      勞動合同期限最后一日被通知走人 法院判決公司需支付30日工資賠償金

      勞(lao)動(dong)合(he)同(tong)期(qi)限(xian)屆滿前,用(yong)(yong)人單(dan)位應當提(ti)前30日將終(zhong)止(zhi)(zhi)或(huo)者續(xu)(xu)訂(ding)勞(lao)動(dong)合(he)同(tong)意(yi)向以(yi)書面形式通知勞(lao)動(dong)者,經協商辦理終(zhong)止(zhi)(zhi)或(huo)者續(xu)(xu)訂(ding)勞(lao)動(dong)合(he)同(tong)手(shou)續(xu)(xu)。用(yong)(yong)人單(dan)位終(zhong)止(zhi)(zhi)勞(lao)動(dong)合(he)同(tong)未提(ti)前30日通知勞(lao)動(dong)者的(de),以(yi)勞(lao)動(dong)者上月(yue)日平均工資(zi)為標準,每延遲(chi)1日支付勞(lao)動(dong)者1日工資(zi)的(de)賠償金。

      近(jin)日(ri),北京一中院審理一起用人(ren)單位申(shen)請撤(che)銷勞動爭議仲裁(cai)裁(cai)決案件,駁回了(le)用人(ren)單位要求撤(che)銷仲裁(cai)裁(cai)決的申(shen)請。用人(ren)單位需按(an)照仲裁(cai)裁(cai)決,向勞動者支(zhi)付勞動合同到期終(zhong)止經濟補(bu)償金、未提前三十日(ri)通知終(zhong)止勞動合同工(gong)資補(bu)償。

      案情回顧

      王(wang)某(mou)(mou)(mou)(mou)(mou)于2019年(nian)1月9日(ri)入職某(mou)(mou)(mou)(mou)(mou)公司(si),雙方簽訂(ding)了期限至(zhi)2022年(nian)1月24日(ri)的固定(ding)期限勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。2022年(nian)1月20日(ri),某(mou)(mou)(mou)(mou)(mou)公司(si)向(xiang)王(wang)某(mou)(mou)(mou)(mou)(mou)出具了終止勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)通(tong)(tong)知(zhi),王(wang)某(mou)(mou)(mou)(mou)(mou)于1月24日(ri)獲悉。王(wang)某(mou)(mou)(mou)(mou)(mou)以要求某(mou)(mou)(mou)(mou)(mou)公司(si)支付高溫補(bu)(bu)貼、解(jie)除勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)經(jing)濟(ji)補(bu)(bu)償(chang)金、未(wei)(wei)提(ti)前(qian)書(shu)面通(tong)(tong)知(zhi)解(jie)除勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)補(bu)(bu)償(chang)金為(wei)由(you),向(xiang)勞(lao)動(dong)(dong)(dong)爭(zheng)議仲(zhong)裁(cai)(cai)(cai)(cai)委(wei)員(yuan)會(hui)提(ti)出仲(zhong)裁(cai)(cai)(cai)(cai)申請,仲(zhong)裁(cai)(cai)(cai)(cai)委(wei)員(yuan)會(hui)部分支持(chi)了王(wang)某(mou)(mou)(mou)(mou)(mou)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)到期終止經(jing)濟(ji)補(bu)(bu)償(chang)金、未(wei)(wei)提(ti)前(qian)三十日(ri)通(tong)(tong)知(zhi)終止勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)工資(zi)補(bu)(bu)償(chang)的仲(zhong)裁(cai)(cai)(cai)(cai)請求,駁回其他仲(zhong)裁(cai)(cai)(cai)(cai)請求。某(mou)(mou)(mou)(mou)(mou)公司(si)不服,向(xiang)北京一(yi)中院申請撤銷仲(zhong)裁(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)決(jue)。

      法院裁判

      法(fa)(fa)院(yuan)生(sheng)效裁(cai)(cai)(cai)(cai)(cai)定(ding)認(ren)為(wei),某(mou)(mou)公(gong)(gong)司(si)依據《中華人民共和國勞(lao)(lao)(lao)動(dong)(dong)(dong)爭議調解仲(zhong)裁(cai)(cai)(cai)(cai)(cai)法(fa)(fa)》第四十(shi)(shi)九條第一款第一項申(shen)請撤(che)銷仲(zhong)裁(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)決,認(ren)為(wei)適用(yong)法(fa)(fa)律、法(fa)(fa)規確有錯誤,其不應支付(fu)(fu)王某(mou)(mou)未(wei)提前(qian)(qian)三(san)十(shi)(shi)日通(tong)(tong)知終(zhong)止勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)工資(zi)補償(chang)(chang)。對(dui)此,法(fa)(fa)院(yuan)認(ren)為(wei),勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)期(qi)限屆滿前(qian)(qian),用(yong)人單位應當(dang)提前(qian)(qian)30日將終(zhong)止或(huo)者(zhe)續(xu)訂勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)意(yi)向以書(shu)面(mian)形式通(tong)(tong)知勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe),經協商辦理終(zhong)止或(huo)者(zhe)續(xu)訂勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)手(shou)續(xu)。用(yong)人單位終(zhong)止勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)未(wei)提前(qian)(qian)30日通(tong)(tong)知勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的(de),以勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)上月日平均工資(zi)為(wei)標準,每延遲(chi)1日支付(fu)(fu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)1日工資(zi)的(de)賠償(chang)(chang)金。仲(zhong)裁(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)決裁(cai)(cai)(cai)(cai)(cai)定(ding)某(mou)(mou)公(gong)(gong)司(si)支付(fu)(fu)王某(mou)(mou)未(wei)提前(qian)(qian)三(san)十(shi)(shi)日通(tong)(tong)知終(zhong)止勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)工資(zi)補償(chang)(chang)符合(he)《北(bei)京市勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)規定(ding)》,并無(wu)不當(dang),故某(mou)(mou)公(gong)(gong)司(si)申(shen)請撤(che)銷仲(zhong)裁(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)決的(de)理由不成立(li),對(dui)于某(mou)(mou)公(gong)(gong)司(si)撤(che)銷仲(zhong)裁(cai)(cai)(cai)(cai)(cai)裁(cai)(cai)(cai)(cai)(cai)決的(de)申(shen)請,法(fa)(fa)院(yuan)予以駁回。

      法官說法

      勞(lao)(lao)(lao)動(dong)合(he)同期(qi)滿終止,用人(ren)單(dan)(dan)(dan)位除依法(fa)支付勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)經濟補償(chang)外,是否需要提前通(tong)知(zhi)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe),《中華人(ren)民共(gong)(gong)和(he)國勞(lao)(lao)(lao)動(dong)法(fa)》和(he)《中華人(ren)民共(gong)(gong)和(he)國勞(lao)(lao)(lao)動(dong)合(he)同法(fa)》雖沒(mei)有明確(que)規定,但可(ke)按所在省市規定和(he)勞(lao)(lao)(lao)動(dong)合(he)同約定執行(xing)。按照北京市規定,用人(ren)單(dan)(dan)(dan)位應當提前30日(ri)(ri)將終止勞(lao)(lao)(lao)動(dong)合(he)同的(de)(de)意(yi)向書面(mian)通(tong)知(zhi)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe),用人(ren)單(dan)(dan)(dan)位未(wei)履行(xing)上述通(tong)知(zhi)義務的(de)(de),每延遲(chi)1日(ri)(ri)應支付勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)1日(ri)(ri)工資(zi)的(de)(de)賠償(chang)金。

      終(zhong)止勞(lao)(lao)動(dong)合同提前通知勞(lao)(lao)動(dong)者,對于(yu)勞(lao)(lao)動(dong)者而言,使其有(you)(you)一定(ding)心理準備,能夠有(you)(you)一個另謀職業的(de)期限與(yu)(yu)規劃;對于(yu)用人單位而言,也便于(yu)安排工作交接(jie)與(yu)(yu)過渡,在一定(ding)程度上減少勞(lao)(lao)動(dong)爭議和糾(jiu)紛(fen),避免不必要的(de)麻煩。

      第四十條 勞(lao)動(dong)合同期限屆滿(man)前,用(yong)人單位應當提前30日將終(zhong)止或者續(xu)訂勞(lao)動(dong)合同意向以(yi)書面形式通知勞(lao)動(dong)者,經協商辦(ban)理終(zhong)止或者續(xu)訂勞(lao)動(dong)合同手續(xu)。

      第四(si)十七(qi)條 用人單位違反(fan)本規定第四(si)十條規定,終止(zhi)勞(lao)(lao)動(dong)合同未提前30日(ri)通(tong)知勞(lao)(lao)動(dong)者的,以勞(lao)(lao)動(dong)者上(shang)月日(ri)平均工資(zi)為標準,每延遲1日(ri)支付勞(lao)(lao)動(dong)者1日(ri)工資(zi)的賠償金。
