    2018年,湖南全省法(fa)(fa)院(yuan)共審執結(jie)各類行(xing)政案(an)(an)件(jian)(jian)27525件(jian)(jian),結(jie)案(an)(an)率(lv)92.4%,較2017年提高7個百(bai)分點;2018年行(xing)政機關負(fu)責(ze)人出庭(ting)應訴(su)率(lv)達到32.6%,同比提高2.4個百(bai)分點……8月14日,湖南高院(yuan)召開新(xin)聞發布(bu)會,發布(bu)了《2018年湖南法(fa)(fa)院(yuan)行(xing)政案(an)(an)件(jian)(jian)司法(fa)(fa)審查報告(gao)》(以(yi)下簡稱《報告(gao)》),并(bing)公(gong)布(bu)了幾起典(dian)型案(an)(an)例。

    據湖南省高(gao)院副院長楊(yang)翔(xiang)介紹,行(xing)(xing)政(zheng)(zheng)(zheng)訴(su)(su)(su)訟法修改實施三(san)年后,湖南省行(xing)(xing)政(zheng)(zheng)(zheng)訴(su)(su)(su)訟案(an)件(jian)(jian)收案(an)總體(ti)呈現(xian)出六(liu)個方面(mian)特點:行(xing)(xing)政(zheng)(zheng)(zheng)訴(su)(su)(su)訟案(an)件(jian)(jian)收案(an)增(zeng)速放(fang)緩,結(jie)案(an)率不(bu)斷提高(gao);各市州一審行(xing)(xing)政(zheng)(zheng)(zheng)案(an)件(jian)(jian)數量(liang)和增(zeng)長幅度不(bu)均衡;涉訴(su)(su)(su)領(ling)域和案(an)件(jian)(jian)類型日趨多元化;非(fei)訴(su)(su)(su)行(xing)(xing)政(zheng)(zheng)(zheng)執(zhi)行(xing)(xing)案(an)件(jian)(jian)數量(liang)呈下降(jiang)(jiang)趨勢;無效起訴(su)(su)(su)案(an)件(jian)(jian)所占比例較高(gao);判決(jue)行(xing)(xing)政(zheng)(zheng)(zheng)機(ji)關敗訴(su)(su)(su)的(de)案(an)件(jian)(jian)同比有(you)所下降(jiang)(jiang),但判決(jue)撤銷的(de)案(an)件(jian)(jian)數及涉土地(di)、征(zheng)拆類行(xing)(xing)政(zheng)(zheng)(zheng)案(an)件(jian)(jian)敗訴(su)(su)(su)率仍相對較高(gao)。

    據楊(yang)翔介(jie)紹,湖南法院著(zhu)力提升(sheng)行政(zheng)案(an)(an)件(jian)(jian)審(shen)判(pan)(pan)(pan)質效,高(gao)院和各(ge)中(zhong)級法院充(chong)分發(fa)揮行政(zheng)二審(shen)、再審(shen)監督功能,統一裁(cai)判(pan)(pan)(pan)尺度,確保案(an)(an)件(jian)(jian)質量(liang),依法改(gai)(gai)判(pan)(pan)(pan)402件(jian)(jian),發(fa)回重審(shen)249件(jian)(jian),撤銷變更(geng)原裁(cai)定265件(jian)(jian),撤銷原判(pan)(pan)(pan)駁回起(qi)訴108件(jian)(jian)。二審(shen)行政(zheng)案(an)(an)件(jian)(jian)的(de)服判(pan)(pan)(pan)息(xi)訴率67.3%,同比(bi)提高(gao)3.4個(ge)百(bai)分點(dian)。2018年,當事人不服湖南高(gao)院生(sheng)效裁(cai)判(pan)(pan)(pan)申請再審(shen)的(de)823件(jian)(jian),最(zui)高(gao)法院再審(shen)改(gai)(gai)判(pan)(pan)(pan)10件(jian)(jian),改(gai)(gai)判(pan)(pan)(pan)率僅為(wei)1.21%,案(an)(an)件(jian)(jian)質量(liang)得到(dao)最(zui)高(gao)法院充(chong)分肯定。

    為不(bu)斷加大(da)相對(dui)人合(he)法(fa)(fa)(fa)(fa)(fa)權益的保護力度,湖(hu)南法(fa)(fa)(fa)(fa)(fa)院堅持(chi)依法(fa)(fa)(fa)(fa)(fa)受(shou)理(li)行(xing)(xing)(xing)政(zheng)案件,保護相對(dui)人的起訴權。2018年(nian)(nian)全省法(fa)(fa)(fa)(fa)(fa)院新(xin)收一審(shen)行(xing)(xing)(xing)政(zheng)訴訟(song)案件10992件。全面強化對(dui)行(xing)(xing)(xing)政(zheng)機關(guan)依法(fa)(fa)(fa)(fa)(fa)行(xing)(xing)(xing)使職權的監督。通過(guo)多種形(xing)式(shi),督促行(xing)(xing)(xing)政(zheng)機關(guan)落實負責(ze)(ze)人出(chu)庭(ting)應訴制度,2018年(nian)(nian)行(xing)(xing)(xing)政(zheng)機關(guan)負責(ze)(ze)人出(chu)庭(ting)應訴率達(da)到32.6%,同比提高(gao)2.4個百分點(dian)。同時,主動延伸審(shen)判職能作用,針(zhen)對(dui)審(shen)理(li)中發(fa)現(xian)的普遍性(xing)問(wen)題,及時向有關(guan)部門提供綜合(he)性(xing)、預(yu)警性(xing)信(xin)息,2018年(nian)(nian),全省法(fa)(fa)(fa)(fa)(fa)院共發(fa)出(chu)司(si)法(fa)(fa)(fa)(fa)(fa)建議264份,不(bu)斷規范行(xing)(xing)(xing)政(zheng)執法(fa)(fa)(fa)(fa)(fa)工作,督促行(xing)(xing)(xing)政(zheng)機關(guan)依法(fa)(fa)(fa)(fa)(fa)行(xing)(xing)(xing)政(zheng)。

    為(wei)穩步推進(jin)湖(hu)南行(xing)政(zheng)訴(su)訟管(guan)轄(xia)改革各(ge)項工作,2018年,湖(hu)南高院(yuan)在總結(jie)郴州(zhou)(zhou)、永州(zhou)(zhou)、益陽試點經驗的基礎(chu)上,決定自(zi)2019年5月1日起正(zheng)式實(shi)(shi)施全省基層(ceng)法(fa)院(yuan)一審行(xing)政(zheng)案(an)件集中管(guan)轄(xia)工作,并(bing)確定長沙市、衡陽市、懷化市基層(ceng)人民法(fa)院(yuan)一審行(xing)政(zheng)案(an)件分別由長沙、衡陽、懷化三(san)個鐵路運輸法(fa)院(yuan)集中管(guan)轄(xia),其他市州(zhou)(zhou)因地制(zhi)宜分別確定兩個基層(ceng)人民法(fa)院(yuan)集中管(guan)轄(xia)。改革實(shi)(shi)施以來,各(ge)項機制(zhi)運行(xing)正(zheng)常(chang),取得(de)了良好效(xiao)果。

    楊(yang)翔指出,從2018年全省(sheng)法院審結的行政(zheng)案件情況看,行政(zheng)執法及應訴中還有(you)一些問(wen)題,主要(yao)有(you):

    一(yi)是(shi)行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為(wei)程(cheng)序違法(fa)(fa)問題仍然(ran)突出(chu)(chu)。2018年湖南全省(sheng)法(fa)(fa)院一(yi)審行(xing)(xing)(xing)政(zheng)(zheng)案(an)件中,因行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為(wei)程(cheng)序違法(fa)(fa)被(bei)判(pan)決(jue)敗(bai)(bai)訴的(de)(de)案(an)件498件,占全部敗(bai)(bai)訴案(an)件的(de)(de)33.5%。程(cheng)序違法(fa)(fa)是(shi)行(xing)(xing)(xing)政(zheng)(zheng)機(ji)關敗(bai)(bai)訴的(de)(de)主要原因,不少行(xing)(xing)(xing)政(zheng)(zheng)機(ji)關未嚴格(ge)按《湖南省(sheng)行(xing)(xing)(xing)政(zheng)(zheng)程(cheng)序規定(ding)(ding)》的(de)(de)要求執法(fa)(fa)。主要表現為(wei):有(you)的(de)(de)行(xing)(xing)(xing)政(zheng)(zheng)機(ji)關沒(mei)有(you)依法(fa)(fa)、科學、民主決(jue)策;有(you)的(de)(de)隨意(yi)(yi)簡化法(fa)(fa)定(ding)(ding)程(cheng)序,作(zuo)(zuo)出(chu)(chu)行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為(wei)前未依法(fa)(fa)進行(xing)(xing)(xing)催告、公告,未保障(zhang)行(xing)(xing)(xing)政(zheng)(zheng)相對人(ren)陳述(shu)、申(shen)辯和聽證的(de)(de)權利;有(you)的(de)(de)在未經調查、聽取(qu)當事人(ren)意(yi)(yi)見,未出(chu)(chu)具行(xing)(xing)(xing)政(zheng)(zheng)強(qiang)(qiang)制決(jue)定(ding)(ding)的(de)(de)情(qing)況下,根據(ju)上級機(ji)關或領導要求,直接實(shi)施(shi)行(xing)(xing)(xing)政(zheng)(zheng)強(qiang)(qiang)制行(xing)(xing)(xing)為(wei);有(you)的(de)(de)超過法(fa)(fa)定(ding)(ding)期限作(zuo)(zuo)出(chu)(chu)行(xing)(xing)(xing)政(zheng)(zheng)行(xing)(xing)(xing)為(wei),未送達或未依法(fa)(fa)送達相關行(xing)(xing)(xing)政(zheng)(zheng)決(jue)定(ding)(ding);少數地方仍然(ran)存在“先征后(hou)批”“先征后(hou)補”,及以“拆危”“拆違”等方式(shi)實(shi)施(shi)征收等嚴重違反法(fa)(fa)定(ding)(ding)程(cheng)序的(de)(de)行(xing)(xing)(xing)為(wei)。

    二(er)是行(xing)政(zheng)行(xing)為事(shi)(shi)實不(bu)(bu)(bu)清證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju)不(bu)(bu)(bu)足。2018年全省(sheng)法院(yuan)一(yi)審(shen)行(xing)政(zheng)案(an)件(jian)(jian)(jian)中,因行(xing)政(zheng)行(xing)為事(shi)(shi)實不(bu)(bu)(bu)清、證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju)不(bu)(bu)(bu)足判決行(xing)政(zheng)機關(guan)敗訴(su)的案(an)件(jian)(jian)(jian)348件(jian)(jian)(jian),占全部敗訴(su)案(an)件(jian)(jian)(jian)的23.3%。主要表現為:有(you)(you)的行(xing)政(zheng)職(zhi)能部門(men)以“形(xing)(xing)式審(shen)查”為由,對(dui)申請人提交的相(xiang)關(guan)材料(liao)未盡謹慎(shen)審(shen)核義務,或片面采信單(dan)方證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju),對(dui)相(xiang)關(guan)證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju)未進行(xing)必(bi)要的調(diao)查核實,導致行(xing)政(zheng)行(xing)為所依(yi)(yi)據(ju)(ju)(ju)(ju)(ju)的基(ji)礎事(shi)(shi)實認定(ding)(ding)錯(cuo)誤(wu),甚(shen)至(zhi)損害第三(san)人的合法權益;有(you)(you)的行(xing)政(zheng)機關(guan)在執法過(guo)程中不(bu)(bu)(bu)注重收(shou)集和保存證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju),導致在行(xing)政(zheng)訴(su)訟過(guo)程中無法有(you)(you)效舉證(zheng)(zheng)(zheng),而導致證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju)不(bu)(bu)(bu)足;有(you)(you)的行(xing)政(zheng)機關(guan)獲取證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju)的途徑和證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju)形(xing)(xing)式不(bu)(bu)(bu)合法,法院(yuan)在認證(zheng)(zheng)(zheng)時依(yi)(yi)法只能排除,不(bu)(bu)(bu)予采信。如(ru)某(mou)市人社局依(yi)(yi)據(ju)(ju)(ju)(ju)(ju)用人單(dan)位提交的有(you)(you)明顯改(gai)動痕(hen)跡(ji)的證(zheng)(zheng)(zheng)據(ju)(ju)(ju)(ju)(ju)材料(liao),作(zuo)(zuo)出不(bu)(bu)(bu)予認定(ding)(ding)工傷(shang)決定(ding)(ding),事(shi)(shi)實依(yi)(yi)據(ju)(ju)(ju)(ju)(ju)不(bu)(bu)(bu)足,被法院(yuan)判決撤(che)銷并責令重作(zuo)(zuo)。

    三是行(xing)(xing)(xing)(xing)(xing)政主體怠于(yu)履(lv)行(xing)(xing)(xing)(xing)(xing)法定(ding)職(zhi)責。2018年全(quan)(quan)省(sheng)法院一(yi)審(shen)行(xing)(xing)(xing)(xing)(xing)政案件(jian)中,因行(xing)(xing)(xing)(xing)(xing)政機(ji)關(guan)(guan)(guan)不(bu)履(lv)行(xing)(xing)(xing)(xing)(xing)、拖延(yan)履(lv)行(xing)(xing)(xing)(xing)(xing)或不(bu)完全(quan)(quan)履(lv)行(xing)(xing)(xing)(xing)(xing)法定(ding)職(zhi)責被(bei)判(pan)決(jue)敗(bai)訴(su)的(de)案件(jian)151件(jian),占全(quan)(quan)部敗(bai)訴(su)案件(jian)的(de)10.2%。主要(yao)表現在:有(you)的(de)行(xing)(xing)(xing)(xing)(xing)政機(ji)關(guan)(guan)(guan)對行(xing)(xing)(xing)(xing)(xing)政相對人及利害關(guan)(guan)(guan)系人要(yao)求履(lv)行(xing)(xing)(xing)(xing)(xing)法定(ding)職(zhi)責的(de)申請不(bu)處(chu)理(li)、不(bu)答復(fu),或超過法定(ding)期限進行(xing)(xing)(xing)(xing)(xing)處(chu)理(li),甚至將相關(guan)(guan)(guan)申請作(zuo)為信訪事項,以(yi)信訪答復(fu)代替(ti)行(xing)(xing)(xing)(xing)(xing)政決(jue)定(ding);有(you)的(de)行(xing)(xing)(xing)(xing)(xing)政機(ji)關(guan)(guan)(guan)不(bu)履(lv)行(xing)(xing)(xing)(xing)(xing)或遲延(yan)履(lv)行(xing)(xing)(xing)(xing)(xing)保護人身權(quan)、財產權(quan)的(de)法定(ding)職(zhi)責,不(bu)及時、不(bu)依法發放工傷保險金(jin)、撫恤金(jin)等(deng);有(you)的(de)行(xing)(xing)(xing)(xing)(xing)政機(ji)關(guan)(guan)(guan)進行(xing)(xing)(xing)(xing)(xing)處(chu)理(li)、答復(fu)時遺(yi)漏行(xing)(xing)(xing)(xing)(xing)政相對人及利害關(guan)(guan)(guan)系人的(de)申請事項,履(lv)職(zhi)不(bu)全(quan)(quan)面。

    四是沒有(you)(you)法律依據自(zi)行(xing)設(she)權(quan)。2018年全(quan)省(sheng)法院一審行(xing)政(zheng)(zheng)案(an)件中(zhong),因沒有(you)(you)法律依據自(zi)我設(she)權(quan),行(xing)政(zheng)(zheng)機關被判(pan)敗訴(su)的(de)案(an)件93件,占全(quan)部敗訴(su)案(an)件的(de)6.3%。在執法實(shi)踐中(zhong),有(you)(you)的(de)基層政(zheng)(zheng)府對本應屬于村(cun)民自(zi)治決議范疇(chou)的(de)事項作出了行(xing)政(zheng)(zheng)行(xing)為(wei);有(you)(you)的(de)鄉鎮政(zheng)(zheng)府、街(jie)道辦直接行(xing)使本應由規劃、國土部門行(xing)使的(de)違法建筑處(chu)罰、強制拆(chai)除等職(zhi)權(quan);有(you)(you)的(de)地(di)方政(zheng)(zheng)府以(yi)編辦文件的(de)形式,自(zi)己設(she)定機關,擅自(zi)賦予行(xing)政(zheng)(zheng)管(guan)理職(zhi)權(quan)。

    五(wu)是行(xing)(xing)(xing)政(zheng)裁量(liang)權(quan)行(xing)(xing)(xing)使不當。2018年全(quan)省法院一審行(xing)(xing)(xing)政(zheng)案件(jian)中,因(yin)行(xing)(xing)(xing)政(zheng)裁量(liang)權(quan)行(xing)(xing)(xing)使明顯不當而被(bei)判敗訴的(de)案件(jian)71件(jian),占全(quan)部(bu)敗訴案件(jian)的(de)4.8%。主(zhu)要表現在(zai):有(you)的(de)行(xing)(xing)(xing)政(zheng)執法行(xing)(xing)(xing)為(wei)不符合比例(li)原則,行(xing)(xing)(xing)政(zheng)機(ji)關作出的(de)行(xing)(xing)(xing)政(zheng)決定(ding)與(yu)違法行(xing)(xing)(xing)為(wei)的(de)事(shi)實、性質(zhi)、情節、社會危害程(cheng)度不均衡;有(you)的(de)行(xing)(xing)(xing)政(zheng)機(ji)關出爾(er)(er)反(fan)爾(er)(er),不遵循既有(you)先例(li)和(he)慣例(li);有(you)的(de)同等條(tiao)件(jian)下區(qu)別對待(dai),不一視同仁;有(you)的(de)執法過(guo)程(cheng)中考(kao)慮(lv)的(de)因(yin)素不正當,考(kao)慮(lv)問題不夠全(quan)面(mian)、周(zhou)延(yan),沒有(you)保護應該保護的(de)利益。

    六(liu)是行(xing)政(zheng)機(ji)(ji)關的(de)(de)(de)(de)應訴(su)(su)(su)能力仍(reng)有(you)待加強。有(you)的(de)(de)(de)(de)行(xing)政(zheng)機(ji)(ji)關應訴(su)(su)(su)、答(da)辯和(he)舉(ju)證(zheng)存(cun)在消極敷衍等情況(kuang)(kuang)。訴(su)(su)(su)訟中,有(you)的(de)(de)(de)(de)應訴(su)(su)(su)人(ren)員不(bu)(bu)能按照法(fa)(fa)律(lv)規(gui)定(ding)的(de)(de)(de)(de)舉(ju)證(zheng)期限提交(jiao)證(zheng)據(ju),又不(bu)(bu)提出延(yan)期舉(ju)證(zheng)申請,或(huo)者(zhe)提交(jiao)證(zheng)據(ju)不(bu)(bu)全(quan)面,遺漏關鍵證(zheng)據(ju),無法(fa)(fa)進行(xing)有(you)效(xiao)質證(zheng);有(you)的(de)(de)(de)(de)應訴(su)(su)(su)人(ren)員包括委托的(de)(de)(de)(de)律(lv)師,或(huo)者(zhe)缺乏必(bi)要(yao)的(de)(de)(de)(de)行(xing)政(zheng)法(fa)(fa)律(lv)專業(ye)知識和(he)出庭應訴(su)(su)(su)知識,或(huo)者(zhe)對(dui)被訴(su)(su)(su)行(xing)政(zheng)行(xing)為(wei)的(de)(de)(de)(de)主要(yao)情況(kuang)(kuang)不(bu)(bu)熟(shu)悉,對(dui)行(xing)政(zheng)行(xing)為(wei)的(de)(de)(de)(de)事實認定(ding)、作出行(xing)政(zheng)行(xing)為(wei)的(de)(de)(de)(de)法(fa)(fa)律(lv)依據(ju)及法(fa)(fa)定(ding)程(cheng)序缺乏充(chong)分了(le)解(jie),難(nan)以針(zhen)對(dui)案(an)件爭議焦(jiao)點進行(xing)有(you)效(xiao)答(da)辯和(he)回應,個別出庭人(ren)員直(zhi)接表示未(wei)參與被訴(su)(su)(su)行(xing)政(zheng)行(xing)為(wei),不(bu)(bu)了(le)解(jie)具體情況(kuang)(kuang)。

    七(qi)是(shi)少數(shu)地方領導的(de)(de)(de)(de)(de)運用法治思(si)維的(de)(de)(de)(de)(de)能(neng)力和法治方式水平需要(yao)進一步提(ti)(ti)升(sheng)。雖然如今全(quan)省行(xing)(xing)(xing)政機關(guan)負(fu)責(ze)人(ren)(ren)出(chu)(chu)(chu)庭應(ying)訴率(lv)已經由2016年的(de)(de)(de)(de)(de)27.5%上升(sheng)至(zhi)(zhi)2018年的(de)(de)(de)(de)(de)32.6%,但仍低于全(quan)國40%的(de)(de)(de)(de)(de)平均水平。部分出(chu)(chu)(chu)庭應(ying)訴負(fu)責(ze)人(ren)(ren)不(bu)(bu)了解案件基本情況(kuang)(kuang),不(bu)(bu)能(neng)有(you)(you)效的(de)(de)(de)(de)(de)參與庭審,出(chu)(chu)(chu)庭不(bu)(bu)出(chu)(chu)(chu)聲(sheng)、出(chu)(chu)(chu)聲(sheng)不(bu)(bu)出(chu)(chu)(chu)彩(cai)。有(you)(you)的(de)(de)(de)(de)(de)對(dui)人(ren)(ren)民法院提(ti)(ti)出(chu)(chu)(chu)的(de)(de)(de)(de)(de)司法建(jian)議不(bu)(bu)夠重視,沒有(you)(you)及時研究落實并反饋情況(kuang)(kuang)。對(dui)違(wei)法行(xing)(xing)(xing)政的(de)(de)(de)(de)(de)責(ze)任(ren)追(zhui)究不(bu)(bu)到位(wei)。另外,還有(you)(you)少數(shu)行(xing)(xing)(xing)政機關(guan)不(bu)(bu)自覺履行(xing)(xing)(xing)生(sheng)效裁判確定(ding)的(de)(de)(de)(de)(de)義務,甚至(zhi)(zhi)出(chu)(chu)(chu)現(xian)另行(xing)(xing)(xing)作出(chu)(chu)(chu)行(xing)(xing)(xing)政行(xing)(xing)(xing)為抵制法院裁判等情況(kuang)(kuang)。實踐中仍有(you)(you)違(wei)反法律規定(ding),要(yao)求人(ren)(ren)民法院直接(jie)參與征地拆遷等行(xing)(xing)(xing)政性工作,甚至(zhi)(zhi)干預行(xing)(xing)(xing)政案件審理。

    對此,《報告》建議,要進(jin)一(yi)步提升(sheng)法治素養和法治水平,嚴格規(gui)范(fan)公正文明(ming)執法;進(jin)一(yi)步健全和完善體(ti)制機制,強化對行政行為的監(jian)督與問責;進(jin)一(yi)步貫(guan)徹落實(shi)行政訴訟(song)法,全面履行訴訟(song)義(yi)務。
