本報北(bei)京(jing)12月(yue)22日(ri)電(記者賴志凱)今天,北(bei)京(jing)市人(ren)力(li)資(zi)源和(he)社會保(bao)障局(ju)發布(bu)2022年度勞動人(ren)事(shi)爭(zheng)議(yi)仲裁(cai)十大典型案例,涉及新就業形態用工(gong)、非全日(ri)制用工(gong)、不定時(shi)工(gong)作制、工(gong)傷(shang)待遇、年休假(jia)、競業限制、女職工(gong)權益保(bao)護、事(shi)業單(dan)位違約金(jin)爭(zheng)議(yi)等勞動人(ren)事(shi)爭(zheng)議(yi)類型。
喬某(mou)系某(mou)保(bao)(bao)(bao)(bao)安(an)服務(wu)公(gong)(gong)(gong)司(si)(si)(si)乘(cheng)(cheng)務(wu)管理員,于2019年1月(yue)(yue)入職(zhi),工(gong)(gong)(gong)作至2019年10月(yue)(yue)14日(ri),當天在接車時發生交通事故。在職(zhi)期(qi)間,保(bao)(bao)(bao)(bao)安(an)服務(wu)公(gong)(gong)(gong)司(si)(si)(si)未為喬某(mou)繳(jiao)納社(she)會(hui)保(bao)(bao)(bao)(bao)險(xian)費。2020年12月(yue)(yue),北京市(shi)某(mou)區(qu)人(ren)社(she)局作出《認定(ding)工(gong)(gong)(gong)傷(shang)(shang)決定(ding)書(shu)》,認定(ding)喬某(mou)所受傷(shang)(shang)害(hai)為工(gong)(gong)(gong)傷(shang)(shang)。2021年4月(yue)(yue)30日(ri),某(mou)區(qu)勞(lao)動能力鑒(jian)定(ding)委員會(hui)作出鑒(jian)定(ding)結(jie)論為:目前已達到職(zhi)工(gong)(gong)(gong)工(gong)(gong)(gong)傷(shang)(shang)與(yu)(yu)職(zhi)業病致(zhi)殘等級標(biao)準(zhun)捌級。保(bao)(bao)(bao)(bao)安(an)服務(wu)公(gong)(gong)(gong)司(si)(si)(si)認為,入職(zhi)之時,其(qi)與(yu)(yu)喬某(mou)簽訂(ding)《乘(cheng)(cheng)務(wu)管理員勞(lao)動協(xie)議》,約定(ding)喬某(mou)自(zi)愿放棄(qi)社(she)保(bao)(bao)(bao)(bao),其(qi)工(gong)(gong)(gong)資中有(you)一部(bu)分是社(she)保(bao)(bao)(bao)(bao)補(bu)(bu)償(chang)等;事故發生后,雙方訂(ding)立《協(xie)議書(shu)》,其(qi)中載明“……為向(xiang)(xiang)肇事方申請(qing)(qing)補(bu)(bu)償(chang),特向(xiang)(xiang)公(gong)(gong)(gong)司(si)(si)(si)申請(qing)(qing)開具誤(wu)工(gong)(gong)(gong)證明。此證明只限于本人(ren)向(xiang)(xiang)肇事方申請(qing)(qing)補(bu)(bu)償(chang)之用,不(bu)(bu)會(hui)利用此證明對公(gong)(gong)(gong)司(si)(si)(si)進行法律訴訟或責任追究(jiu),與(yu)(yu)公(gong)(gong)(gong)司(si)(si)(si)不(bu)(bu)存在任何法律糾紛”,故不(bu)(bu)同意向(xiang)(xiang)喬某(mou)賠付任何工(gong)(gong)(gong)傷(shang)(shang)待遇。2021年6月(yue)(yue),喬某(mou)向(xiang)(xiang)勞(lao)動人(ren)事爭議仲裁委員會(hui)提出仲裁申請(qing)(qing),要求保(bao)(bao)(bao)(bao)安(an)服務(wu)公(gong)(gong)(gong)司(si)(si)(si)支(zhi)付一次(ci)性傷(shang)(shang)殘補(bu)(bu)助(zhu)金、一次(ci)性工(gong)(gong)(gong)傷(shang)(shang)醫療補(bu)(bu)助(zhu)金、一次(ci)性傷(shang)(shang)殘就業補(bu)(bu)助(zhu)金合計239509元(yuan)。最后,仲裁裁決:保(bao)(bao)(bao)(bao)安(an)服務(wu)公(gong)(gong)(gong)司(si)(si)(si)未依法繳(jiao)納工(gong)(gong)(gong)傷(shang)(shang)保(bao)(bao)(bao)(bao)險(xian)費,致(zhi)使本可由(you)社(she)保(bao)(bao)(bao)(bao)基金列支(zhi)的相關工(gong)(gong)(gong)傷(shang)(shang)保(bao)(bao)(bao)(bao)險(xian)待遇,均(jun)由(you)該(gai)公(gong)(gong)(gong)司(si)(si)(si)全額向(xiang)(xiang)喬某(mou)支(zhi)付。
據了(le)解(jie),今年(nian)以來,全市(shi)勞(lao)動人事(shi)爭(zheng)議(yi)(yi)仲(zhong)裁機構(gou)以依法高效辦理爭(zheng)議(yi)(yi)案(an)(an)(an)件為主線,加(jia)強爭(zheng)議(yi)(yi)源頭(tou)治理,加(jia)大仲(zhong)裁辦案(an)(an)(an)力度,充(chong)分發揮調解(jie)仲(zhong)裁維護企(qi)業生存發展和保(bao)護勞(lao)動者合(he)法權益(yi)的職能作用。今年(nian)1月至11月,全市(shi)勞(lao)動人事(shi)爭(zheng)議(yi)(yi)仲(zhong)裁機構(gou)受理勞(lao)動人事(shi)爭(zheng)議(yi)(yi)案(an)(an)(an)件12.3萬(wan)件,其(qi)中(zhong)仲(zhong)裁結案(an)(an)(an)率為92%,調解(jie)成(cheng)功率為66%,有力維護了(le)勞(lao)動關系和諧與社(she)會穩定。
