  • 今年以來十余個省份上調標準 最低工資標準如何確定和調整

      自12月(yue)1日起,內蒙古調(diao)整最低工(gong)(gong)(gong)資(zi)標(biao)準,一類、二(er)類、三類地區全日制月(yue)最低工(gong)(gong)(gong)資(zi)標(biao)準較調(diao)整前各增(zeng)長290元(yuan)(yuan)(yuan)。今年以來(lai),江(jiang)蘇、浙江(jiang)、河南(nan)(nan)、遼寧、吉(ji)林、黑龍(long)江(jiang)、江(jiang)西、湖(hu)北(bei)、湖(hu)南(nan)(nan)等(deng)10余個省份陸續上調(diao)最低工(gong)(gong)(gong)資(zi)標(biao)準。多數省份月(yue)最低工(gong)(gong)(gong)資(zi)漲幅為200元(yuan)(yuan)(yuan)左(zuo)右(you)(you),最高上漲290元(yuan)(yuan)(yuan),個別(bie)省份上漲100元(yuan)(yuan)(yuan)左(zuo)右(you)(you)。從調(diao)整后的水平(ping)看,已有20余個省份第一檔(dang)最低工(gong)(gong)(gong)資(zi)超過2000元(yuan)(yuan)(yuan)。

      調整最低工資標(biao)準有何影響?將惠及哪(na)些人群?就讀(du)者關心(xin)的問(wen)題(ti),記者近日采(cai)訪了內蒙(meng)古、江蘇(su)、湖南等省份人社(she)廳有關負責人。

      問:什(shen)么是最低工資標準(zhun)?如何確定和(he)調整最低工資標準(zhun)?

      答(da):根據勞動法(fa)第四十八條規定,國(guo)家實行最低(di)工(gong)資(zi)保障制度。最低(di)工(gong)資(zi)的具體標準由省、自(zi)治區、直轄市(shi)人民政(zheng)府規定,報國(guo)務院備案。用人單位(wei)支付勞動者的工(gong)資(zi)不得低(di)于當(dang)地最低(di)工(gong)資(zi)標準。

      最(zui)低(di)(di)工(gong)資(zi)標(biao)準(zhun)是指(zhi)勞(lao)動者(zhe)在(zai)法定(ding)(ding)工(gong)作時(shi)間(jian)或(huo)依法簽訂(ding)的(de)(de)勞(lao)動合(he)同約定(ding)(ding)的(de)(de)工(gong)作時(shi)間(jian)內提(ti)供了(le)正常勞(lao)動的(de)(de)前(qian)提(ti)下,用(yong)人(ren)單位依法應(ying)(ying)支(zhi)付的(de)(de)最(zui)低(di)(di)勞(lao)動報(bao)酬。按照《最(zui)低(di)(di)工(gong)資(zi)規定(ding)(ding)》,確定(ding)(ding)和調(diao)整月最(zui)低(di)(di)工(gong)資(zi)標(biao)準(zhun),應(ying)(ying)參考(kao)當地就業者(zhe)及其贍(shan)養(yang)人(ren)口的(de)(de)最(zui)低(di)(di)生活(huo)費(fei)(fei)(fei)用(yong)、城鎮居民消費(fei)(fei)(fei)價格指(zhi)數、職工(gong)個人(ren)繳(jiao)納(na)的(de)(de)社會保(bao)險費(fei)(fei)(fei)和住房公積金、職工(gong)平均(jun)工(gong)資(zi)、經濟發展水(shui)平、就業狀況(kuang)等因素(su)。確定(ding)(ding)和調(diao)整小(xiao)時(shi)最(zui)低(di)(di)工(gong)資(zi)標(biao)準(zhun),應(ying)(ying)在(zai)頒布的(de)(de)月最(zui)低(di)(di)工(gong)資(zi)標(biao)準(zhun)的(de)(de)基(ji)礎上,考(kao)慮單位應(ying)(ying)繳(jiao)納(na)的(de)(de)基(ji)本(ben)養(yang)老保(bao)險費(fei)(fei)(fei)和基(ji)本(ben)醫療(liao)保(bao)險費(fei)(fei)(fei)因素(su),同時(shi)還(huan)應(ying)(ying)適當考(kao)慮非全(quan)日(ri)制(zhi)勞(lao)動者(zhe)在(zai)工(gong)作穩定(ding)(ding)性、勞(lao)動條件(jian)和勞(lao)動強度(du)、福利(li)等方面與全(quan)日(ri)制(zhi)就業人(ren)員之間(jian)的(de)(de)差異。可(ke)以(yi)通過抽(chou)樣(yang)調(diao)查、統計(ji)分析、實地調(diao)研等形式對最(zui)低(di)(di)工(gong)資(zi)調(diao)整進(jin)行(xing)評估,從而合(he)理確定(ding)(ding)標(biao)準(zhun)。

      據(ju)了解,各地(di)分檔調(diao)整最(zui)低(di)(di)工資(zi)標準,主(zhu)要是(shi)考慮到不同地(di)區經(jing)濟發(fa)展水平(ping)、生活成(cheng)本、人口結構、收(shou)入水平(ping)等存在差異,通過(guo)分檔設定最(zui)低(di)(di)工資(zi)標準,可以更好保(bao)障勞動者生活需求。

      問:最低(di)工(gong)資標(biao)準一般(ban)多(duo)久調整一次?

      答:據統(tong)計(ji),近年來各地最(zui)低工資標準一般(ban)每2—3年調(diao)整一次。

      根據《最(zui)低(di)(di)(di)工(gong)(gong)資(zi)規(gui)定》,在(zai)勞(lao)(lao)動者(zhe)(zhe)提(ti)供(gong)正常勞(lao)(lao)動的(de)(de)情(qing)況下,用人單(dan)位應支付給(gei)勞(lao)(lao)動者(zhe)(zhe)的(de)(de)工(gong)(gong)資(zi)不(bu)(bu)得低(di)(di)(di)于當地最(zui)低(di)(di)(di)工(gong)(gong)資(zi)標準。實行(xing)計件工(gong)(gong)資(zi)或(huo)提(ti)成(cheng)工(gong)(gong)資(zi)等工(gong)(gong)資(zi)形式的(de)(de)用人單(dan)位,在(zai)科學合理(li)的(de)(de)勞(lao)(lao)動定額基礎上(shang),其支付勞(lao)(lao)動者(zhe)(zhe)的(de)(de)工(gong)(gong)資(zi)不(bu)(bu)得低(di)(di)(di)于相應的(de)(de)最(zui)低(di)(di)(di)工(gong)(gong)資(zi)標準。各(ge)地最(zui)低(di)(di)(di)工(gong)(gong)資(zi)標準不(bu)(bu)包含延長(chang)工(gong)(gong)作時間(jian)工(gong)(gong)資(zi),中班、夜班、高溫(wen)、低(di)(di)(di)溫(wen)、井下、有毒有害等特殊工(gong)(gong)作環境和(he)條件下的(de)(de)津貼,以及法律(lv)、法規(gui)和(he)國家(jia)規(gui)定的(de)(de)勞(lao)(lao)動者(zhe)(zhe)福(fu)利待(dai)遇等。

      問:上(shang)調最低工資(zi)標準(zhun),將惠(hui)及哪些就業群體?

      答:在江(jiang)蘇,最(zui)低工資標準(zhun)主(zhu)要適用(yong)于(yu)行(xing)政區(qu)域內的(de)企業、民辦(ban)非企業單位(wei)、個(ge)體經(jing)濟組織、基金會(hui)(hui)、會(hui)(hui)計師(shi)事務所、律師(shi)事務所等用(yong)人單位(wei)和與(yu)之(zhi)形成勞動關系的(de)勞動者(zhe)。

      上(shang)調最低(di)(di)工(gong)資(zi)(zi)標(biao)準(zhun)惠及各行(xing)業中(zhong)薪酬較(jiao)低(di)(di)的勞動(dong)者(zhe)(zhe),對新進入(ru)勞動(dong)力市場的勞動(dong)者(zhe)(zhe)也有幫助。對于銷售員、中(zhong)介人(ren)員等(deng)采(cai)用“低(di)(di)底薪+高提成”模式發放工(gong)資(zi)(zi)的勞動(dong)者(zhe)(zhe),上(shang)調最低(di)(di)工(gong)資(zi)(zi)標(biao)準(zhun)可(ke)提高他們(men)在業績低(di)(di)谷時的待遇。

      最(zui)低工資標(biao)準上(shang)調還將惠(hui)及靈(ling)活就(jiu)(jiu)業(ye)(ye)(ye)群(qun)體以及新就(jiu)(jiu)業(ye)(ye)(ye)形(xing)態(tai)勞(lao)(lao)動(dong)(dong)者(zhe)。比如(ru),在(zai)江蘇,對(dui)符(fu)合(he)(he)確(que)立(li)勞(lao)(lao)動(dong)(dong)關(guan)系情形(xing)的靈(ling)活就(jiu)(jiu)業(ye)(ye)(ye)群(qun)體、新就(jiu)(jiu)業(ye)(ye)(ye)形(xing)態(tai)勞(lao)(lao)動(dong)(dong)者(zhe),全(quan)部適用最(zui)低工資標(biao)準相關(guan)要求;對(dui)不(bu)完全(quan)符(fu)合(he)(he)確(que)立(li)勞(lao)(lao)動(dong)(dong)關(guan)系情形(xing)但企業(ye)(ye)(ye)對(dui)勞(lao)(lao)動(dong)(dong)者(zhe)進行勞(lao)(lao)動(dong)(dong)過程管理(li)的新就(jiu)(jiu)業(ye)(ye)(ye)形(xing)態(tai)勞(lao)(lao)動(dong)(dong)者(zhe),明確(que)不(bu)低于用工所在(zai)地最(zui)低小時工資標(biao)準。

      除了關乎(hu)收入水平,最低工資(zi)標準(zhun)還是調(diao)整失(shi)業保險金等相關待(dai)遇的(de)參(can)照(zhao)線,上(shang)調(diao)后能進一步保障勞動者合法(fa)權益。

      問:用人(ren)單位(wei)如果不(bu)執行最低工資標準(zhun),將承擔(dan)什(shen)么(me)責任?勞動者如何維(wei)護(hu)合法權益?

      答:用人(ren)單位(wei)不執行最(zui)低(di)工(gong)(gong)資(zi)標準將違反勞(lao)動(dong)(dong)法、勞(lao)動(dong)(dong)合同法等(deng)法律規定。用人(ren)單位(wei)低(di)于當(dang)(dang)地最(zui)低(di)工(gong)(gong)資(zi)標準支(zhi)付勞(lao)動(dong)(dong)者工(gong)(gong)資(zi)的,應當(dang)(dang)支(zhi)付其差(cha)額(e)部分(fen)。不支(zhi)付的,由(you)勞(lao)動(dong)(dong)行政部門責(ze)令限期支(zhi)付。逾期不支(zhi)付的,依(yi)法責(ze)令用人(ren)單位(wei)向(xiang)勞(lao)動(dong)(dong)者加付賠償金。

      對違反(fan)最低工(gong)資標(biao)準規定的用人單(dan)位,勞(lao)動者(zhe)有權投訴舉報,舉報途徑包括12333熱線、屬地勞(lao)動保障監察機構(gou)等,也可(ke)依法申請勞(lao)動爭議仲(zhong)裁、向人民法院(yuan)提起訴訟。(記者(zhe)  邱超(chao)奕)
