      面對勞動(dong)者日漸多(duo)元的司法(fa)需求,最高人民(min)法(fa)院堅持以習近(jin)(jin)平(ping)新(xin)時代中國特色社(she)會主義思(si)想(xiang)為(wei)指導,全面貫徹黨的二十大(da)精神,深入貫徹習近(jin)(jin)平(ping)法(fa)治思(si)想(xiang),立足和延伸司法(fa)職能,加強審(shen)判指導,制發司法(fa)解釋、司法(fa)建議(yi)書、規(gui)范性(xing)文件,發布典型案例,支持和規(gui)范新(xin)就業(ye)形態,加強超齡勞動(dong)者權益(yi)保障(zhang),鞏固拓展(zhan)根(gen)治欠薪成(cheng)果,多(duo)措并(bing)舉落實(shi)我國勞動(dong)用工(gong)和社(she)會保障(zhang)制度,推動(dong)審(shen)判工(gong)作及(ji)訴源(yuan)治理不斷取得新(xin)成(cheng)效。

      人(ren)民法院對(dui)勞(lao)動爭議(yi)(yi)的妥善化解(jie),不(bu)僅(jin)關涉勞(lao)動者合法權益的維護,更是與經(jing)濟社(she)會發展大(da)局(ju)息(xi)息(xi)相(xiang)關。為(wei)進(jin)一步發揮司法服(fu)務保障(zhang)促進(jin)構(gou)建和諧勞(lao)動關系的職能作(zuo)用及(ji)典(dian)型(xing)案例的引(yin)領(ling)示范價值,最高人(ren)民法院此(ci)次發布六個勞(lao)動爭議(yi)(yi)典(dian)型(xing)案例。這批案例主要有以下幾個特點:

      一是貫徹以(yi)人(ren)民(min)為中(zhong)(zhong)心的(de)(de)(de)發(fa)展理念,更好(hao)滿(man)足勞動(dong)(dong)(dong)者(zhe)對(dui)美好(hao)生(sheng)活的(de)(de)(de)向(xiang)往。就業(ye)(ye)(ye)是最基本(ben)的(de)(de)(de)民(min)生(sheng)。黨中(zhong)(zhong)央、國(guo)務院(yuan)將就業(ye)(ye)(ye)擺(bai)在(zai)經濟社會發(fa)展的(de)(de)(de)優先位(wei)置(zhi),把(ba)穩就業(ye)(ye)(ye)提高(gao)到戰略(lve)高(gao)度通(tong)盤考慮。人(ren)民(min)法院(yuan)保障勞動(dong)(dong)(dong)者(zhe)的(de)(de)(de)工資收入(ru)等基本(ben)需(xu)求,并不(bu)(bu)(bu)斷(duan)滿(man)足勞動(dong)(dong)(dong)者(zhe)在(zai)確認勞動(dong)(dong)(dong)關系、平等就業(ye)(ye)(ye)、休息休假等方面的(de)(de)(de)更高(gao)要(yao)求,促進高(gao)質量充(chong)分(fen)就業(ye)(ye)(ye),實(shi)現體面勞動(dong)(dong)(dong),通(tong)過(guo)奮力書(shu)寫穩就業(ye)(ye)(ye)“答卷”,筑牢“萬(wan)家燈火”的(de)(de)(de)幸福根基。如李某(mou)(mou)(mou)與某(mou)(mou)(mou)服飾公(gong)司(si)(si)勞動(dong)(dong)(dong)爭議案(an)中(zhong)(zhong),李某(mou)(mou)(mou)陪妻(qi)子待產(chan),要(yao)求用(yong)人(ren)單位(wei)支付(fu)護理假工資,人(ren)民(min)法院(yuan)依法予以(yi)支持,減輕女(nv)性(xing)在(zai)育(yu)兒(er)階段的(de)(de)(de)負(fu)擔,推動(dong)(dong)(dong)用(yong)人(ren)單位(wei)構建生(sheng)育(yu)友好(hao)的(de)(de)(de)就業(ye)(ye)(ye)環境。又如某(mou)(mou)(mou)公(gong)司(si)(si)與李某(mou)(mou)(mou)競(jing)業(ye)(ye)(ye)限制糾紛案(an)中(zhong)(zhong),某(mou)(mou)(mou)公(gong)司(si)(si)與普通(tong)員工李某(mou)(mou)(mou)約定競(jing)業(ye)(ye)(ye)限制條款,在(zai)李某(mou)(mou)(mou)入(ru)職新用(yong)人(ren)單位(wei)之后(hou),某(mou)(mou)(mou)公(gong)司(si)(si)要(yao)求李某(mou)(mou)(mou)承擔違約金,人(ren)民(min)法院(yuan)依法認定李某(mou)(mou)(mou)在(zai)日(ri)常工作中(zhong)(zhong)接觸到的(de)(de)(de)公(gong)司(si)(si)信息不(bu)(bu)(bu)屬于核(he)心經營信息,李某(mou)(mou)(mou)不(bu)(bu)(bu)屬于其他負(fu)有保密義務的(de)(de)(de)人(ren)員,充(chong)分(fen)保護勞動(dong)(dong)(dong)者(zhe)的(de)(de)(de)自由(you)擇業(ye)(ye)(ye)權(quan),促進人(ren)力資源有序社會性(xing)流動(dong)(dong)(dong)和合理配置(zhi)。

      二是推動(dong)(dong)(dong)(dong)經(jing)濟(ji)社會(hui)高質(zhi)量發(fa)(fa)展,提升企(qi)業(ye)競(jing)(jing)(jing)爭(zheng)力(li)。在市(shi)場(chang)經(jing)濟(ji)條件下(xia),市(shi)場(chang)主(zhu)體(ti)的(de)(de)生存(cun)發(fa)(fa)展與(yu)(yu)勞(lao)動(dong)(dong)(dong)(dong)人(ren)才競(jing)(jing)(jing)爭(zheng)密(mi)切相關(guan),構成了(le)既相互(hu)促進又相互(hu)制(zhi)(zhi)(zhi)約(yue)(yue)(yue)的(de)(de)關(guan)系(xi)。人(ren)民(min)法(fa)院(yuan)衡(heng)平(ping)保護勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)與(yu)(yu)用人(ren)單位的(de)(de)合法(fa)權益(yi),為(wei)推動(dong)(dong)(dong)(dong)經(jing)濟(ji)社會(hui)高質(zhi)量發(fa)(fa)展,構建公(gong)平(ping)、合理、有序(xu)的(de)(de)良性(xing)市(shi)場(chang)競(jing)(jing)(jing)爭(zheng)環境提供了(le)有力(li)支撐。如張某(mou)(mou)(mou)與(yu)(yu)某(mou)(mou)(mou)體(ti)育公(gong)司(si)勞(lao)動(dong)(dong)(dong)(dong)爭(zheng)議案(an)中,張某(mou)(mou)(mou)與(yu)(yu)某(mou)(mou)(mou)體(ti)育公(gong)司(si)簽(qian)訂(ding)競(jing)(jing)(jing)業(ye)限(xian)制(zhi)(zhi)(zhi)協議,其妻持有95%股份的(de)(de)某(mou)(mou)(mou)公(gong)司(si)與(yu)(yu)某(mou)(mou)(mou)體(ti)育公(gong)司(si)存(cun)在競(jing)(jing)(jing)爭(zheng)關(guan)系(xi)。面對(dui)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)通過配偶(ou)投資(zi)、經(jing)營有競(jing)(jing)(jing)爭(zheng)關(guan)系(xi)企(qi)業(ye)等隱蔽型違反競(jing)(jing)(jing)業(ye)限(xian)制(zhi)(zhi)(zhi)行為(wei),人(ren)民(min)法(fa)院(yuan)在查明(ming)事實的(de)(de)基礎上,認定(ding)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)違反競(jing)(jing)(jing)業(ye)限(xian)制(zhi)(zhi)(zhi)約(yue)(yue)(yue)定(ding),判令(ling)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)返(fan)還競(jing)(jing)(jing)業(ye)經(jing)濟(ji)補(bu)償并(bing)承擔(dan)違約(yue)(yue)(yue)責(ze)任(ren),制(zhi)(zhi)(zhi)止勞(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)違反競(jing)(jing)(jing)業(ye)限(xian)制(zhi)(zhi)(zhi)的(de)(de)行為(wei),有利于(yu)激勵(li)企(qi)業(ye)依法(fa)獲取經(jing)營優勢,促進市(shi)場(chang)經(jing)濟(ji)健康發(fa)(fa)展。又如某(mou)(mou)(mou)公(gong)司(si)與(yu)(yu)李某(mou)(mou)(mou)勞(lao)動(dong)(dong)(dong)(dong)爭(zheng)議案(an),李某(mou)(mou)(mou)作(zuo)為(wei)該公(gong)司(si)研發(fa)(fa)人(ren)員,在辭職后拒(ju)不與(yu)(yu)公(gong)司(si)辦理工(gong)作(zuo)交接手續,致(zhi)使該公(gong)司(si)啟動(dong)(dong)(dong)(dong)備用方案(an),補(bu)救研發(fa)(fa)項目,因遲延交付(fu)樣(yang)機(ji)承擔(dan)了(le)違約(yue)(yue)(yue)責(ze)任(ren),人(ren)民(min)法(fa)院(yuan)依法(fa)判令(ling)李某(mou)(mou)(mou)賠償某(mou)(mou)(mou)公(gong)司(si)損失,維護了(le)用人(ren)單位的(de)(de)合法(fa)權益(yi),有利于(yu)促進企(qi)業(ye)技術創新和產業(ye)升級。

      【基本案情】

      2022年(nian)2月(yue)(yue),崔(cui)某(mou)(mou)(mou)(mou)到(dao)某(mou)(mou)(mou)(mou)高(gao)纖(xian)公司(si)的(de)車(che)(che)間(jian)工(gong)作。2022年(nian)3月(yue)(yue),某(mou)(mou)(mou)(mou)高(gao)纖(xian)公司(si)與該(gai)車(che)(che)間(jian)全體人(ren)(ren)員(含崔(cui)某(mou)(mou)(mou)(mou))簽(qian)(qian)訂車(che)(che)間(jian)承包(bao)協(xie)議(yi)。承包(bao)協(xie)議(yi)約定,崔(cui)某(mou)(mou)(mou)(mou)等要遵守某(mou)(mou)(mou)(mou)高(gao)纖(xian)公司(si)的(de)各項安全制度、本協(xie)議(yi)視為某(mou)(mou)(mou)(mou)高(gao)纖(xian)公司(si)與該(gai)車(che)(che)間(jian)全體人(ren)(ren)員(含崔(cui)某(mou)(mou)(mou)(mou))簽(qian)(qian)訂的(de)集體勞(lao)(lao)動(dong)(dong)合同。某(mou)(mou)(mou)(mou)高(gao)纖(xian)公司(si)于2022年(nian)3月(yue)(yue)、4月(yue)(yue)、5月(yue)(yue)分別向崔(cui)某(mou)(mou)(mou)(mou)支付報酬。2022年(nian)6月(yue)(yue),崔(cui)某(mou)(mou)(mou)(mou)在工(gong)作中(zhong)受傷。崔(cui)某(mou)(mou)(mou)(mou)向某(mou)(mou)(mou)(mou)勞(lao)(lao)動(dong)(dong)人(ren)(ren)事爭議(yi)仲裁(cai)委員會(hui)申請(qing)仲裁(cai),請(qing)求確(que)認(ren)(ren)其(qi)與某(mou)(mou)(mou)(mou)高(gao)纖(xian)公司(si)存在勞(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi)。某(mou)(mou)(mou)(mou)勞(lao)(lao)動(dong)(dong)人(ren)(ren)事爭議(yi)仲裁(cai)委員會(hui)予以支持。某(mou)(mou)(mou)(mou)高(gao)纖(xian)公司(si)不服,訴至人(ren)(ren)民法院(yuan),請(qing)求確(que)認(ren)(ren)其(qi)與崔(cui)某(mou)(mou)(mou)(mou)之間(jian)不存在勞(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi)。

      【裁判結果】

      審理(li)法院認為(wei),崔(cui)(cui)某(mou)具(ju)備勞(lao)(lao)(lao)(lao)動者主(zhu)體資格,某(mou)高(gao)(gao)纖(xian)(xian)公(gong)(gong)司(si)(si)具(ju)備用(yong)(yong)工主(zhu)體資格。崔(cui)(cui)某(mou)自(zi)2022年2月至6月一直(zhi)在(zai)某(mou)高(gao)(gao)纖(xian)(xian)公(gong)(gong)司(si)(si)的(de)生產線工作(zuo),所從(cong)事的(de)工作(zuo)是公(gong)(gong)司(si)(si)業務的(de)組成部分,按(an)月領(ling)取勞(lao)(lao)(lao)(lao)動報(bao)酬。雙方簽訂的(de)承包(bao)協(xie)(xie)議(yi)載明該協(xie)(xie)議(yi)視為(wei)某(mou)高(gao)(gao)纖(xian)(xian)公(gong)(gong)司(si)(si)與崔(cui)(cui)某(mou)等人簽訂的(de)集體勞(lao)(lao)(lao)(lao)動合同,崔(cui)(cui)某(mou)需遵守(shou)公(gong)(gong)司(si)(si)各項安(an)全制度等約定亦證(zheng)實某(mou)高(gao)(gao)纖(xian)(xian)公(gong)(gong)司(si)(si)的(de)相關規章制度適用(yong)(yong)于(yu)崔(cui)(cui)某(mou),崔(cui)(cui)某(mou)接受公(gong)(gong)司(si)(si)的(de)勞(lao)(lao)(lao)(lao)動管(guan)理(li)。審理(li)法院判令崔(cui)(cui)某(mou)與某(mou)高(gao)(gao)纖(xian)(xian)公(gong)(gong)司(si)(si)之(zhi)間存在(zai)勞(lao)(lao)(lao)(lao)動關系。

      隨著市(shi)場經(jing)(jing)濟的(de)(de)轉(zhuan)型(xing)和發展,勞(lao)動(dong)(dong)密(mi)集型(xing)企業出于降低(di)成本(ben)、提高效益(yi)等(deng)考慮(lv),采取種類(lei)多樣的(de)(de)經(jing)(jing)營模式(shi)。實(shi)踐中(zhong)存在部分企業濫用(yong)承(cheng)包(bao)經(jing)(jing)營方(fang)式(shi),通(tong)過(guo)與勞(lao)動(dong)(dong)者(zhe)(zhe)簽(qian)訂(ding)內部承(cheng)包(bao)合(he)(he)(he)同(tong)(tong)規避(bi)訂(ding)立勞(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)(de)情形。用(yong)人單(dan)位以已經(jing)(jing)簽(qian)訂(ding)承(cheng)包(bao)合(he)(he)(he)同(tong)(tong)為由否認與勞(lao)動(dong)(dong)者(zhe)(zhe)之(zhi)間的(de)(de)勞(lao)動(dong)(dong)關(guan)系(xi),轉(zhuan)嫁(jia)用(yong)工風(feng)險。人民法院在判(pan)斷用(yong)人單(dan)位與勞(lao)動(dong)(dong)者(zhe)(zhe)之(zhi)間是否存在勞(lao)動(dong)(dong)關(guan)系(xi)時,不僅要審查(cha)雙方(fang)簽(qian)訂(ding)合(he)(he)(he)同(tong)(tong)的(de)(de)名稱,更要通(tong)過(guo)合(he)(he)(he)同(tong)(tong)的(de)(de)內容和實(shi)際履行情況(kuang)實(shi)質性審查(cha)雙方(fang)之(zhi)間的(de)(de)法律(lv)關(guan)系(xi)是否具(ju)備(bei)勞(lao)動(dong)(dong)關(guan)系(xi)的(de)(de)從屬性特征,準確認定雙方(fang)之(zhi)間的(de)(de)法律(lv)關(guan)系(xi),糾(jiu)正通(tong)過(guo)簽(qian)訂(ding)承(cheng)包(bao)合(he)(he)(he)同(tong)(tong)等(deng)規避(bi)用(yong)人單(dan)位義務的(de)(de)違(wei)法用(yong)工行為,切實(shi)維(wei)護勞(lao)動(dong)(dong)者(zhe)(zhe)的(de)(de)合(he)(he)(he)法權(quan)益(yi)。

      案例二

      勞動者對于是否訂立無固定期限勞動合同具有單方選擇權

      ——張某與某公交公司勞動合同糾紛案

      【基本案情】

      【裁判結果】

      案例三

      競業限制協議不能限制非負有保密義務的勞動者的自主擇業權

      ——某公司與李某競業限制糾紛案

      【基本案情】

      2017年(nian)(nian)(nian)1月(yue)(yue)10日(ri),李某(mou)(mou)入職某(mou)(mou)公司(si)(si)從事(shi)(shi)推拿(na)師工作,雙方(fang)簽訂員工保密協議(yi),約定李某(mou)(mou)離職后(hou)兩年(nian)(nian)(nian)內(nei)不得(de)從事(shi)(shi)同(tong)類(lei)產品(pin)或(huo)同(tong)類(lei)企業(ye)的相關服務(wu)(wu)(wu),否(fou)則應當一次(ci)性向某(mou)(mou)公司(si)(si)支付不低于50000元(yuan)的違約金。2017年(nian)(nian)(nian)11月(yue)(yue),李某(mou)(mou)取得(de)高(gao)級小(xiao)兒推拿(na)職業(ye)培(pei)訓(xun)師證書。2021年(nian)(nian)(nian)5月(yue)(yue),李某(mou)(mou)從該公司(si)(si)離職,7月(yue)(yue)入職某(mou)(mou)社區(qu)衛生服務(wu)(wu)(wu)中心中藥房工作。某(mou)(mou)公司(si)(si)主張(zhang)李某(mou)(mou)掌握該公司(si)(si)的客戶資料、產品(pin)報價方(fang)案、培(pei)訓(xun)課程等信息,屬(shu)于其他(ta)負(fu)有保密義務(wu)(wu)(wu)的人(ren)員,向某(mou)(mou)勞(lao)動(dong)人(ren)事(shi)(shi)爭(zheng)議(yi)仲裁(cai)(cai)委員會申請仲裁(cai)(cai),要求李某(mou)(mou)支付違反競業(ye)限(xian)制義務(wu)(wu)(wu)違約金50000元(yuan),某(mou)(mou)勞(lao)動(dong)人(ren)事(shi)(shi)爭(zheng)議(yi)仲裁(cai)(cai)委員會未予(yu)支持(chi)。某(mou)(mou)公司(si)(si)不服,訴至人(ren)民法院。

      審理(li)(li)法(fa)院認為(wei)(wei),李(li)某(mou)(mou)系某(mou)(mou)公(gong)司(si)的(de)(de)(de)(de)(de)(de)推拿(na)師及培(pei)訓師,不屬于公(gong)司(si)的(de)(de)(de)(de)(de)(de)高(gao)級管理(li)(li)人(ren)員(yuan)(yuan)(yuan)及高(gao)級技(ji)(ji)術人(ren)員(yuan)(yuan)(yuan)。李(li)某(mou)(mou)掌握的(de)(de)(de)(de)(de)(de)客戶資料是提供(gong)服(fu)務過程(cheng)中必然接(jie)(jie)觸到的(de)(de)(de)(de)(de)(de)基本信息(xi),例(li)如客戶名稱、聯系方式等(deng);李(li)某(mou)(mou)接(jie)(jie)觸到的(de)(de)(de)(de)(de)(de)產品報(bao)價(jia)方案對服(fu)務的(de)(de)(de)(de)(de)(de)客戶公(gong)開,潛(qian)在(zai)(zai)(zai)的(de)(de)(de)(de)(de)(de)客戶經(jing)過咨(zi)詢即(ji)可獲得;某(mou)(mou)公(gong)司(si)提供(gong)的(de)(de)(de)(de)(de)(de)培(pei)訓課(ke)程(cheng)雖(sui)然為(wei)(wei)自己制作(zuo)(zuo)的(de)(de)(de)(de)(de)(de)課(ke)件(jian)(jian),但課(ke)件(jian)(jian)內的(de)(de)(de)(de)(de)(de)知識多為(wei)(wei)行(xing)業(ye)內中醫小兒推拿(na)的(de)(de)(de)(de)(de)(de)常識性內容。此(ci)外,李(li)某(mou)(mou)在(zai)(zai)(zai)公(gong)司(si)工作(zuo)(zuo)期間(jian)通過培(pei)訓獲取的(de)(de)(de)(de)(de)(de)按摩推拿(na)知識及技(ji)(ji)能(neng)也是該(gai)行(xing)業(ye)通用的(de)(de)(de)(de)(de)(de)專業(ye)知識及技(ji)(ji)能(neng)。某(mou)(mou)公(gong)司(si)提供(gong)的(de)(de)(de)(de)(de)(de)證(zheng)據僅能(neng)證(zheng)明(ming)李(li)某(mou)(mou)在(zai)(zai)(zai)日常工作(zuo)(zuo)中接(jie)(jie)觸到該(gai)公(gong)司(si)的(de)(de)(de)(de)(de)(de)一(yi)般(ban)經(jing)營信息(xi),而非核心經(jing)營信息(xi)。在(zai)(zai)(zai)正常履職期間(jian)僅接(jie)(jie)觸用人(ren)單位一(yi)般(ban)經(jing)營信息(xi)的(de)(de)(de)(de)(de)(de)勞動者不屬于勞動合(he)同法(fa)第(di)(di)二十四條第(di)(di)一(yi)款規定(ding)的(de)(de)(de)(de)(de)(de)其他(ta)負有(you)保(bao)密義(yi)務的(de)(de)(de)(de)(de)(de)人(ren)員(yuan)(yuan)(yuan)。某(mou)(mou)公(gong)司(si)主張李(li)某(mou)(mou)屬于負有(you)保(bao)密義(yi)務的(de)(de)(de)(de)(de)(de)競業(ye)限(xian)制人(ren)員(yuan)(yuan)(yuan),證(zheng)據不足。審理(li)(li)法(fa)院判令(ling)駁回某(mou)(mou)公(gong)司(si)要(yao)求李(li)某(mou)(mou)支(zhi)付(fu)競業(ye)限(xian)制違約金的(de)(de)(de)(de)(de)(de)訴訟請(qing)求。

      勞動者的配偶投資、經營與勞動者原用人單位存在競爭關系的企業屬于違反競業限制的行為

      ——張某與某體育公司勞動爭議案

      【基本案情】

      研發人員辭職后拒不交接工作給用人單位造成損失的,應承擔賠償責任

      審理法院認為(wei)(wei),根據(ju)《江蘇省(sheng)人(ren)口與計(ji)劃生育條例(li)》第二十四條規(gui)(gui)定,符合(he)本條例(li)規(gui)(gui)定生育子女的(de)夫妻,女方在享受(shou)國家規(gui)(gui)定產(chan)假(jia)的(de)基礎上,延長產(chan)假(jia)不少于(yu)三十天(tian),男方享受(shou)護(hu)(hu)理假(jia)不少于(yu)十五天(tian),假(jia)期(qi)視為(wei)(wei)出勤(qin)(qin),在規(gui)(gui)定假(jia)期(qi)內(nei)照(zhao)發工(gong)資。李(li)某在護(hu)(hu)理假(jia)期(qi)間視為(wei)(wei)出勤(qin)(qin),某服飾公司應當發放工(gong)資。審理法院支持李(li)某要求某服飾公司支付十五天(tian)護(hu)(hu)理假(jia)工(gong)資等訴訟(song)請求。

      近年(nian)來,各地落(luo)實(shi)《中(zhong)(zhong)共中(zhong)(zhong)央 國務(wu)院關于(yu)優化(hua)生育政策促進人口長期均衡發展的(de)決定(ding)》,出臺支持優化(hua)生育的(de)政策措施。在(zai)家庭中(zhong)(zhong),丈夫和妻(qi)子共同(tong)承擔著生兒育女(nv)的(de)責任。陪產護理假(jia)是男職工(gong)在(zai)妻(qi)子生育期間(jian)享有的(de)看護、照料妻(qi)子與(yu)子女(nv)的(de)權利。本(ben)案中(zhong)(zhong),人民(min)法院判令用(yong)(yong)(yong)人單位(wei)支付男職工(gong)護理假(jia)期間(jian)的(de)工(gong)資,有助于(yu)引(yin)導用(yong)(yong)(yong)人單位(wei)嚴格執行國家相關規定(ding),發揮男性在(zai)生育中(zhong)(zhong)不可(ke)或缺的(de)丈夫和父親的(de)角(jiao)色(se)作用(yong)(yong)(yong),強化(hua)兩性在(zai)生育事務(wu)中(zhong)(zhong)的(de)平(ping)等合作,有利于(yu)下一代(dai)的(de)健康成長、生育支持政策體系的(de)進一步完善及人口的(de)高質量發展。
