(ren)(ren)(ren)(ren)生的(de)(de)(de)(de)第一(yi)所學(xue)校(xiao),家(jia)長(chang)是孩子的(de)(de)(de)(de)第一(yi)任(ren)老師,家(jia)庭(ting)(ting)(ting)(ting)教(jiao)育(yu)(yu)是預(yu)防犯罪(zui)和(he)(he)(he)(he)遭受(shou)侵害(hai)的(de)(de)(de)(de)第一(yi)道(dao)防線(xian)。再(zai)次,家(jia)庭(ting)(ting)(ting)(ting)教(jiao)育(yu)(yu)指導(dao)(dao)和(he)(he)(he)(he)幫助(zhu)是健(jian)(jian)全未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)監(jian)(jian)(jian)督(du)體系的(de)(de)(de)(de)有(you)(you)效路徑(jing)。目前(qian),對(dui)(dui)于涉(she)案未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)父(fu)母或(huo)者(zhe)其(qi)他(ta)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)人(ren)(ren)(ren)(ren)(ren)的(de)(de)(de)(de)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)監(jian)(jian)(jian)督(du)主要(yao)(yao)有(you)(you)訓誡和(he)(he)(he)(he)剝奪(duo)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)權兩種方式。實踐中對(dui)(dui)不(bu)(bu)當履(lv)行(xing)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)職(zhi)(zhi)責(ze)的(de)(de)(de)(de)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)人(ren)(ren)(ren)(ren)(ren),訓誡發(fa)揮的(de)(de)(de)(de)作(zuo)(zuo)用(yong)往往有(you)(you)限(xian),而撤銷監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)權又是無奈的(de)(de)(de)(de)選擇。無論從未(wei)成(cheng)年(nian)(nian)(nian)(nian)人(ren)(ren)(ren)(ren)(ren)心理發(fa)展(zhan),還是社會穩定的(de)(de)(de)(de)角度考慮(lv),監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)權的(de)(de)(de)(de)剝奪(duo)都應慎之(zhi)(zhi)又慎。對(dui)(dui)于監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)人(ren)(ren)(ren)(ren)(ren)不(bu)(bu)當履(lv)行(xing)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)職(zhi)(zhi)責(ze)的(de)(de)(de)(de)問(wen)(wen)題,在提醒和(he)(he)(he)(he)剝奪(duo)之(zhi)(zhi)間缺少督(du)促、幫助(zhu)這一(yi)中間環節(jie)。開(kai)展(zhan)家(jia)庭(ting)(ting)(ting)(ting)教(jiao)育(yu)(yu)指導(dao)(dao)工(gong)作(zuo)(zuo),強(qiang)化(hua)父(fu)母或(huo)其(qi)他(ta)監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)人(ren)(ren)(ren)(ren)(ren)教(jiao)育(yu)(yu)能(neng)力和(he)(he)(he)(he)責(ze)任(ren)意(yi)識,能(neng)夠(gou)填補監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)監(jian)(jian)(jian)督(du)體系空缺,對(dui)(dui)于健(jian)(jian)全監(jian)(jian)(jian)護(hu)(hu)(hu)(hu)干(gan)預(yu)體系具有(you)(you)十分重要(yao)(yao)的(de)(de)(de)(de)作(zuo)(zuo)用(yong)和(he)(he)(he)(he)價值。
發揮各自職能優勢提升家庭教育指導工作質量效果

全國婦聯家庭和兒童工作部負責人:在全(quan)國范圍內全(quan)面推開涉(she)案(an)未(wei)成(cheng)(cheng)(cheng)年(nian)人家(jia)庭(ting)(ting)教(jiao)(jiao)育(yu)指導(dao)工(gong)(gong)作是有實踐基(ji)(ji)礎(chu)的。各(ge)地檢(jian)察(cha)機關(guan)(guan)(guan)、婦(fu)聯(lian)(lian)(lian)組織、關(guan)(guan)(guan)工(gong)(gong)委在涉(she)案(an)未(wei)成(cheng)(cheng)(cheng)年(nian)人家(jia)庭(ting)(ting)教(jiao)(jiao)育(yu)指導(dao)方面已(yi)經進行了多年(nian)嘗(chang)試和(he)探索。在前期實踐基(ji)(ji)礎(chu)上,最(zui)高(gao)檢(jian)、全(quan)國婦(fu)聯(lian)(lian)(lian)、關(guan)(guan)(guan)工(gong)(gong)委于(yu)去年(nian)開始啟(qi)動《意(yi)見》的起草工(gong)(gong)作。2020年(nian)10月,最(zui)高(gao)檢(jian)與全(quan)國婦(fu)聯(lian)(lian)(lian)組成(cheng)(cheng)(cheng)聯(lian)(lian)(lian)合調研(yan)組,分(fen)別赴四川、江蘇等(deng)地對家(jia)庭(ting)(ting)教(jiao)(jiao)育(yu)指導(dao)工(gong)(gong)作開展(zhan)情況、做法(fa)(fa)(fa)和(he)成(cheng)(cheng)(cheng)效(xiao)進行了深入調研(yan)。結合調研(yan)情況,并(bing)根據未(wei)成(cheng)(cheng)(cheng)年(nian)人保(bao)護法(fa)(fa)(fa)和(he)未(wei)成(cheng)(cheng)(cheng)年(nian)人犯(fan)罪法(fa)(fa)(fa)的法(fa)(fa)(fa)律(lv)精(jing)神(shen)、具體(ti)要(yao)求和(he)職能分(fen)工(gong)(gong),最(zui)高(gao)檢(jian)起草了《意(yi)見》稿,并(bing)在書(shu)面征求各(ge)家(jia)意(yi)見的基(ji)(ji)礎(chu)上,形成(cheng)(cheng)(cheng)了最(zui)終《意(yi)見》。對于(yu)聯(lian)(lian)(lian)合發文共同(tong)開展(zhan)涉(she)案(an)未(wei)成(cheng)(cheng)(cheng)年(nian)人家(jia)庭(ting)(ting)教(jiao)(jiao)育(yu)指導(dao)工(gong)(gong)作,全(quan)國婦(fu)聯(lian)(lian)(lian)和(he)關(guan)(guan)(guan)工(gong)(gong)委高(gao)度贊同(tong)、大力支持。
推動全國涉案未成年人家庭教育指導工作平衡協調發展
記者:《意見》已經下(xia)發實施,下(xia)一(yi)步的工作重點是什么?
中國關工委辦公室負責人:《意(yi)見(jian)》實(shi)施后重(zhong)(zhong)在(zai)落(luo)實(shi)。下一(yi)步的工(gong)(gong)作重(zhong)(zhong)點主要是:一(yi)是指導(dao)各地(di)結(jie)合地(di)區(qu)實(shi)際,制(zhi)定(ding)本地(di)實(shi)施細(xi)則,建立長效工(gong)(gong)作機制(zhi),扎實(shi)推(tui)(tui)進涉案未成(cheng)年人(ren)家庭教育指導(dao)工(gong)(gong)作。二是定(ding)期(qi)總結(jie)督(du)導(dao),推(tui)(tui)動(dong)《意(yi)見(jian)》落(luo)實(shi)。三是及時指導(dao)幫助(zhu),推(tui)(tui)動(dong)全國(guo)涉案未成(cheng)年人(ren)家庭教育指導(dao)工(gong)(gong)作平(ping)衡協調(diao)發展。
記者:新修訂的未(wei)成(cheng)(cheng)年人(ren)保護(hu)法(fa)和預(yu)防未(wei)成(cheng)(cheng)年人(ren)犯罪法(fa)明確了(le)全國(guo)婦聯(lian)、關工(gong)委(wei)在未(wei)成(cheng)(cheng)年人(ren)保護(hu)和預(yu)防未(wei)成(cheng)(cheng)年人(ren)違(wei)法(fa)犯罪工(gong)作(zuo)中的法(fa)定職責(ze),請問在“兩法(fa)”貫(guan)徹落實中,婦聯(lian)組織和關工(gong)委(wei)還將與檢(jian)察機關深化哪些方(fang)面的合作(zuo)?
全國婦聯家庭和兒童工作部負責人:“兩(liang)(liang)法(fa)”規(gui)定了未成(cheng)(cheng)年人(ren)保護(hu)的一(yi)系列制度(du)機制,下一(yi)步(bu)落(luo)實“兩(liang)(liang)法(fa)”的重要任務之一(yi)就是相關制度(du)的落(luo)實。今年,在全面開展家庭教育指(zhi)導工作(zuo)的同時,還將與最(zui)高檢(jian)合(he)力(li)(li)深化強(qiang)制報告等制度(du)落(luo)實,強(qiang)化犯罪預防,切(qie)實加大未成(cheng)(cheng)年人(ren)保護(hu)力(li)(li)度(du)。同時,進一(yi)步(bu)加強(qiang)婦聯組織、檢(jian)察機關聯動機制建設(she),推動未成(cheng)(cheng)年人(ren)司法(fa)保護(hu)制度(du)落(luo)實,強(qiang)化法(fa)治(zhi)宣傳教育,推動法(fa)律政策完善。
中國關工委辦公室負責人:近(jin)年來,關工(gong)委與司法(fa)(fa)機關加強(qiang)(qiang)合(he)(he)作(zuo)(zuo)(zuo),深入開(kai)展青少年普法(fa)(fa)教育,有效(xiao)開(kai)展社(she)會化(hua)幫教活動(dong)(dong),積極配合(he)(he)未成年人保護社(she)會治理創新,充(chong)分(fen)發揮退(tui)休司法(fa)(fa)干警作(zuo)(zuo)(zuo)用,在(zai)青少年法(fa)(fa)治教育和犯(fan)罪(zui)預(yu)防方面合(he)(he)作(zuo)(zuo)(zuo)成效(xiao)顯(xian)著。下一步,關工(gong)委與檢察機關將進一步加強(qiang)(qiang)交流,深化(hua)合(he)(he)作(zuo)(zuo)(zuo),構建聯動(dong)(dong)協(xie)同的工(gong)作(zuo)(zuo)(zuo)機制,探索建立未成年人司法(fa)(fa)保護的社(she)會支持工(gong)作(zuo)(zuo)(zuo)體系,加強(qiang)(qiang)未成年人保護和犯(fan)罪(zui)預(yu)防調研合(he)(he)作(zuo)(zuo)(zuo),充(chong)分(fen)發揮“五(wu)老(lao)”在(zai)關心下一代工(gong)作(zuo)(zuo)(zuo)中(zhong)的積極作(zuo)(zuo)(zuo)用。
